A St. Clair County resident is suing a motorist alleging vehicular negligence in a collision on South Jefferson Avenue.
Daryl Ryan of Millstadt filed a lawsuit on Aug. 18 in St. Clair County Circuit Court against Bettie Lange, alleging negligence in an August 2013 fender-bender.
According to the complaint, Lange was operating a motor vehicle eastbound on West White Street near the junction of South Jefferson Avenue in Millstadt; and Ryan was driving northbound on South Jefferson, on or about Aug. 20, 2013.
The suit states that no traffic control device was in place facing northbound traffic, and that Lange’s automobile collided with the plaintiff’s vehicle as a direct and proximate result of negligence.
Ryan alleges Lange failed to keep a proper lookout for other vehicles, control her vehicle, yield the right of way at an intersection, reduce speed to avoid an accident, apply brakes, and swerve or stop before colliding with the plaintiff.
Alleging internal and external injuries, pain and anguish, medical bills, and impaired earning capacity, the plaintiff seeks judgment in his favor for more than $50,000, plus attorney’s fees and costs. Ryan is represented by Ronald J. Foster Jr. of Schoen Walton Telken & Foster in Edwardsville.

A Madison County resident is suing another motorist over allegations of vehicular negligence in an automobile accident on state Route 143 in Madison County.
Jamie Offerman filed a lawsuit on Aug. 26 in Madison County Circuit Court against Kaitlyn Bethany of Highland, alleging various traffic-related infringements in an August 2014 two-car collision.
The lawsuit states that on or about Aug. 22, 2014, when the plaintiff was a passenger in a vehicle stopped at the intersection of state Route 143 and U.S. Route 40 in Madison County, the vehicle in which she was riding was struck by Bethany from the rear.
According to the complaint, the defendant carelessly and negligently followed the plaintiff’s vehicle too closely; failed to keep a proper lookout for other vehicles, obey the rules of the road, exercise reasonable care in the operation of a motor vehicle, reduce speed to avoid an accident, apply brakes, and stop before colliding with the plaintiff.
The suit states that the plaintiff sustained physical injuries causing pain and suffering, lost income, lost enjoyment of life, medical bills, and disability as a direct and proximate result of the defendant’s actions.
The plaintiff seeks judgment in her favor for more than $50,000 plus attorney’s fees and costs. She is represented by Matthew Young of Kuehn, Beasley & Young in Belleville.

Woman accuses St. Clair County police officer of negligence following Shiloh collision
A woman claims she was struck by another motorist after a St. Clair County police officer allegedly cut her off while attempting to pass her vehicle.
Tawana Payne filed a lawsuit on Aug. 19 in St. Clair County Circuit Court against Carrol Rinehart III, St. Clair County, St. Clair County Sheriff’s Department of Belleville, and Jason Williams, alleging several counts of negligence in August 2014 automobile collisions in Shiloh.
According to the complaint, Payne was driving eastbound on Interstate 64 on or about Aug. 20, 2014, when Rinehart, a police officer, allegedly attempted to improperly pass and cut off her vehicle, resulting in Payne's vehicle being struck by Williams' vehicle. The suit states that Rinehart was on duty, but not involved in a law enforcement and/or emergency situation at the time.
Payne alleges Rinehart operated his vehicle “at an outrageously high and excessive rate of speed for the time of day and area of travel,” failed to keep a lookout, observe the plaintiff, reduce speed, control his vehicle, and follow proper protocol. Payne claims to have sustained severe and permanent injuries.
Williams is accused of negligently operating his vehicle and striking the plaintiff's car. The suit did not state the exact circumstances of Williams’ alleged collision.
Claiming loss of income and earning capacity, property damage, and medical bills as a direct and proximate result of the defendant’s actions, the plaintiff seeks more than $50,000 plus attorneys’ fees and costs. Injured woman sues driver following collision on Rock Road
A Madison County resident is suing a motorist on allegations of negligent driving following a 2013 vehicle collision.
Phyllis Campbell filed against Larry E. Douglas on Aug. 24 in Madison County Circuit Court, alleging several traffic violations in the November 2013 collision.
According to the complaint, the defendant was traveling westbound on Rock Road near the intersection of Route 3 in Granite City on or about Nov. 1, 2013. The suit states that Douglas failed to stop or swerve his vehicle at the appearance of danger, drove without keeping his automobile under sufficient control to avoid collision, operated the vehicle at too great a speed for the circumstances, and failed to keep an adequate lookout for traffic ahead of and to the side of his car, crashing into Campbell’s vehicle and causing injuries.
The suit states that Campbell sustained internal and external injuries, pain, suffering, anguish, limitation of daily activities, disability, loss of normal life and medical bills as a direct and proximate result of the defendant’s actions.
The plaintiff seeks judgment in her favor for more than $50,000 plus attorneys’ fees and costs. She is represented by Kenneth Beljanski and Trent West of Brown & Brown in Fairview Heights.

