Tractor-trailer driver sues former employer for retaliatory discharge

BELLEVILLE – A tractor-trailer driver is suing his former employer for retaliatory discharge after allegedly "stealing company time" to get an MRI.

Anthony Keely filed the suit Jan. 25 in St. Clair County Circuit Court against USF Holland Inc., a transportation company doing business in St. Clair County.

On Feb. 20, 2014, the plaintiff claims he was injured during a tractor-trailer rollover accident. He allegedly hurt his back and neck and sought medical treatment, exercising his rights under the Illinois Workers Compensation Act, the suit states.

On Dec. 21, 2015, an MRI ordered by his physician showed disc abnormality and spinal cord compression. Two days later, the lawsuit says, he claims he further injured his back and neck while lifting a 5,000-pound tote with a pallet jack. He reported the injury according to the defendant's rules.

Then on Dec. 24, he sought medical treatment from a physician who placed him on light duty for four weeks.

On Jan. 5, the plaintiff was called to a meeting with three representatives from the defendant. Jon Kenney, a supervisor, asked the plaintiff to explain the circumstances around his Dec. 23 work injury involving the pallet lift.

The terminal manager, Chris Gula, then allegedly told the plaintiff his workers compensation case was closed and he wasn't entitled to seek further medical treatment, including the Dec. 21 MRI.

The plaintiff explained that he still needed treatment, but Kenney allegedly charged him with “stealing company time” by having the procedure during his work hours. The plaintiff explained he used his lunch break time for the MRI, which took no more than one hour and the MRI company confirmed this, the suit says.

Still, the lawsuit alleges, the plaintiff was terminated on Jan. 5 for “stealing company time.”

As a result of the termination, the plaintiff claims he has lost wages, experienced pain and suffering and been unable to secure employment to support his family.

The suit alleges the defendant's termination of the plaintiff was done with fraud, actual malice and gross negligence. As a result, the plaintiff seeks punitive damages. He also seeks damages against the defendant in the amount of $75,000. He is represented by John H. Leskera of the Leskera Law Firm in Collinsville.

Man alleges he was injured while riding in a Metro bus

BELLEVILLE – A passenger on a city bus is suing over injuries he allegedly received when the bus was involved in an accident.

Julio Smith filed the suit Jan. 14 in St. Clair County Circuit Court against Bi-State Development Agency, doing business as Metro, and Danny Phinney.

According to the complaint, on Oct. 27, 2015, the plaintiff was a passenger on a bus owned and operated by the defendant that was traveling southbound on Mississippi Avenue in Centerville. The driver turned left at an intersection, and the right-hand side of the bus was allegedly struck.

The plaintiff alleges the defendants were negligent in failing to keep a proper lookout, failing to properly apply the brakes, driving too fast for conditions and failing to yield the right-of-way.

As a result of said negligence, the plaintiff claims he sustained injuries to his head, neck, back and arms, expects to pay medical expenses, has suffered disability and has lost wages.

The plaintiff seeks judgment against both defendants in excess of $50,000 plus court costs. He is represented by Thomas C. Rich, Kristina D. Cooksey and Michelle Rich of Thomas C. Rich PC in Fairview Heights.

Man alleges libel and wrongful termination following alleged false statement

BELLEVILLE – A Collinsville man claims he was wrongfully terminated after an alleged statement he made was misinterpreted, published and sent to the managers at his former employment.

Wesley P. Nicolussi filed the suit Feb. 4 in St. Clair County Court against Mike Likert and Sensient Technologies Corporation.

According to the complaint, Nicolussi has been an employee of Sensient for several years.

On Jan. 6, Likert allegedly made a false statement about the plaintiff, specifically that the plaintiff had made a threat of comment that he wished he had a gun to shoot people at his workplace. He also claims someone made an "unprivileged" publication of the statement to the managers at Sensient.

The lawsuit says that no reasonable person present at the time of the alleged statement could have confused anything the plaintiff said for a threat.

The plaintiff claims the publication of the alleged statement damaged his reputation and resulted in his termination on Jan. 14, the suit states.

As a result, the plaintiff claims he incurred lost wages and benefits and other sources of potential income.

He seeks damages in excess of $50,000, plus court costs and other relief as allowed by law. He also requests that the court order Sensient to respond to discovery.

