Pensions, salaries, pension: Illinoisans pay 2.5 times for their politicians
According to the Commission on Government Forecasting and Accountability, the average legislative salary currently equals almost $82,000 – already too high for what is legally a part-time job.
But on top of paying for state politicians’ salaries, Illinois taxpayers must also contribute toward their lawmakers’ pension fund. In 2017, taxpayers will contribute the equivalent of nearly $123,000 for each Illinois lawmaker just to keep the General Assembly Retirement System, or GARS, from going bankrupt. That’s one and a half times more than the average legislative salary.
To be clear, the average GARS member won’t receive $123,000 in annual pension benefits. The current average pension for a General Assembly retiree is about $58,400.
Rather, the $123,000 taxpayer contribution per active lawmaker is the amount taxpayers are being forced to pay to keep the legislative pension plan from going bankrupt. GARS is the worst-funded state-run pension plan with just 16 percent of the funding it needs today to meet its future obligations.
To help prop up the system, the state (taxpayers) next year will contribute 17 times more than lawmakers will toward politicians’ pensions. In fiscal year 2017, the state will contribute nearly $21.7 million, while lawmakers, on the other hand, will put in just $1.28 million toward their own pensions.
By 2045, taxpayers will pay more than $31.8 million a year into GARS, while lawmakers will contribute just $1.9 million.
Given the disastrous performance of GARS and its burden on taxpayers, why haven’t Illinois politicians reformed their own retirement plan?
Politicians face no obstacles to reforming their own retirement system. They have no unions to oppose reforms in court.
But there’s a likely reason why many Illinois lawmakers are hanging on to their pension plans. Many have become career politicians earning full-time benefits – even though serving in the General Assembly was never meant to be a long-term career like teaching, law enforcement or firefighting.
According to GARS rules, retired lawmakers earn a pension equal to 85 percent of their final salary after just 20 years of service.
As a result, the average retired lawmaker receives $58,400 in annual pension benefits. And that annual pension grows every year – current retirees are also entitled to an annual, automatic and compounded 3 percent cost-of-living adjustment.
These overly generous benefits for part-time work put lawmakers’ financial interests in direct conflict with the need to reform GARS.
But by reforming their own retirement plan, lawmakers can demonstrate to their constituents – as well as to other government workers – that they are willing to lead by example.
State lawmakers should create a new defined-contribution plan for themselves that’s fair and ends their insolvent pension fund. Illinois’ existing self-managed plan for nearly 19,000 state-university employees participating in the State Universities Retirement System offers a great model for lawmakers.
Reforms to GARS could serve as the basis for the reform of Illinois’ other state and local retirement systems, finally bringing retirement security to government workers and tax relief to all Illinoisans.

Belleville gas station removes customer’s slip and fall suit
The owners of a Belleville gas station removed a woman’s slip and fall suit that alleges she slipped on ice while standing at the gas pump.
The defendants filed a notice of removal to the U.S. District Court for the Southern District of Illinois on Nov. 18 through attorney Beth Boggs of Boggs, Avellino, Lach & Boggs in St. Louis.
They argue that removal is proper based on diversity of citizenship and the amount in controversy.
Sharon and Jay Hoffman filed the lawsuit on Oct. 19 against Supervalue Holdings Inc. and Shop ‘N Save Warehouse Foods Inc.
According to the complaint, Sharon Hoffman slipped and fell on an unnatural accumulation of ice located below a permanent overhead canopy while she was a patron at the Shop ‘N Save Fuel Express in Belleville on Jan. 22, 2014.
The plaintiffs allege the defendants should have discovered or warned her of the problem.
They seek damages in excess of $75,000, plus court costs.
The plaintiffs are represented by Matthew Young of Kuehn, Beasley & Young in Belleville.
St. Clair County Circuit Court case number 15-L-597
Menards says carpenter altered materials that allegedly caused him to fall
Menard Inc. denies liability in a carpenter’s personal injury suit, arguing that the man failed to specifically identify the materials at issue and altered the materials that allegedly malfunctioned and caused him to fall.
Victor Betancourt, a local carpenter, filed his lawsuit on Oct. 26 against Michael Pedersen and Menard Inc.