Parents sue East Alton motorist for medical expenses following collision
A Macoupin County family is suing a Madison County resident on allegations of vehicular negligence in a 2014 head-on collision, which allegedly injured the entire family.
George Sronce and Jeanette Sronce filed a lawsuit individually and as next friends of their minor children, Brady Sronce and Brock Sronce, on Aug. 26 in Madison County Circuit Court against Ashley Silkwood of East Alton, alleging traffic violations in a November 2014 accident.
According to the complaint, George Sronce was driving a 2008 Honda CRV eastbound on Brighton-Bunker Hill Road in Brighton Township in Macoupin County with Jeanette, Brady and Brock as passengers on Nov. 16, 2014.
The suit states that Silkwood, operating a 2002 Dodge Durango westbound on the same road, collided with the plaintiffs’ automobile, injuring all four occupants. She is accused of failing to control her vehicle, operate at a safe speed, keep a proper lookout, reduce speed and change lanes safely.
Invoking the Family Expense Act, the plaintiffs contend that both children suffered internal injuries and back injuries requiring medical attention, pharmaceutical intervention and expenses as a direct and proximate result of the defendant’s actions.
The Sronces seek judgment in their favor for more than $50,000 plus attorney’s fees and costs. The family is represented by Richard Reed of Reed and Bruhn in Belleville.

Worker sues Ashley Furniture claiming age discrimination
An Ashley Furniture employee claims her employer violated the Human Rights Act by discriminating against her because of her age.
Debra Frakes filed a lawsuit on Aug. 24 in Madison County Circuit Court against Dufrenese Spencer Group, doing business as Ashley Furniture, and DSG Missouri LLC, also doing business as Ashley Furniture, alleging age discrimination and wrongful treatment at her job over the course of her employment.
According to the complaint, the defendant, a furniture retail operation, hired Frakes on May 11, 2011. She claims the company failed to consider or train her for promotion based on her age (now 61). Instead, she claims the defendant promoted persons outside of the plaintiff’s protected age group who were allegedly less qualified and untrained and permitted employees to make “age critical remarks” to her.
Additionally, the suit states, the defendant not only failed to reimburse the plaintiff for management training testing, but also forced her to give up the training; paid her less than her counterparts; and failed to respond to her complaints to HR regarding age discrimination in the workplace.
Claiming lost wages and humiliation, Frakes seeks judgment in her favor for more than $50,000 plus attorney’s fees and costs. She is represented by Thomas Falb of Williamson, Webster, Falb & Glisson in Alton.