Man sues nursing home over alleged neglect

BELLEVILLE – A man is suing Four Fountains Convalescent Center for negligence and violation of the Nursing Home Care Act following a patient's death.

Albert Prater, as independent administrator of the estate of Juanita Prater, filed the suit Feb. 4 in St. Clair County Circuit Court against Helia Southbelt Healthcare LLC, doing business as Four Fountains Convalescent Center; Bridgemark Healthcare LLC; Crystal Dawn Ransom LPN; Cheryl L. Day LPN and T. Rogers LPN.

According to the complaint, Juanita Prater was a resident of Four Fountains from March 6, 2012 to Feb. 25, 2013. Upon her admission there, she was assessed as a medium risk for falls. However, between April 20, 2012 and Feb. 16, 2013, it was noted by the nursing staff that she had fallen at least six times, the suit states.

Nine days later, the decedent complained of pain to her right hip and was transferred to Memorial Hospital where she underwent surgery to repair a hip fracture.

She died Feb. 6, 2014.

The plaintiff alleges the defendants were negligent in failing to develop an up-to-date plan for the resident, failing to protect the resident from abuse or neglect, failing to provide adequate supervision and assistance and failing to recognize injury to her hip, which allegedly contributed to her death.

The plaintiff seeks a judgment of more than $50,000. He is represented by Paul D. Richter and Caitlin K. Finnegan of Kralovec, Jambois & Schwartz in Chicago.

Fifth District judicial candidates are rated 'highly qualified'; Barberis says panelist who interviewed him was an official he didn't re-appoint

Three of four judicial candidates seeking a seat at the Fifth District Appellate Court have been rated highly qualified by evaluators of the Illinois State Bar Association (ISBA).

But Madison County Circuit Judge John Barberis received a "not qualified" rating, according to results released on Friday. Barberis seeks the Republican nomination to the vacancy created by Justice Bruce Stewart who retires in December. 

Barberis said he was "very disappointed" in the results, but not surprised by them.

He called into question the integrity of the evaluation process, which included a panel of eight ISBA members interviewing him in early February. He said the hour-long interview seemed to go well, and he was given positive feedback on what the ISBA learned about him during 40 hours of investigation conducted beforehand.

When he learned about two weeks ago that he was neither going to get rated "highly qualified" or "qualified," he said the lack of endorsement wasn't the "main reason" he was disappointed. 

It was that one of the panel members who interviewed him was an appointed official from Madison County whom Barberis did not support for re-appointment, he said. 

"The only question he (the official) asked was whether I was going to get financed by Bruce Rauner," Barberis said. "How that has any bearing on my ability to be an appellate judge...It was very, very inappropriate to ask that."

Barberis said he didn't believe the Madison County official he didn't vote to re-appoint should have sat on the panel.

"He should have recused himself," Barberis said. 

Barberis said he answered the question about Rauner financing his campaign, by saying, "You need to ask Bruce Rauner."

Barberis said "rumors and speculation" about Rauner support were rampant months ago when the governor dove hunted at his property. 

"We didn't much discuss politics," Barberis said of the occasion. 

"If he plans on supporting my campaign, I'd certainly be happy to have it."

As of Feb. 29, Barberis had not yet created a finance committee for his appellate court campaign. He also did not organize one during his 2014 campaign for circuit judge. 

He faces no opposition in the March 15 primary. In the November general election, he will face Williamson County Circuit Judge Brad Bleyer, a Democrat.

After Barberis received a rating of 23.60 in the 2014 ISBA advisory poll and the accompanying "not recommended" evaluation in his race against Madison County Associate Judge Clarence Harrison - a Democrat who was "recommended" - Barberis then, as now, shrugged off the poll as a "political statement."

In spite of spending a small fraction of what Harrison's campaign spent, Barberis won the 2014 election by a margin of 54 to 46 percent.

Barberis said he believes the evaluation and polling process is a "tool the Democratic party uses to undermine respect for Republican candidates." 

In the other vacancy created by the retirement of Justice James Wexstten, appointed Justice James "Randy" Moore is running unopposed in the primary as a Republican and Jefferson County Circuit Judge Jo Beth Weber is running unopposed as a Democrat. 

