Former Roxana teacher alleges injuries from Shell Oil pollution

A former teacher is suing Shell Oil in Roxana over claims of pollution.

Gerald Maberry filed a lawsuit on Sept. 15 in the Madison County Circuit Court against Shell Oil Co.; Equilon Enterprises LLC, doing business as Shell Oil Products; Conoco Phillips Co.; WRB Partner LLC; Cenovus GPCO LLC; and BP Products North America Inc. for neglect and willful and wanton unlawful conduct.

According to the complaint, Maberry worked in Roxana as a teacher and claims that the defendants' refineries failed to contain certain harmful hydrocarbons, such as benzene, safely and properly. As a result, the pollutants allegedly dispersed onto the plaintiff's work site, causing him bodily harm.

The complaint also states that the defendants neglected proper safety procedures and was aware of such contaminations but failed to properly prevent harmful chemical leaks, resulting in pollution of the air and groundwater, which leaked onto Maberry's work site.

Maberry is suing for damages of more than $50,000 due to injuries sustained and for court costs. He is represented by attorney Ted N. Gianaris of the law office of Simmons Hanly Conroy in Alton.

Man sues Trouw Nutrition over sexual harassment claims

A man is suing his former employer over allegations of sexual harassment and wrongful termination.

Cedric Harmon filed a lawsuit on Sept. 14 in Madison County Circuit Court against Trouw Nutrition USA LLC, Jeff Hornberger and Luke Isringhuasen, citing a hostile work environment, sexual harassment and wrongful termination.

Harmon claims that during his employment for Trouw Nutrition, he was subjected to continual sexual harassment from Hornberger in the form of touching, inappropriate remarks and comments, and humiliation which resulted in a hostile environment. During this time, Harmon claims to have reported this misconduct to Isringhausen, the supervisor at the time. Harmon claims that Isringhausen and Trouw Nutrition failed to take the steps necessary to reprimand Hornberger and, as retailiation, terminated plaintiff’s employment with the company on or about July 14, 2014.

Harmon is requesting a trail by jury and is suing for more than $50,000 for damages, court costs, and other such relief the court deems just. He is represented by attorney Michael J. Brunton and Mary M. Stewart of Brunton Law Offices P.C. in Collinsville.

Former employee sues Steak N Shake over alleged racial discrimination

An African-American restaurant worker is suing Steak N Shake, claiming he was unfairly accused of stealing and was refused promotion because of his race.

Saxon Allen filed a lawsuit on Sept. 18 in the St. Clair County Circuit Court against Steak N Shake Operations Inc., claiming he was a victim of discrimination based on his race at his former place of work at the defendant's Regency Park location in O'Fallen.

According to the complaint, Allen worked for the defendant from March 19 to Dec. 18, 2013. Allen alleges he was falsely accused of stealing a cellphone from the location manager on Dec. 18, 2013. Allen also claims he and the other African-American males were made to submit to search of their persons and automobiles, but no female or white workers were forced to do so. Allen says he was fired and escorted off the property, the complaint states.

The complaint also states that he was repeatedly refused promotion possibilities from fountain worker to server within the restaurant due to his race.

Allen is seeking reinstatement of his job as well as promotion opportunities, back pay and other benefits. He also seeks damages of more than $50,000, as well as attorney fees less than $25,000.

Allen is represented by attorney John H. Leskera of Leskera Law Firm in Collinsville.

Belleville attorney sued for alleged legal malpractice

A St. Clair County man is suing his former lawyer, claiming he failed to properly represent him in a probate will case.

Charles Dean Pruitt filed the lawsuit on Sept. 21 in St. Clair County Circuit Court, claiming defendant Preston K. Johnson IV did not fully perform his duties as he was hired to do.

Pruitt claims he hired Johnson to represent him in the interest of an original will executed by Melba P. Pruitt on Feb 1, 2000. Pruitt claims Johnson did not perform his duties with his client in mind, and failed to provode the services in which he was requested.

Pruitt is suing Johnson for $250,000, a full refund of all payments made to Johnson, and for any further relief as the court deems fit. Pruitt is being represented by Christine Boardman of Millstadt.

St. Clair County residents claim plummeting property values forced them to forgo ownership of senior citizens home

Several St. Clair County residents are suing a bank and appraisal firm after property values allegedly plummeted, forcing them to take on new partners and forgo ownership.

