A man is suing a local municipality over an injury he suffered after stepping on an allegedly insufficient manhole cover.
Andrew Flood filed a complaint July 28 in Madison County Circuit Court against the city of Granite City.
On March 20, Flood was in a vehicle accident at Maryville and Edwardsville roads in Granite City, the lawsuit states, and while waiting for police to arrive, he stopped "on top of a sewer manhole cover, which then flipped, causing plaintiff to fall into the sewer hole."
The defendant is cited with negligence and carelessness for placing a cover that was too small over the hole and failing to secure the cover, maintain a safe sewer system, warn pedestrians about an unsafe condition, and properly maintain its system.
As a result, Flood suffered injuries, pain and suffering, loss of income and employability; and medical expenses.
The plaintiff seeks damages of more than $50,000, plus costs.
The plaintiff is represented by Bruce R. Cook of Cook, Ysursa, Bartholomew, Brauer and Shevlin Ltd. in Belleville.
Madison County Circuit Court case number 15L953.