The candidates who were evaluated by members of the ISBA Judicial Evaluations Committee, underwent a comprehensive review, according to the ISBA. It further states:

"This involves a detailed background investigation by members of the ISBA Judicial Evaluations Committee, followed by an in-person interview of the candidate. The Committee then decides whether to rate the candidate Qualified, Highly Qualified or Not Qualified for the judicial office being sought. Ratings based on evaluations are the opinion of the Illinois State Bar Association."

"Judge Brad Bleyer has served as the circuit judge in Williamson County since 2004. He presides primarily over the civil division, although he has served in all divisions of the circuit court. A graduate of Southern Illinois University, he came to the bench after an extensive career as a trial attorney that spanned approximately 20 years. Prior to his career as an attorney he was a teacher and coached youth sports. Judge Bleyer is a native of Williamson County and enjoys a reputation among lawyers as being an impartial and fair jurist who manages his docket efficiently. 

"Justice James 'Randy' Moore was appointed to the Fifth District Appellate Court in December 2014 by the Illinois Supreme Court. Prior to his appointment, he served as a circuit court judge in the First Judicial Circuit, Williamson County, where he presided over a variety of cases. He has served as a circuit court judge since 2007. Before serving as a judge, he was a solo practitioner in Carterville, Williamson County. He also served as a city attorney for Carbondale, Illinois. He received his undergraduate and law degrees from Southern Illinois University.

"Judge Jo Beth Weber has served as the resident circuit judge in Mount Vernon, Jefferson County, since 2012. As a judge, she founded the Jefferson County drug and youth courts, and presides over a variety of cases. She also provides oversight of the courthouse and has led efforts to modernize the courtrooms. Before becoming a judge, she served as a Deputy in the Illinois State Appellate Defender’s office, Associate General Counsel at Southern Illinois University, law clerk to four different appellate justices in the Fifth District, an attorney for the Illinois State’s Attorneys Appellate Prosecutor, and briefly served as an associate in a general practice law firm. Judge Weber is a native of Mount Vernon, having received her undergraduate and law degrees from the University of Illinois. Judge Weber actively serves the Mount Vernon community in various roles."


Alton Rehab and Nursing Center sued for alleged negligence

EDWARDSVILLE – The executor of a woman's estate is suing over negligent health care that allegedly led to her death.

Linda J. Garrett, executor of the estate of June Pearl Sisson, filed the suit Feb. 16 in Madison County Circuit Court against Alton Rehabilitation and Nursing Center LLC, doing business as Alton Rehab and Nursing Center.

The deceased was living at the health care facility on April 13, 2014, when she allegedly suffered a medical emergency later determined to be a stroke. Employees of the defendant, although aware of the situation, failed and refused to obtain medical treatment for her, the lawsuit alleges.

The defendant, by and through its employees, is alleged to be guilty of negligence for failing to notify the decedent's physician of a significant change in her condition, failing to provide immediate treatment for her, failing to provide adequate and properly supervised nursing care to her, failing to supervise and oversee a comprehensive assessment of her needs and neglecting her.

That negligence allegedly caused injury to Sisson, violating the Nursing Home Care Act. It also caused her estate to become liable for large sums of money for medical care, she suffered pain and anguish, and severe and permanent injuries.

The plaintiff seeks a sum in excess of $50,000, court costs and other relief the court deems proper. She is represented by Robert H. Gregory of the Law Office of Robert H. Gregory PC in East Alton.

St. Clair County motorist blames another driver for accident

BELLEVILLE – A St. Clair County motorist is suing a Swansea driver, alleging negligence for injuries he says he received in an automobile accident.
 
Bobby Waterson filed the lawsuit Jan. 19 in St. Clair County Circuit Court against Christine J. Laker of Swansea, alleging negligence.
   
According to the complaint, on Feb. 23, 2015, Waterson was driving his vehicle on state Route 159 near Schlueter-Germain Road in Smithton, and Laker was driving behind the plaintiff's vehicle. She struck the rear of his vehicle due to negligence, the lawsuit says.

The suit says the defendant was negligent by failing to keep a proper lookout, failing to keep her vehicle under proper control, following the plaintiff's vehicle more closely than was reasonable and prudent, and failing to reduce the speed of her vehicle to avoid a collision.

