Woman says fellow motorist was on phone before collision

BELLEVILLE — A woman is suing a fellow motorist for alleged negligence in connection with a collision.

Tricia Held filed a complaint on Sept. 29 in St. Clair County Circuit Court against Neil Lucash, alleging that prior to a collision, the defendant was negligently talking to someone on his cellphone.

According to the complaint, the plaintiff alleges that on Sept. 12, 2015, she was operating her Kia SUV and was stopped for a red light when the defendant suddenly collided with the rear of her vehicle, causing her to sustain injuries and damages that resulted in medical expenses and lost earnings. The plaintiff holds Lucash responsible because the defendant allegedly failed to maintain control of his vehicle and failed to keep proper lookout.

The plaintiff requests a trial by jury and seeks compensation in the sum of $75,000, plus costs of this suit. She is represented by Walter F. Floyd of The Floyd Law Firm PC in St. Louis.