It’s back to court for state and its unions; AFSCME and others seek wages, increases, med payments
State employee unions have returned to court in an effort to lock in continued pay for the fiscal year, get medical claims paid, stop layoffs and retain step pay raises and semi-automatic promotions despite lack of a contract.
At the end of June, Illinois entered fiscal year 2016 without a budget and without new labor contracts, and its biggest unions sought to make sure their members in state government continued to be paid.
The unions have so far succeeded in the courts, and their members continue to work and to be paid despite the lack of a state budget or specific appropriations for payrolls.
On the bargaining front, the unions — led by the American Federation of State, County and Municipal Employees Council 31 — so far have agreed to three “tolling agreements” with first-term Republican Gov. Bruce Rauner’s administration.
In those agreements, both sides promise to stay at the table and work toward a new contract without threat of lockout or strike.
Now, by way of an amended complains filed in St. Clair County Circuit Court on Sept. 4 and on Friday (Sept. 18), the unions are asking the court to again intervene.
“The administration has received a copy of the complaint and is currently reviewing it,” Rauner spokeswoman Catherine Kelly said earlier this week.
Among other things, the unions ask the court to find that any refusal by the state to pay wages in the current fiscal year would be an impairment of contract in violation of the state constitution.
They also argue employees covered in collective bargaining agreements cannot be laid off unless the layoff is due to lack of funds, lack or work or some other reason spelled out in the bargaining agreements.
The unions seek an injunction barring 158 layoffs now scheduled for Sept. 30. They argue the state’s “lack of funds” reason is “demonstrably false.”
The unions say there’s enough money in the state treasury to continue employing the workers facing layoff.
The unions also appear to argue that step increases and semi-automatic promotions are rightfully part of the pay their members should receive.
“The state has refused to pay employees for their step increases pursuant to these step plans since since July 1, 2015,” according to the complaint. “In addition, state employees covered by the AFSCME agreement earn salary increases as they progress through their levels of their classification series by virtue of their time in each title of the series. The state has refused to allow such progression since July 1, 2015.”
On Friday, the unions asked the judge to allow a revision to their filings. They cited the state’s recent disclosure that Illinois won’t be able to cover medical provider billings for thousands of employees, retirees and dependents in the state’s self-insured programs.
“This possibility will inevitably deprive many participants of the insurance provided by their labor agreements and employment contracts,” according to pleadings.
The unions seek relief by way of two strategies, the first being an impairment of contract argument and the other a request for an injunction to aid in arbitration of pending grievances.
The unions argue state employees shouldn’t be caught in the middle when elected leaders can’t agree.
State “employees are now pawns in the political dispute over the state budget,” the complaint said. “They and their families deserve better.”
In their latest agreement to continue negotiations, which was signed Sept. 8, the Rauner administration and AFSCME Council 31 included language acknowledging the two sides did not agree on step increases and semi-automatic promotions and made clear neither side conceded those points.
The agreement also included language saying each side retained all legal rights.
That deal to keep talking — the third such agreement in light of the June 30 contract expiration — came six days after the unions suffered a narrow defeat Sept. 2 on the hotly contested “no strike-no lockout” bill, which the unions backed and the governor opposed.
The plaintiffs in the St. Clair County lawsuit include AFSCME, as well unions representing police officers, teachers, nurses, laborers and others. In total, they represent about 40,000 state employees.
Defendants include the governor, Comptroller Leslie Geissler Munger and Tom Tyrell, who is the director of the state’s Department of Central Management services.
The state has yet to file its answers to the union’s new complaints, and no hearing date had been set as of Friday afternoon.

Washington University rehab facility denies liability in wrongful death case
A Washington University rehabilitation facility denies liability in a widow’s wrongful death lawsuit alleging the facility failed to prevent or recognize a deep vein thrombosis and pulmonary embolism.
Chanta Martin filed a lawsuit for the estate of Rodney Goree on July 1 against The Washington University of St. Louis and ProRehab P.C.
According to the complaint, the plaintiff’s husband died on Oct. 17, 2014. She claims the defendants were guilty of failing to perform a specialized medical test called a Homan’s test on multiple occasions during her husband’s medical examinations and that they negligently failed to recognize, diagnose and prevent or treat his alleged deep vein thrombosis and pulmonary embolism when he was present for treatment on Aug. 29, 2014.
Prorehab answered the complaint on Sept. 2 through attorneys Jonathan Ries and Corey A.T. Stegeman of Sandberg Phoenix & von Gontard in St. Louis, denying the allegations against it.
In its affirmative defenses, the defendant argues that any alleged injuries were not caused by its acts or omissions.
The plaintiff seeks more than $75,000, plus attorney’s fees and costs.

Illinois attorney sued over alleged negligence in trust preparation
A woman is suing an Illinois attorney over claims of negligence in preparing a trust, allegedly resulting in the loss of estate assets.
Abby Benson Razer filed a complaint on Aug. 25 in Madison County Circuit Court against Tammy Julian, alleging negligence.
The complaint states that the late Orville Benson, who died in 2009, retained Julian in April 2007 for the purpose of creating an irrevocable living trust, under which Razer was a beneficiary.
After Orville Benson died, his surviving wife, Shirley Benson, believed she would be protected from a Medicare spend-down under the terms of the trust, but the trust did not in fact protect the Bensons' assets, which were spent down in approximately $400,000.
The complaint alleges Julian was negligent in failing to inquire whether the Bensons had any handicapped relatives, and failing to apply for Veteran benefits available to Orville Benson under Illinois law, which would have spared the asset spend-down and allowed Razer more available assets for her care.
Razer seeks a judgment in excess of $50,000, plus costs of the suit.