Benjamin R. Brown, Roberta L. Brown, Billy Joe Foutch, Madonna Foutchm and Mascoutah Land Trust #5 together filed the lawsuit in St. Clair County Circuit Court on Sept. 11 against Kenworth C. Johnston, Kenworth Johnston Appraisals, and Commerce Bank, N.A.

The plaintiffs claim they took out a loan and purchased a mortgage on a piece of land intending to redevelop the property as a senior living community for people 55 years old and older. The group claims they were later told the property value had fallen below what was owed on the note.

They claim this forced them to take on new partners, who in turn paid the note in full, in exchange for a third share interest in their partnership. The plaintiffs claim they would never have each had less than a fifty percent share of the land per couple if not for the faulty conduct of the bank and appraisal firm, the suit states.

The plaintiffs seek an amount in excess of $50,000 from each defendant , plus costs, litigation expenses and attorney's fees. They are represented in this case by Eric M. Rhein of Belleville.

Bank sues boating company for $1.8 million in loan payments

A Marion bank is suing a boating company and its owners for allegedly failing to make payments on a loan deal.

Banterra Bank filed the lawsuit on Sept. 21st in Madison County Circuit Court against Nameoki Village Marine Incorporated, located at 4300 Nameoki Road, Granite City, Michael T. McCormick, and David P. McCormick.

According to the complaint, the plaintiff claims it entered into a series of loan transactions with the defendants, but they've allegedly failed to make payments. Banterra Bank alleges the company established several lines of credit as well as business loans to finance the company, upwards of $1.8 million.

Banterra Bank is asking for seizure and immediate possession of all new and used inventory, all records, all tax returns, and any other books of records, as well as prohibition from further sale of goods. Banterra is also asking for judgement against the defendants for the value of all missing and/or non-existent collateral, full recovery of all court costs, costs of repossession, moving and storage of collateral and records and attorney's fees.

Banterra Bank is represented in the case by James L. Van Winkle of Van Winkle & Van Winkle of McLeansboro.

Collinsville couple files medical malpractice suit over faulty hip surgery

A Colinsville couple is suing a local hospital and the company which supplied the equipment used in what they claim was a botched hip surgery.

Ronald and Stella Vivoid filed the lawsuit in Madison County Circuit Court on Sept. 18 against Hoemedica Osteonics Corp., d/b/a Strkyer Orthopedics, Stryker Corporation, Stryker Sales Corporation, Stryker Ireland Limited, and Southwestern Illinois Health Facilities after they claim a routine hip procedure went awry due to faulty products used.

The Vivoids claim that on Sept. 21, 2007, Ronald Vivoid had a total aphroplasty procedure due to degenerative arthritis of his left hip at Anderson Hospital. The couple claims that on March 20, 2008, Vivoid felt sudden and severe pain in the left hip. After being hospitalized, doctors found that he suffered erosion and corrosion of the metal used during the hip surgery as a result of metal-on-metal contact, the suit states.

The couple claims that because of the faulty manufacturing of the equipment used, Vivoid incurred more harm and bodily damage than was necessary. They also claim they incurred an influx of unnecessary hospital bills as well as loss of income due to hospitalization.

The couple is seeking an amount that exceeds $50,000 from each defendant, as well as costs of the suit. The Vivoids are being represented in the case by Michael P. Glisson of Williamson, Webster, Falb, & Glisson of Alton.

Simon Poll: Southern Illinoisans are ticked off; Eighty percent unhappy with direction of state, nation

SPRINGFIELD — Southern Illinois voters are far from pleased about the direction of the state and nation, according to a poll released Monday by the Paul Simon Public Policy Institute at Southern Illinois University Carbondale.

About 80 of respondents thought the nation (78.8 percent) and the state (79.8) are headed in the wrong direction.

However, about half (50.9 percent) think their city or area is headed in the right direction.

“These results probably reflect some of Illinois’ current conflicts. Most polls show that more
people feel their state is doing better than the nation. Not here,” said John Jackson, a visiting
professor at the institute.

Political leaders also got lukewarm reviews, according to the Simon Institute.

