BELLEVILLE — A cancer survivor has filed suit against a talcum powder product manufacturer, distributor and seller for allegedly failing to prevent injuries and negligence after a link between talc and cancer was discovered.
Wendy Schwartz filed a complaint Sept. 28 in St. Clair County Circuit Court against Johnson & Johnson, Johnson & Johnson Consumer Co. Inc., Imerys Talc America Inc. and Walgreen Co., alleging that they failed to inform customers of their product's known health hazard.
According to the complaint, the plaintiff alleges that she, as a direct and proximate result of using the defendants' talc-based products, was diagnosed with ovarian cancer, which required past and will require future surgeries and treatment. The plaintiff holds Johnson & Johnson, Johnson & Johnson Consumer Co. Inc., Imerys Talc America Inc. and Walgreen Co. responsible because the defendants allegedly advertised and marketed that talc is safe for human use, failed to provide adequate health and warning information and failed to properly test their product.
The plaintiff requests a trial by jury and seeks judgment against each defendant in a reasonable amount in excess of $50,000, plus punitive damages, costs of this suit and all other relief as the court deems just.