Couple sues over faulty pain pump
A Belleville couple is suing over a pain pump that allegedly malfunctioned and caused the wife permanent damage and the husband loss of consortium, under Illinois law.
Theresa Schanz and Edward Schanz filed the suit on Aug. 20 in Saint Clair County Circuit Court against Medtronic, Inc.; Anthony R. Anderson, MD; Memorial Medical Group, LLC; Protestant Memorial Medical Center, Inc.; and St. Elizabeth's Hospital of the Hospital Sisters of the Third Order of St. Francis.; Matthew McCormick, representative of Medtronic, is named a Respondent in Discovery.
On Oct. 7, 2007, Theresa Schanz had implanted a pain pump to relieve spinal pain. On August 20, 2013, defendant Anderson performed a dye study to assess the performance of the pump. The plaintiff says that same day the pump discharged an overdose of narcotic pain medication. On July 31, 2014, the pump was surgically removed at Memorial Hospital.
Theresa Schanz alleges counts of implied warranty, professional negligence and product liability. Concurrently, Edward Schanz is suing for loss of consortium under each individual allegation.
Both seek at least $50,000 plus court costs; they also want a jury trial.

Patient sues after shoulder surgery allegedly results in carpal tunnel syndrome
A Monroe County man is suing several medical practitioners after surgery allegedly resulted in a permanently debilitating condition.
Milton Kish filed the suit on Aug. 31 in Saint Clair County Circuit Court against Donald A. Weimer, M.D.; Belleville Orthopedic Surgeons, Ltd.; Belleville Surgical Center; Surgical Care Affiliates, Inc.; Diane G. Joiner, RN; Mary Diane McCarkel, RN; and Cheryl Raynor, RN.
On Sept. 3, 2013, Weimer and Belleville Orthopedic performed rotator cuff surgery on the plaintiff, after which Weimer applied a sling to the plaintiff with his left hand in a hyper-flexed position, the suit states.
According to the complaint, eight days later the plaintiff complained of numbness in his left hand. On Sept. 26, the plaintiff again visited the doctor, saying he felt his arm pop and that he was still experiencing numbness. An MRI determined the plaintiff had developed carpal tunnel syndrome, which he believes is the result of his hand being hyper-flexed while he was wearing a sling to recover from shoulder surgery.
He says the condition has never improved, despite surgery.
He is suing all the defendants for medical negligence. He seeks at least $50,000, court costs and a jury trial.