According to the complaint, Betancourt alleges he fell from a structure built at Pedersen’s O’Fallon home with lumber purchased from Menards.
Betancourt alleges Pedersen failed to provide him with a safe working structure. He also alleges the materials sold by Menards were unsafe.
Pedersen answered the complaint on Dec. 2 through attorney Erin Phillips of Unsell Schattnik & Phillips in Wood River, denying the allegations against him.
Menards answered the complaint on Dec. 7 through attorney Byron Bowles Jr. of McAnany Van Cleave & Phillips in Kansas City. It also filed nine affirmative defenses against the plaintiff, arguing that Betancourt failed to state a claim for which relief can be granted.
Menards argues that the plaintiff failed to specifically identify the lumber, hardware or fastening tools allegedly at issue in the case.
The defendant also claims the products at issue were “substantially” altered or modified after leaving the control of Menards.
The plaintiff seeks damages in excess of $50,000, plus punitive damages and costs.
Circuit Judge Vincent Lopinot scheduled a status conference for Jan. 19 at 9 a.m.
Betancourt is represented in the case by Charles Scanlon of St. Louis.

The Madigan Mob rides again
What the mob wanted was a monopoly on liquor sales, and the best way to establish one was by criminalizing the enterprise, thereby removing all legal competition.
Likewise, there are dangers associated with gambling, legal and illegal, but banning it altogether is probably not the best solution, and the sincerity and disinterest of persons expressing opposition to wagering bears consideration.
After all, the mob – or a mob – might desire to have a monopoly on gaming, too, and be sophisticated enough to feign a concern for public safety to achieve it.
For instance, there might be good arguments for regulating or even banning fantasy sports contests with buy-ins and pay-outs, but we should know if those arguments are being advanced by rival gambling interests.
As it turns out, here in Illinois, most of the opposition to the services of DraftKings and FanDuel is coming from a single source: the single biggest gambling interest in our state.
Are they concerned about the safety of our citizens, or are they trying to protect their market, discourage competition, and maintain a monopoly?
What mob is this that controls most of the gambling in our state? It's the State.
That's right, the State of Illinois, purveyor of Powerball, Mega Millions, Lotto, Pick 3 and 4, Instant Games, etc. The State of Illinois, recipient of largesse from the Casino Queen in East St. Louis, Argosy's Alton Belle, and other casinos statewide.
Does this have a role in Attorney General Lisa Madigan's decision to declare daily fantasy sports illegal in our state?
Who knows? But it's something to consider.
Milk marketing dispute to be argued at Illinois Supreme Court on Jan. 14
A fraud suit that originated 10 years ago in Madison County will be argued at the Illinois Supreme Court on Jan. 14.
Prairie Farms Dairy (PFD) is appealing a Fourth District Appellate Court decision
involving a milk marketing agreement that went in favor of plaintiffs Michael and Denise Richter of Highland in June.
The Richters claim they were wrongfully terminated from an agricultural cooperative in October 2005 because they had temporarily ceased milk production. In their first suit filed in Madison County in 2006, the Richters alleged they had invested substantial capitol and labor and planned to resume production within a year, pursuant to the agreement, but that PFD terminated them anyway and returned just $15 to redeem their common stock.
The Richters seek a judgment of more than $200,000 and an order to purchase their common stock for its fair value, which they claim exceeds $50,000.
After litigating the case for six years, the Richters moved to dismiss without prejudice, which Madison County Circuit Judge Dave Hylla granted in September 2012. The case was refiled a year later with Prairie Farms board of directors and Edward Mullins added as defendants, however they were never served, according to the record. The new complaint contained four counts: shareholder remedies, misrepresentation, common-law fraud and breach of fiduciary duty.
After the new case was filed, Prairie Farms Dairy argued for transfer to Macoupin County, which Circuit Judge Andreas Matoesian granted in December 2013.
In June 2014, Macoupin County Judge Patrick J. Londrigan granted PFD's motion to dismiss the refiled action on grounds it was barred by the doctrine of res judicata - when a final judgment has been made in a case and it is no longer subject to appeal - and the statute of limitations.
