Patient sues Client First, alleging carelessness caused her injuries

A Belleville woman is suing a medical transportation company, alleging negligence caused her unnecessary injuries.

Roshanda Lee filed a lawsuit Sept. 23 in St. Clair County Circuit Court against Client First Medical Transportation Inc., alleging negligence for injuries she says she suffered while awaiting transport to a dialysis appointment.

According to the complaint, on April 1, while Lee was in the company's care she was left unattended near a transport van parked at her residence of 1040 Brookshire Court, Belleville. The suit says while Lee was left outside of the parked vehicle, her wheelchair rolled out onto the sidewalk, crashed and flipped over.

The lawsuit states the plaintiff suffered unnecessary injuries due to the lack of supervision and assistance.

Lee seeks judgment of more than $50,000. She is represented by attorneys Lanny Darr of the Darr Firm in Alton, and Alan Mandel and Michael Sudekum of Mandel & Mandel in St. Louis.

IOU balloon: State limits Lottery payouts to $600 or less

SPRINGFIELD — Illinois Lottery players who hit a winner worth more than $600 will have to settle for a promise.

As of Thursday, retailers will still pay out winners of $600 or less from their cash registers, but winners of bigger amounts will have to wait until the state has a budget.

Put simply, the Lottery’s check-writing account is exhausted, the state agency said.

“Once a budget is passed in Springfield, all outstanding claims will be paid,” the Illinois Lottery said in written statement.

This is the second such action by the state. In late August, the Lottery said it would limit payouts to $25,000.

That action sparked a lawsuit by some winners, including factory foreman Danny Chasteen of Oglesby, who’s waiting on a $250,000 payout.

“I heard about the $600 last night,” Chasteen said Thursday. “I think it’s just totally wrong. If you buy a Lottery ticket and you win, you should get paid."

If the state can’t pay out on its winning tickets, it should halt sales until it can pay winners, he said.

With 2015 revenues exhausted and no appropriations bill in place for the current fiscal year, the state’s comptroller doesn’t have the legal authority to pay winners, the Lottery says.

Illinois Lottery spokesman Steve Rossi said the payout restriction also applies to multi-state games played in Illinois, such as Mega Millions and Powerball, because the state that sells the winning tickets is responsible for making the payouts.

Elliot Frome, a Las Vegas-based gaming analyst and author, said Illinois will almost certainly see a reduction in ticket sales.

While a $25,000 limit probably hurt some games, a $600 limit will reach all the way down into the games that people play daily or several times per week, he said.

“Illinois is predictably going to lose some revenue during this period of time as a result,” he said.

“Lotteries are all about the money,” Frome said. “People are not going to play at the same rate for promise of payment as they are for money.”

Ben Friedrich, who was playing the Lottery in Aurora on Thursday, told Illinois News Network the $600 restriction struck him as unfair.

“If they’re still going to have the games and you’re still able to win the money, then you should be able to collect on the money,” he said.

Illinois is now in its fourth month of fiscal year 2016 without a budget as first-term Republican Gov. Bruce Rauner and legislative Democrats have been unable to reach an agreement.

Rauner says the Democrats have sent him a plan billions heavier in spending than revenue. While Rauner says he’s willing to discuss new revenue, he says he won’t sign off until he gets at least some of his agenda items, which he considers fundamental reforms.

Democrats complain Rauner and the GOP have been unwilling to work with them until the governor gets what he wants, and they don’t consider his agenda items directly related to the annual budget.

Rauner answers that his proposals are necessary to improve the state's economy and retain jobs and population.

Even without a master budget, the state is spending at clip said to be driving it toward a $5 billion shortfall by the end of the budget year.

Illinois woman sues O'Fallon car dealer, alleging deceptive practices

An Illinois woman is suing an O'Fallon car dealer, alleging it was involved in a pattern of deceptive and unfair misconduct concerning the repair of her car.

