Marcus Gordon Jr. filed the suit April 19 in Madison County Circuit Court against The New DJ's Bar & Grill Inc. and Shawn B. Barrett.
On June 29, 2015, the plaintiff arrived at the defendant business located at 2526 College Ave., Alton, and the defendant Barrett was also there, consuming alcoholic beverages, according to the complaint. Barrett drank liquor and became intoxicated, the suit alleges.
Barrett then began a verbal altercation with the plaintiff, using racial slurs and attempting to entice the plaintiff into a physical altercation, according to the complaint. The plaintiff left the premises and was sitting inside a vehicle when the defendant came out of the bar and allegedly struck the plaintiff in the face, the suit claims.
The plaintiff left the scene and called his father, who told the plaintiff to meet him back at the defendant bar, according to the suit. Defendant Barrett continued his verbal assault, according to the complaint. Barrett became so agitated, the suit alleges, that he shoved his hands through a window, causing injuries to the plaintiff.
Those include injuries to his
face, chin, arms and hands; he will continue to incur medical bills
for treatment of said injuries; and he has been prevented from
attending to his usual duties and affairs, the suit says.
The plaintiff seeks judgment against the both defendants for all four counts in excess of $50,000 plus court costs and other relief the court deems appropriate. He is represented by William E. Miller III in Alton.
