Father claims driver in crash became drunk at restaurant

EDWARDSVILLE – The father of two sons is suing on their behalf as well as his own over allegations of being injured by a drunk driver. This action is pursuant to the Dram Shop Act.

Johnny Everage III, and Johnny Everage IV and Jamion Everage, minors by their father and next friend, Johnny Everage III, filed the suit April 8 in Madison County Circuit Court against Red Lobster Hospitality LLC, doing business as Red Lobster #0380.

On April 9, 2015, the defendant sold alcoholic beverages to a customer, who drank them, became intoxicated and caused an automobile crash in which the three Everages were injured, the lawsuit alleges.

Johnny Everage III, on behalf of himself and his two minor sons, seeks $50,000 for each of five counts plus court costs. They are represented by Ralph J. Mendelsohn in Godfrey.