Dian Ducey filed a lawsuit Sept. 1 in St. Clair County Circuit Court against Meyers Bros. Auto Company, doing business as Meyer Honda in O'Fallon, alleging conversion and consumer fraud.

According to the complaint, Ducey purchased a new CRV Honda from the defendant in June 2007.  The suit states Meyer Honda began its misleading behavior in July 2011 when Ducey brought her vehicle to the dealership to fix a problem with the car's air conditioner. Over the next four years, the lawsuit states, the defendant misrepresented what repairs were necessary to correct the vehicle's erratic performing air conditioner, charged for the unnecessary repairs and said the repairs corrected the problem.

Moreover, the lawsuit says the defendant removed the clutch hub from the CRV without Ducey's permission in an attempt to hide that the clutch was detective and improperly installed.

Ducey seeks compensatory and exemplary damages, in addition to attorney fees, court costs, and other relief deemed appropriate by the court.  She is represented by attorney Pat Ducey of the Law Office of Pat Ducey in Troy.

Illinois Supreme Court changes the rules to meet the demands of technology and a brave new world.

CHICAGO - Rules are never set in stone and change with the times. This is the case today when the Illinois Supreme Court announced it is adapting several changes in the rules regarding technology and developments in global practices along with revising the Rules of Professional Conduct.

The rule changes, which will take effect Jan.1, 2016, came after the Court extensively reviewed proposals and held a public hearing on July 22 in Chicago.

Eventually the court, in its September term, approved amendments to the Illinois Rules of Professional Conduct and Supreme Court Rules 705 and 716.

These changes brings the Illinois Rules of Conduct “online” so to speak, making it more accommodating to the ever expanding usage of technology in today’s court.

"The amendments to the Rules reflect the Supreme Court’s strong interest in utilizing technology to make the judicial process more efficient and its recognition of the increasing use of technology in today’s legal practice," Chief Justice Rita B. Garman said. "These rule amendments also recognize how changes in legal practice have brought lawyers from other jurisdictions to Illinois to provide needed legal services as well as the Court's commitment to ensuring that lawyers who practice in Illinois meet the highest of professional and ethical standards."

The rules now allow for references to electronic forms of communication and information, such as emails and instant messages; acknowledge attorneys' need to stay current with technology changes; proclaim the explicit duty to safeguard confidential client information with regards to the electronic age; and detail duties dealing with Internet advertising and solicitation.

In addition to the changes which acknowledge the importance of technology, the Supreme Court approved changes to how prosecutors handle evidence which may exonerate a convicted defendant. Prosecutors now have an obligation to disclose any evidence that may cast reasonable doubt on a convicted defendant. If there is a reasonable likelihood that a convicted defendant did not commit the offense, prosecutors would have to disclose that evidence and then seek to remedy the conviction.

Another amendment to the Rules provides lawyers with guidance on how to counsel clients with respect to the conflict between federal law and the Illinois Compassionate Use of Medical Cannabis Pilot Program Act, which permits the cultivation, distribution, and use of marijuana for medical purposes.

In addition to the changes made to the Rules of Conduct, the Supreme Court also permitted changes to Rules 705 and 716. These amendments make it easier for attorneys authorized to practice in other jurisdictions to be admitted to the Illinois bar and to provide legal services as in-house counsel here. However, attorneys in other jurisdictions will still have to be fully qualified and be familiar with Illinois's ethics rules.

All the changes to the Illinois Rules of Conduct are a reflection of the changes made to the American Bar Association's Model Rules of Professional Conduct, upon which Illinois’ Rules are based. But they are changes to make the courts more efficient, address client concerns about technology, and meet the needs of an ever borderless world.

Madison County Dram Shop suit ends in defense verdict

A Madison County jury returned a verdict in favor of defendant Daddie-O’s Nite Out on Wednesday in a Dram Shop suit involving a bar brawl.

The two-day trial was held in Circuit Judge Dennis Ruth’s courtroom.