Slightly more than 37 percent (37.4) of respondents somewhat approved or strongly approved of Gov. Bruce Rauner’s performance, while 50.7 percent somewhat disapproved or strongly disapproved. Roughly 12 percent said they did not know.

“Though Democrats and Republicans are evenly distributed in our southern Illinois sample, this is still a conservative area, and one might have thought of it as fertile ground for Gov. Rauner,”
said Charlie Leonard, one of the Institute’s visiting professors supervising the poll.

For Rauner’s “approval ratings to be ‘upside down’ in southern Illinois this early in his administration may not bode well for the pro-business agenda he’s been trying to push,” Leonard said.

The Rauner administration had its own viewpoint.

“The status quo continues to hurt Illinois, and in the past decade of one-party rule the state has led to more than 300,000 manufacturing jobs lost and a $5 billion structural deficit, which is why the state needs the reforms outlined in the Turnaround Agenda,” Rauner spokeswoman Catherine Kelly said in an e-mail.

“The governor will judge his performance by his ability to reform state government to grow the economy and create jobs while helping the most vulnerable,” she said.

The Simon Institute said U.S. Sen. Mark Kirk’s job-approval rating was 30.4 percent, with 22.9 percent disapproving.

Nearly half of the respondents (46.6 percent) said they didn’t know how they feel about Kirk, a native of Champaign who now lives in Highland Park.

U.S. Sen. Dick Durbin, a Democrat from Springfield, scored approval ratings that exceeded his disapprovals, but not by much.

Half of the respondents (50.6 percent) approved of Durbin’s performance and a third (33.5 percent) disapproved. Sixteen percent said they did not know.

“Voters here have been in a bad mood and they continue to be,” said David Yepsen, director of Simon Institute.

“The only surprise is how many people don’t have an opinion about Sen. Kirk. For a
statewide Republican incumbent to have such ambivalent ratings down here isn’t a good sign for him as he heads into a tough re-election campaign,” Yepsen said.

Kirk “needs to be running well in this area to offset Democratic strengths elsewhere in the state,” Yepsen said.

The Kirk campaign says the senator is doing fine in Southern Illinois.

"Southern Illinois voters clearly approve of Senator Kirk's efforts to create and retain jobs in Illinois as well as his fight to lower taxes and reduce spending," said Kirk spokesman Kevin Artl.

The Simon Institute’s Southern Illinois Poll interviewed 401 registered voters across the 18
southernmost counties in Illinois.

The poll has a margin of error of plus or minus 4.9 percentage points at the 95 percent confidence level. This means that if we were to conduct the survey 100 times, in 95 of those instances the results would vary by no more than plus or minus 4.9 percentage points from the results obtained.

Live telephone interviews were conducted by Customer Research International of San Marcos,

Texas. No auto-dial or “robo-polling” polling was included. The survey was paid for
with non-tax dollars from the Institute’s endowment fund.

Couple sues insurance agency for failure to provide full coverage after fire

A Mascoutah couple is suing their insurance agency, claiming the company failed to honor their coverage after a fire.

Joseph and Lisa Fournie filed a lawsuit in St. Clair County Circuit Court on Sept, 10, claiming J.C. Reinneck Insurance Agency Inc., John C. Reinneck and Country Mutual Insurance Company are all at fault after allegedly failing to honor fire insurance coverage.

The Fournies claim they were denied partial coverage after a fire ripped through their property located at 10735 Fournie Lane in June 2015. The couple claims that prior to the fire, they were assured they were fully covered if such an event occurred. Upon filing their claim, the couple alleges they were told only a portion of their personal property would be covered. The Fournies claim the Insurance agents and companies are at fault for failing to fully cover their personal property, the suit states.

The Fournies are seeking $15,000 from each defendant exclusive of interest or cost. They are represented in this case by B. Jay Dolwing of Sterling and Dowling, P.C., in Fairview Heights.

St. Clair County teacher sues school board over pay dispute

A former St. Clair County school teacher is suing the school board claiming they failed to pay him his proper salary for the last 20 years.


Frederick William Hoaf filed a lawsuit on Sept. 9 in St. Clair County Circuit Court, claiming the Board of Education of Belleville Township High School District 201 failed to pay him appropriately for his masters degree.

