Plaintiff claims city, college allowed hazard to exist on sidewalk

EDWARDSVILLE – A resident is suing two entities, claiming there were unsafe conditions on a sidewalk for which they were responsible.

Debra M. Fish filed the suit April 12 in Madison County Circuit Court against the city of Alton and Lewis & Clark Community College.

On April 16, 2015, the plaintiff was using a portion of sidewalk owned and maintained by the defendants when she tripped and fell on elevated portions, she claims.

Among the alleged negligent actions by both defendants: allowing the elevated ledge to exist on the sidewalk, failing to eliminate the height variation, ignoring prior complaints about the condition of the sidewalk, and failing to erect warning signs about the dangerous sidewalk.

As a result, the plaintiff tripped and fell, causing her severe injuries, lost wages and value of time, large medical bills and permanent disabilities, the suit alleges.

The plaintiff seeks judgment against both defendants in excess of $50,000 plus court costs and any other remedy the court deems appropriate. She is represented by Gregory M. Tobin of Pratt & Tobin in East Alton.