Plaintiff William D. Odom filed the seven-count lawsuit on May 5, 2014, against John P. Heitman, Daddie-O’s Nite Out Inc., Richard L. Campbell, individually and as liquor licensee, Brian Campbell, individually and as liquor licensee, and Richard L. Campbell Trust, as property owner.

Represented by Patrick G. King of the King Law Firm in Alton, Odom argues that the defendants sold alcohol to Heitman on May 12, 2013, causing him to become intoxicated. Odom claims he was on the Daddie-O’s pool team and was on the Wood River premises at the same time as Heitman.

While intoxicated, Odom claims Heitman began making sexual remarks and yelled obscenities, profanities and fighting words at the bartender and other patrons. As a result, the bartender allegedly demanded for Heitman to leave the establishment, but he refused.

Odom, along with other patrons, “assisted and attempted with the peaceful removal of John P. Heitman from the inside of Daddie-O’s at the direction and request of the bartender,” the suit states.

Odom claims Heitman responded by physically striking him, causing him to fall and land against a pool table and the floor.

As a result of the altercation, Odom claims he suffered severe and permanent injuries to his right shoulder.

Represented by Stephen J. Moore of Galloway, Johnson, Tompkins, Burr & Smith in St. Louis, Daddie-O’s and the Campbell defendants argue that the plaintiff provoked the alleged incident by becoming intoxicated and acting in a reckless, offensive and careless manner; provoking and willingly, purposefully and intentionally engaging in and allowing the alleged incident when it could have been avoided; actively provoked the conduct of Heitman through verbal threats; engaged in a personal dispute; and voluntarily, freely and willfully participated in the attempted removal of Heitman.

The defendants argue that Odom’s alleged injuries were the result of his own fault for failing to take care for his own safety and failing to act reasonably under the circumstances.

Motorist sues Lebanon driver for allegedly causing traffic accident

A Belleville woman is suing a Lebanon driver, alleging her negligence caused an accident that left the plaintiff severely injured.

Sharon L. Siewert filed a lawsuit on Sept. 21 in St. Clair County Circuit Court against Jessica D. Adams of Lebanon, alleging negligence.

According to the complaint, on Aug. 9, 2014, the vehicle driven by Jessica D. Adams rear-ended Siewert's vehicle on state Route 158 at East Highway 50 in O'Fallon, causing her bodily harm.

The suit says Adams was negligent by failing to keep a lookout on the roadways, speeding, failing to properly brake and reduce speed and failing to keep her vehicle under control.

The plaintiff alleges she incurred injuries to her neck, back and shoulder area, as well as aggravating pre-existing injuries.

Siewert seeks more than $50,000 as well as cost of suit. She is represented by attorney James R. Williams of Williams, Caponi, & Associates in Belleville.

Family of deceased land owner alleges fraudulent million-dollar real estate deal

The family of a deceased land owner is suing an individual, alleging a million dollar real estate deal is fraudulent.

Alfred E. Schilling, executor of the estate of Edwin J. Schilling, filed a lawsuit on Sept. 22 in St. Clair County Circuit Court against David Wiskamp over property valued at more than $1 million.

According to the complaint, Edwin Schilling was elderly and incapacitated from doing any business or entering into any contract when Wiskamp allegedly took advantage of his weakened mental state. The suit says the defendant fraudulently procured a deed that should be void.

The suit alleges Wiskamp negotiated a lease with the estate on the property and has failed to make required payments.

Alfred E. Schilling seeks more than $100,000 in damages, attorney fees, cost of suit, and any other other relief the court deems just, as well as a jury trial. He is represented by attorney Bryan D. Flynn of Flynn Guymon, & Garavalia in Belleville.

Rauner, L. Madigan lawyers duel in letters; At issue: Can Rauner file ‘friend of the court’ brief?

SPRINGFIELD — Top lawyers for Illinois’ Republican governor and Democratic attorney general are in a dustup over the governor’s office filing a “friend of the court” brief with the U.S. Supreme Court.