The Richters then appealed to the Fourth District Appellate Court, which agreed with them and reversed and remanded for further proceedings.
Fourth District judges blamed Prairie Farms for failing to obtain final judgment.
“We note although nearly five years elapsed between the plaintiffs were given leave to file an amended complaint and their voluntary dismissal, defendant did not take any steps to put a definitive end to the case by filing a motion to dismiss the fraud counts with prejudice,” they wrote.
In November, the Illinois Association of Defense Counsel filed a brief in support of Prairie Farms Dairy, arguing that court orders dismissing civil actions should count as final judgments if plaintiffs ignore deadlines to amend.
“An order which grants a plaintiff leave to amend where the plaintiff chooses not to amend within the specified time is no different than an order which does not grant leave to amend,” attorney Ann Barron of Edwardsville wrote for the IDC.

Owner alleges construction companies damaged his property
BELLEVILLE – The owner of commercial real estate in Edgemont is suing four Illinois companies, alleging unauthorized use of a portion of his property.
Tyler Davis filed the suit Dec. 18 in St. Clair County Circuit Court against Ameren Illinois Company of Springfield, L. Keeley Construction Co. of Sauget, Upchurch Oil and Ready Mix Concrete of Belleville and J.F. Electric Inc. of Edwardsville.
The complaint states Davis' property, at 7610 State St., Edgemont, has been improved with an asphalt parking lot, concrete sidewalks and carports he had erected to rent to flea market vendors and has an easement is approximately 15 feet wide.
Beginning in 2015, the suit says, employees of the defendants began driving over and parking on his property without his permission. After he became aware of the situation, the plaintiff says he spoke with the employees, asking them to restrict their activities to the easement.
However, the suit says, the defendants' employees ignored Davis, and the asphalt, parking lots, sidewalks and parking blocks have been moved and damaged, landscaping has been damaged and the plaintiff has lost rental income from vendors he thought would use the property but could not because of the damage.
The plaintiff alleges he suffered emotional distress when an employee of Ameren displayed a handgun and became belligerent. Because the defendants' conduct was intentional, the suit alleges, the plaintiff seeks punitive damages.
Davis seeks at least $50,000 from each defendant and court costs. He is represented by attorney Matthew J. Marlen of Matthew J. Marlen PC of Belleville.

Plaintiffs don't get to change judges simply because they withdraw, refile suit, high court rules
The Illinois Supreme Court has shot down a plaintiff’s attempt to change judges after she dropped a lawsuit and then re-filed it, saying her attempt to “reset the clock” on the process was a loophole those who wrote the rules did not intend to be exploited.
State law allows each party to a lawsuit to request one substitution of judge without cause, as long as the motion is made before the judge has ruled on matters of substance in the case. The question before the Supreme Court was whether that remains true if the judge had ruled on matters of substance in an earlier version of the same case.
The question arose out of Case No. 13-L-41, a medical malpractice suit brought by Connie L. Bowman against doctor Michael D. Ottney.
Bowman, represented by John J. Hopkins of Alton, first filed the suit in Jefferson County in 2009, as Case No. 09-L-28, and the case was assigned to Circuit Judge David Overstreet.
Ottney was represented by attorneys with the firm of Heyl, Royster, Voelker & Allen - Brad A. Elward, Richard K. Hunsaker and Sara A. Ingram.
After several years of pretrial proceedings, during which Overstreet ruled on a number of matters, Hopkins dropped the case, according to court documents.
Suit against Ottney was re-filed again a few months later, citing the same allegations, but starting the case anew. It was again assigned to Overstreet, and Hopkins moved for a substitution of judge. Though the court denied the motion, it certified a question to the appellate court as to whether the trial court could deny a motion made under such circumstances.
The appellate court, with one dissenting vote, ruled that the court was correct in its decision; the Supreme Court, also with one dissenting vote, agreed.
The circuit court and appellate court rulings were based largely on the “test the waters” doctrine, which prohibits a party to a lawsuit from requesting a new judge if they have had an opportunity to form an opinion of the judge’s disposition in the case. The lone dissenting judge in the appellate decision said the “test the waters” doctrine has been discredited and rejected.