Disabled beneficiary sues Allsup over alleged Social Security fraud
A St. Clair County resident is suing an Illinois corporation alleging breach of fiduciary duty and fraud in a disability benefits compliance issue beginning in 2010.
Linda Cramer filed a lawsuit on Aug. 18 in St. Clair County Circuit Court against Allsup Inc. of Belleville, with Aetna Life Insurance Company listed as a respondent in discovery, in a Social Security Disability Insurance (SSDI) benefits dispute dating to August 2010.
According to the complaint, Cramer became disabled on or about Aug. 1, 2010 and was approved for long-term disability insurance benefits by her then-current employer’s provider, Aetna. When asked by Aetna to apply for continued benefits through Allsup, the suit states, she complied on or about Nov. 23, 2010.
The lawsuit states that Cramer was granted benefits on or about Feb. 21, 2011. She claims received notice from Allsup on March 3 that she would be awarded retroactive benefits in the amount of $8,718.00, but then was informed by Aetna on March 8 that she had been allegedly overpaid in the amount of $8,805.18.
The suit states that Allsup, believing a creditor-debtor relationship existed between Aetna and the plaintiff, unlawfully withdrew funds from the plaintiff’s bank account, claiming that it forwarded a portion to Aetna and keeping the rest.
Cramer accuses the defendant with breach of fiduciary duty, fraudulent misrepresentation and concealment—failing to disclose conflicts of interest and material facts, and striving to reduce or eliminate the plaintiff’s bargaining power, as well as failing to refund the balance.
Claiming compensatory, exemplary, punitive and pecuniary damages as a direct and proximate result of the defendant’s actions, the plaintiff seeks judgment in her favor for more than $50,000 plus attorneys’ fees and costs. Med mal case at trial this week in Madison County
Glen Carbon pain management specialist and anesthesiologist Gregory Randle, M.D. and the Edwardsville Ambulatory Surgery Center will be defending claims of negligence at trial this week in Madison County Circuit Court.
Plaintiff Connie Duft of Maryville alleges she suffered a spinal cord injury following a pain management procedure she received in January 2013 for non-debilitating neck pain.
According to her lawsuit, Randle made a steroid injection into Duft's spinal cord instead of into epidural space, which caused atrial fibrillation, weakness and paralysis to her right side, as well as extreme pain.
Duft claims that the defendants allegedly failed to properly monitor her for anxiety, movement and alertness during the cervical epidural steroid injection, and that they failed to stop the procedure when those conditions presented an increased probability of a spinal cord injury.
She further claims the defendants failed to properly evaluate her cervical spine and chose a riskier pain management procedure rather than a safer alternative pain management procedure; failed to properly use live fluoroscopy while making the injections and failed to properly place the needle in the epidural space.
She is represented by Ted Gianaris and G. Michael Stewart of the Simmons firm in Alton. They seek damages for past and future pain and suffering, emotional distress, medical expenses, earnings, caretaking expenses, nursing expenses, adaptive living expenses and the expense of necessary help.
Her husband Ronald Duft seeks damages for medical expenses, emotional distress, wages and loss of consortium.
The defendants have denied negligence.
Randle, represented by Kenneth Burke of Brown and James in Belleville, has stated in his affirmative defenses that "plaintiff failed to follow and comply with medical instructions provided to her at the time of the procedure at issue."
Edwardsville Ambulatory Surgery Center is represented by Richard J. Behr of Behr, McCarter and Potter in St. Louis.
Attempts at mediating the claims failed.
Circuit Judge William Mudge, who served as mediator, wrote on July 10 that there was "no realistic likelihood" that a mediated agreement could be achieved, "although progress was made."

Doctor says patient allowed leg wound to become contaminated with dirt and pet hair
The doctor accused of negligently causing a patient’s leg to be amputated when they allegedly failed to order tests and scans has denied liability and claims the woman failed to attend follow-up appointments and allowed her wounds to become contaminated with dirt and pet hair.
Cynthia Davidson filed her lawsuit on July 2 against Dr. David L. Kee and HSHS Medical Group Inc., doing business as Ankle and Foot Center.
According to the complaint, Davidson claims Kee, a licensed podiatrist, failed to “apply the knowledge and use the skill and care ordinarily used by a reasonably well-qualified health care provider” in decisions that led to Davidson losing her left leg in August 2014.
Davidson claims Kee was negligent when he failed to obtain any arterial studies and didn’t order advanced imaging, MRI or other necessary scans. She also claims Kee failed to obtain a bone biopsy in the presence of a suspected osteomyelitis, the suit states.
Davidson alleges Kee’s negligence caused her left leg to be amputated. She seeks more than $50,000 in damages, plus court costs.
Kee denied the allegations against him in his Aug. 14 answer to the complaint through attorney Mark Bauman of Hinshaw & Culbertson in Belleville.
In his affirmative defenses, Kee argues that Davidson had a duty to exercise reasonable care for her own safety.
He alleges the plaintiff failed to check her foot every other day for wounds even though she was advised to do so by medical professionals, failed to keep follow-up appointments as scheduled, failed to stay off her foot as directed, failed to use her scooter device to eliminate weight bearing on her foot, failed to take her medications and failed to keep the wounds on her foot clean and dressed when she allegedly allowed her wounds to be contaminated with dirt and pet hair.
On Aug. 21, Davidson denied the allegations in her reply to Kee’s affirmative defenses through attorney Joseph A. Bartholomew of Cook, Ysursa, Bartholomew, Brauer & Shevlin in Belleville.
Davidson also filed a motion to strike Lee’s demand and payment for a jury of 12, arguing that the case should be tried by a jury of 6 based on former Gov. Pat Quinn’s Public Act 98-1132.
The motion was granted that same day.
Circuit Judge Andrew Gleeson scheduled a status conference for Oct. 5 at 9 a.m. before granted the defendant’s motion for substitution of judge on Sept. 8.