Attorney General Lisa Madigan’s solicitor general says Gov. Bruce Rauner’s staff lawyers stepped out of line when they filed an amicus curiae brief in a case now before the court, Friedrichs v. California Teachers Association.

Rauner’s lawyers say Madigan’s office is wrong on several fronts.

The Friedrichs case is of nationwide interest to unions and right-to-work advocates, among others.

Rebecca Friedrichs and nine other California teachers who are not union members object to paying what are known as “agency fees” or “fair-share” dues.

They argue that being forced to pay dues, even those said to be directed only toward bargaining and contract administration, is a violation of their First Amendment rights of free speech and free association.

The high court announced in June it would hear the case this term, which began earlier this month. A decision is not expected until summer 2016.

On Sept. 25, Illinois Solicitor General Carolyn Shapiro wrote to Scott Harris, clerk of the court, to inform him of an “unauthorized” filing of an amicus curiae or “friend of the court” brief on behalf of Rauner in support of Friedrichs’ position.

The governor’s attorneys, Jason Barclay and Dennis Murashko, lack the authority to file such a brief, Shapiro argued.

Those attorneys “have no authority to file or order the filing of any brief in this court on behalf of the governor, in his official capacity, because neither the governor nor his attorneys have the authority, as a matter of state law, to represent the state or its officials in any court or to determine the state’s litigation positions,” Shapiro wrote.

“The Illinois Constitution provides: ‘The attorney general shall be the legal officer of the state,’” Shapiro wrote.

She cited the Illinois Attorney General Act which states, among other things, the attorney general has the power to “appear for and represent the people of the state before the Supreme Court in all cases in which the state or the people of the state are interested.”

She said the Illinois Supreme Court has, for at least a century, delegated the state’s legal representation to the attorney general.

For example, she cited the case of Fergus v. Russel, in which the Illinois Supreme Court held the attorney general “is the sole official adviser of the executive officers … and it is his duty to conduct the law business of the state, both in and out of the courts.”

She also cited the case of Scachitti v. UBS Financial services, in which the court said, “the attorney general is the chief legal officer of the state and its only representative in the courts.”

Shapiro contends “Mr. Barclay and Mr. Murashko are well aware that they do not have authority to file or authorize the filing of court documents on behalf of of the governor in his official capacity absent appointment by the attorney general as special assistant attorneys general.”

Barclay and Murashko wrote their own Oct. 1 letter to the clerk of the court and argued the solicitor general is off the mark.

The governor’s lawyers say Illinois is not and never has been a party to the Friedrichs case and the governor’s office isn’t trying to change that, but only filing an amicus or “friend” brief — which they argue Rauner has every right to do.

And they say the governor clearly and within court rules filed only in his individual capacity and alongside several individual employees of the Kaneland, Illinois, Unified School District No. 302.

“The governor never represented that he filed the brief on behalf of the state of Illinois, the attorney general of Illinois, or any other elected official in Illinois,” the governor’s attorneys wrote.

Finally, they say the governor and attorney general have been at odds in both state and federal cases and remain so in a state case concerning a Rauner executive order addressing First Amendment issues similar, if not identical, to matters at issue in the Friedrichs case.

When the attorney general is in conflict with another state executive official, such as the governor, the courts have held “attorney general must yield to the other official’s choice of counsel,” Barclay and Murashko wrote, citing the case of Suburban Cook County Regional Office of Education v. Cook County Board.

The governor’s lawyers conclude the “attorney general is, of course, free to file her own amicus brief in support of respondents in Friedrichs. She may yet do so. She may do so on behalf of her own office or on behalf of the state. But the attorney general cannot infringe on the governor’s ability to speak to this court, especially when..the governor and the attorney general are adversaries in active litigation on the same issue in Illinois.”

To date, nothing has become of the disagreement.

Supreme Court spokeswoman Kathleen Arberg said the letters are part of the case file and docket notes distributed to the justices. Should the court have any response, it will be noted on the docket, she said in an email.

Neither Rauner’s nor Madigan’s press secretaries had any comment Friday.