In their Dec. 17 decision, a majority of the state Supreme Court justices in a 6-1 decision declined to even take on the “test the waters” question, finding that it was moot because the doctrine has been applied in cases where no substantive rulings have been made, making them dissimilar to this case.
The majority opinion was authored by Justice Charles E. Freeman.
In his dissenting opinion, Justice Thomas Kilbride disagreed, calling the doctrine “a critical issue.” He quoted the appellate court opinion that the doctrine was rendered obsolete by the amendment granting parties the right to substitute a judge without cause.
“Although the same trial judge presided over both cases, the judge issued substantive rulings only in Case No. 09-L-28,” Kilbride wrote. “It is undisputed that the judge did not enter any substantive rulings in plaintiff’s refiled action.”
In the motion for substitution, Hopkins had argued that the language in the statute that refers to “in the case” clearly refers to only the current case; since the first lawsuit had been dropped, and the new suit was a new case with a new docket number, he claimed Overstreet’s decisions in the first suit had no bearing.
“Admittedly, refiled cases have been held to be new and separate actions for some purposes,” the majority wrote. “The narrow and literal interpretation of the phrase ‘in the case’ suggested by Bowman creates a loophole that allows the purpose of the statute to be defeated. We conclude that the legislature did not intend such a construction.”
If the plaintiff had wanted a new judge, the justices wrote, she could have moved for a substitution during the 2009 case; even after Overstreet had ruled on matters of substance, she could have sought a substitution for cause, though the burden would have been much higher.
In his dissenting opinion, Kilbride wrote that the court’s decision “effectively rewrites” the law “to create a new requirement for a motion seeking substitution of judge in Illinois.”
The case was remanded back to the lower court.
Worker alleges Baxmeyer Construction injured him at job site
BELLEVILLE – A Cahokia man is suing a construction company, alleging negligence for injuries he says he suffered when a piece of equipment hit him.
Curtis Barnett filed the suit Dec. 18 in St. Clair County Circuit Court against Baxmeyer Construction Inc. and Brian Embrich, alleging negligence.
According to the complaint, on April 18, Barnett was working for Kozeny-Wagner on a construction project, and while on the job at state Route 3 extension in East St. Louis, he was struck by a skidloader operated by Baxmeyer and its employee Brian Embrich. As a result, the suit says, Davis sustained severe injuries to his back, neck, legs, shoulders, hips and head.
The lawsuit states the plaintiff has had to pay large medical expenses, experienced disability, great physical pain and mental anguish, and hasn't been able to work, thereby losing wages.
Barnett seeks judgment against both defendants for four counts, and for at least $50,000, plus court costs and attorney fees. He is represented by attorneys Kenneth L. Halvachs and Ronald J. Abernathy Jr. of Halvachs & Abernathy LLC in Belleville.

Estate alleges intoxicated driver caused death, injuries in collision
BELLEVILLE – The estate of a deceased woman is suing a Maryville motorist and a bar, alleging injuries and a death caused by intoxication and by the establishment where the defendant drank.
Joshua Miller and Barry Monroe, co-special administrators of the estate of Samantha Miller, deceased, and Joshua Miller, as father and next friend of minors Jay Miller, Haily Miller and Brantly Miller, filed a lawsuit Dec. 11 in St. Clair County Circuit Court against Steven L. Willis of Maryville and The Hangar
According to the complaint, on Oct. 22, Samantha Miller had parked her motor vehicle on the shoulder of eastbound Interstate 55/70 near mile post 16, while, at the same time, Willis was driving a motor vehicle in the same direction along the same highway. The suit says he was negligent in that he drove faster than reasonable, failed to keep a proper lookout, failed to keep his vehicle on the roadway and drove while intoxicated, causing him to leave the roadway and strike Miller's vehicle, causing the death of Miller and injuries to the plaintiff minors.
The plaintiffs are also suing The Hangar, a bar at 6100 Archview Drive, Cahokia, alleging it gave Willis drinks and, as a result, he became intoxicated.