The plaintiff alleges as a result of the negligence, he was injured, has suffered pain and mental anguish, and will continue to incur medical expenses.

Waterson seeks judgment against the defendant in an amount the court deems reasonable and equitable in addition to court costs. He is represented by attorney Alvin C. Paulson of Belleville.

East St. Louis motorist alleges another driver's negligence caused collision

BELLEVILLE – An East St. Louis man is suing a Cahokia motorist, alleging negligence for injuries he says he suffered in an automobile accident.
 
Kelvin H. McNeil filed the lawsuit Jan. 21 in St. Clair County Circuit Court against Gale L. Mims of Cahokia, alleging negligence.
  
According to the complaint, on March 31, 2015, McNeil was operating his vehicle eastbound on Camp Jackson Road near the Interstate Highway 55 on- and off-ramps in Cahokia and, concurrently, Mims also was driving eastbound along the same stretch of roadway.

Because of several negligent acts, the suit says, Mims' vehicle rear-ended the the plaintiff' car. The lawsuit states Mims was driving too fast for conditions, failed to keep her vehicle under proper control, failed to keep a lookout, failed to apply the brakes in time to avoid losing control of her vehicle, and failed to stop her vehicle when danger was imminent.

As a result of the collision, the plaintiff alleges he sustained serious injuries, will be prevented from attending to his usual duties and occupation and will continue to lose wages, profits and value of that time, and will continue to have medical bills.

McNeil seeks more than $50,000, plus court costs. He is represented by attorney Clay B. St. Clair of Crowder & Scoggins LTD in Columbia.

Belleville customer blames Menard's for fall in snow

BELLEVILLE – A Belleville man is suing Menard's, alleging negligence for injuries he says he suffered when he fell on snow at the defendant's O'Fallon store.

William R. Moseley Jr. filed the lawsuit Feb. 9 in St. Clair County Circuit Court against Menard Inc., a snow removal contractor whose name is unknown, and the general manager of Menards, at 1179 Central Park Drive, O'Fallon.

According to the complaint, on Feb. 15, 2014, Moseley parked his vehicle in the parking lot at Menards and attempted to walk to the entrance of the store. As he was walking across the parking lot, the suit says, he stepped onto slush that concealed solid ice from snow that had been plowed and piled in the lot.

The lawsuit alleges the defendants were negligent in failing to adequately supervise the snow-removal from the parking lot, failing to warn customers the lot could have slick spots, failing to remove ice and snow from where customers walk and failing to adequately treat the piles of snow to prevent re-freezing.

As a result, the plaintiff alleges he suffered injuries to his right arm that required surgery. He says he has experienced physical pain and suffering, continues to incur medical bills, has been unable to attend to his customary activities, and will be permanently disabled.

Moseley seeks from each defendant more than $50,000, plus court costs. He is represented by attorney Rhonda D. Fiss of Belleville.

Real estate agent accuses Diamond State Insurance of breach of contract

BELLEVILLE – A real estate agent is suing her insurance company, alleging refusal to adhere to all provisions of her policy.

Geraldine A. Davidson filed the lawsuit Feb. 1 in St. Clair County Circuit Court against Diamond State Insurance Company, alleging breach of contract.
   
Davidson, a licensed real estate broker, was insured by Diamond State under a real estate errors and omission insurance policy as of the date of this lawsuit. On Aug. 17, 2006, the suit says, she was sued for alleged wrongdoing while she was covered under the policy.

The lawsuit says Davidson properly reported the lawsuit to Diamond State because the allegations related to her conduct as a professional. The suit alleges the defendant agreed to defend the plaintiff under all provisions of the contract except for one--her ability to hire her own choice of counsel.

The lawsuit states that because assigned counsel of its choosing, which the plaintiff did not agree to, she has been required to hire her own private counsel and pay for said counsel from her own funds, incurring legal fees and costs which have not been reimbursed by the defendant.

The lawsuit argues Diamond State, under Illinois law, does not have the right to force its own counsel in such a situation. As a result, the plaintiff has suffered monetary damages, the suit says.
  
Davidson seeks damages, costs and interest between $50,000 and $70,000. She is represented by attorney Michael S. Williams of Belleville.

Tenant sues after slipping on snow and ice outside his O'Fallon residence

BELLEVILLE – An O'Fallon man is suing over injuries he allegedly suffered when he slipped and fell on the snow- and ice-covered sidewalk outside his residence.

Charles E. Love III filed the suit Feb. 4 in St. Clair County Circuit Court against Trend Management LLC, Georgetowne Homeowners' Association and Georgetowne I Homeowners' Association.

According to the complaint, on Feb. 6, 2014, Love walked outside his residence at 418 Colleen Drive in O'Fallon when he allegedly slipped and fell on accumulated ice and snow. They suit says Trend Management attempted to remove the hazard, but it was allegedly negligent in doing so.

Love alleges the defendants were negligent in failing to place a melting agent on the sidewalk or front porch of the plaintiff's residence, failing to warn plaintiff of the hazard outside his residence, failing to inspect the sidewalk and porch to check the work done, aggravation of a natural accumulation of snow by carelessly attempting to remove it and failing to remove all snow and ice outside the plaintiff's residence.

The plaintiff also cites breach of contract against all defendants.

As a result, the plaintiff claims he injured his back and fractured his left heel, suffered pain, lost wages and a normal life, and incurred medical bills to treat his injuries.

The plaintiff seeks a judgment in excess of $50,000 for each count against each defendant plus court costs. He is represented by Michael P. Glisson and Timothy J. Chartrand of Williams, Webster, Falb & Glisson in Alton.

Woman alleges wrongful termination from Bria Health Services

BELLEVILLE – A former nursing home employee is suing Bria Health Services for alleged wrongful termination after she refused to alter health questionnaires.  

Rachel Hadjan filed the suit Feb. 9 in St. Clair County Circuit Court against Bria Health Services LLC in Belleville.

According to the complaint, on June 18, 2015, the plaintiff began working at the nursing home as the Social Service Director. From June 18 until her termination on Jan. 29, the plaintiff says she believes she performed her duties in a satisfactory manner and never received any discipline.

The only exception taken to the plaintiff's work, the lawsuit alleges, concerned her administration of the Patient Health Questionnaire, an instrument used by nursing homes for screening, monitoring, diagnosing and measuring the severity of depression in residents.

The suit alleges the defendant criticized the plaintiff for not over-reporting the existence of depression in the home's residents so that the defendant could collect additional funds from Medicare. The suit says the defendant consistently counseled and encouraged the plaintiff to artificially increase the scores on the questionnaire so it could obtain more funding.

When the plaintiff refused, she was discharged Jan. 29 without explanation, the lawsuit alleges. She claims the termination was related to her refusal to alter the questionnaires.

As a result, the plaintiff has sustained monetary damages including wages and benefits.

The plaintiff seeks actual and punitive damages in excess of $50,000 plus attorney fees and court costs. She is represented by John H. Leskera of the Leskera Law Firm in Collinsville.

Motorist blames Family Foods & Concessions, driver for accident

BELLEVILLE – A female motorist is suing a Missouri foods business, alleging negligence for injuries she says she suffered when a pickup truck towing a cargo trailer collided with her vehicle.

Courtney Nihells filed the lawsuit Jan. 8 in St. Clair County Circuit Court against Family Foods & Concessions LLC, a Missouri company, and David Penn, alleging negligence.
   
According to the complaint, on Nov. 2, Nihells was driving her vehicle southbound on state Route 203 in St. Clair County and Penn was operating a pickup truck towing an enclosed-cargo trailer. The truck is owned by Family Foods & Concessions and Penn was driving it in the course of his employment, the suit says.

The lawsuit alleges Penn pulled into the path of Nihells' vehicle because the defendant failed to keep a proper lookout, failed to yield, drove too fast for conditions and failed to reduce his speed, failed to operate the vehicle in a single lane of traffic and violated a yield sign.
As a result of the collision, the plaintiff alleges she was severely injured, especially to her lower right extremity, right knee, right hand and right foot. She says will continue to lose wages and will continue incurring medical expenses.

Nihells seeks a trial by jury, plus at least $50,000 from both defendants and court costs. She is represented by attorneys Todd Muchnick and Aaron D. Haber of Muchnick & Haber LC of St. Louis.