The plaintiffs seek at least $50,000 from each defendant, plus court costs and attorney fees. They are represented by attorney Jon E. Rosenstengel of Bonifield & Rosenstengel in Belleville.

Injured trucker blames Darby Trucking, driver for collision
BENTON – A Missouri trucker is suing a Mississippi trucking company and a driver, alleging negligence for injuries he says suffered as the result of a tractor-trailer accident in Cumberland County.
Jeffrey Kohlhauff of O'Fallon, Missouri, filed a lawsuit Dec. 22 in U.S. District Court for the Southern District of Illinois against Darby Trucking Company and Matthew Lee, both of Mississippi, alleging negligence.
According to the complaint, on Jan. 7, 2014, Kohlhauff was injured in a rear-end collision between his Peterbilt tractor trailer and an International Prostar tractor trailer owned by Darby Trucking Company and driven by Lee on Interstate Highway 57. The suit says Lee was driving at a high rate of speed and the impact of the collision and caused the plaintiff's vehicle to continue to the shoulder of the highway and come to a stop.
The suit states Lee was negligent in following too closely, failure to stop the vehicle, failure to sound the horn, and failure to slow down enough to avoid colliding with the plaintiff's tractor trailer among other charges.
As a result, the lawsuit says, the plaintiff was injured in his spine, neck and shoulders, causing him medical bills in the past and future, surgeries and medical treatment in the past and future, pain and suffering, emotional distress, lost wages and a loss of earning capacity.
Kohlhauff seeks more than $75,000, plus court costs from both defendants. He is represented by attorney J. Brad Wilmoth of Brown & Crouppen PC of St. Louis.

Couple blames companies for husband's asbestos exposure
BELLEVILLE – A Belleville couple is suing more than 20 companies, alleging negligence for the husband's exposure to asbestos fibers during his working life.
Jerry Hurst and Nancy Hurst filed a lawsuit Dec. 22 in St. Clair County Circuit Court against 3M Corporation, Union Carbide Corporation, Young Insulation Group of St. Louis and more than 20 other defendants. Also named is Metropolitan Life Insurance Company.
According to the complaint, from 1962 to 1999, Jerry Hurst worked as an auto mechanic and a pattern maker and both jobs put him in contact with asbestos fibers. He was exposed to and inhaled, ingested or absorbed large amounts of the fibers from the products he was working with and around, the suit says.
As a result of the years of exposure, the suit states, on Dec. 23, 2013, Hurst was diagnosed with asbestosis. He says he has spent large sums of money on medical care, has experienced physical pain and mental anguish and has been prevented from pursuing his normal course of employment, thereby losing large sums of money.
The lawsuit states Metropolitan Life Insurance Company and Pneumo Abex Corporation, as successor-in-interest to Abex Corporation, began in the 1920s to conduct research on asbestos-related health problems. They also actively suppressed publication of articles about asbestos in Asbestos Magazine, leading to fraudulent misrepresentation/concealment, the suit says.
Jerry Hurst seeks $50,000 from each of the defendants for economic damages. Nancy Hurst, alleging loss of consortium, also seeks $50,000 from each defendant. They are represented by attorneys Ronald J. Abernathy and Kenneth L. Halvachs of Halvachs & Abernathy LLC in Belleville.

Hey, millennials, take note
There appears to be two distinct thoughts from young voters.
1. I voted for Mr. Obama but the experiment failed. Millennials are worse off than before.
2. I voted for Mr. Obama but he failed to go far enough left.
Group Two is filled with dreamers who believe the real world will (with the right leader) be something it has never been before.
Group One is open to reality. Those young people are the voters who might be reachable next November.
The political message to the young must be about protecting what they and their family have now, plus a realistic message about how we move America toward an expanding Middle Class of the young and the not so young.
Just about everyone is tired of being sold a Bill of Goods by the Political Class. The new message MUST ring true by being specific enough that everyone understands the route to success. The leader's job is then to "head 'em up and move 'em out." Rebuilding America's economy will be easier once the vast majority understands what we are attempting to accomplish and how that will benefit them.
Failing that, it is my opinion, the young will follow an autocrat over a cliff. By that I mean, the Republic, as we have known it, will end.