Hoaf alleges that from 1995 to 2015 he was certified with a masters degree in higher education and should have been compensated as so. Instead, he claims he was paid as a teacher holding a bachelors degree. 

 
Hoaf is suing the Board of Education for $50,000 plus coast of the suit. Hoaf is being represented in this case by William L. Wimmer of Belleville.

Staunton man files million dollar lawsuit against his former employer over work-related injury

A Staunton man is suing his former employer for a work related injury he claims was exacerbated by their negligence.

William A. Billings filed suit on Sept. 25 in Madison County Circuit Court claiming Triton Risk Management and Barbara Hill displayed a willful disregard for injuries incurred at his place of work and deprived him of proper medical care.

According to the complaint, Billings claims he was injured while on the job and was poorly treated by medical professionals assigned to him by his place of work. Billings alleges this negligence aggrieved his injuries, further forcing him to incur more physical damage, which he claims negatively affected business and personal life.

Billings is seeking economic damages in the total of $611,440 for lost wages, lost business opportunities, sale of business equipment and personal property and debt incurred. Billings also seeks $550,000 in non-economic damages for pain and suffering including but not limited to mental and physical anguish, depression, and mental and physical pain.

Billings is representing himself in this case.

NAPA Auto Parts seeks to transfer trip and fall case to Randolph County

A NAPA Auto Parts store filed a motion to transfer a customer’s lawsuit alleging he tripped over a concrete impediment in the parking lot of the Sparta store.

Douglas K. Rushing and Patricia Rushing filed their July 31 lawsuit against Sparta Equipment Sales & Service Inc., which operates NAPA Auto Parts, in the St. Clair County Circuit Court.

The defendant filed a motion to transfer venue to Randolph County, arguing that the alleged incident occurred at the NAPA Auto Parts Store located in Randolph County, which also happens to be the location of the defendant’s registered office.

Further, Sparta Equipment Sales & Service claims it does not do any business in St. Clair County.

According to the complaint, Douglas Rushing claims he was injured on Aug. 2, 2013, after tripping over a concrete impediment in the parking lot. As a result, he claims he injured his right shoulder, both wrists and his left knee and developed rhabdomyolysis.

The plaintiffs accuse the defendant of negligence for failing to paint the impediment to warn customers of its existence.

Sparta Equipment Sales & Service answered the complaint on Sept. 15 through attorney Michael S. Hamlin of Pitzer Snodgrass in St. Louis.

The defendant asserted three affirmative defenses against the plaintiff, arguing that the Rushings failed to state a claim upon which relief may be granted and denying that the defendant was at fault for any alleged damages.

Sparta Equipment Sales & Service argues that Douglas Rushing failed to exercise due care for his own safety, failed to keep a careful lookout and failed to observe an open and obvious condition.

The Rushings seek damages of more than $50,000, plus costs of the suit.

St. Clair County Circuit Judge Vincent Lopinot scheduled a status conference for Oct. 19 at 9 a.m.

The plaintiffs are represented by Michael L. McGlynn of McGlynn & McGlynn in Belleville.

Progressive removes class action alleging it wouldn’t honor insurance coverage to federal court

Progressive Direct Insurance removed a class action to federal court that alleges the automobile insurance company sold insurance that it would not pay claims on.

The defendant filed a notice of removal to the U.S. District Court for the Southern District of Illinois on Sept. 28 through attorneys Emily Kiser of Lathrop & Gage in Clayton, Mo., and Brian Fries and Mara Cohara of Kansas City.

The defendant argues that removal is proper based on the Class Action Fairness Act, which extends federal jurisdiction over class actions.

According to the notice of removal, the proposed class consists of more than 100 members, diversity of citizenship exists and the amount in controversy exceeds $5 million, making removal appropriate.

Suzanne and Michael Hallihan filed the lawsuit on July 30 against Progressive Direct Insurance Co. of Ohio.

They claim the company sold policies to customers for minimum underinsured motorist coverage that is “illusory,” is rendered void by the language of the policy and had no intention of using as a basis for paying a claim.

The plaintiffs accuse the defendant of violating the Illinois Consumer Fraud and Deceptive Business Practices Act, fraudulent misrepresentation or omission and unjust enrichment.

Suzanne Hallihan alleges she submitted a claim on July 25, 2014, in relation to a loss on Nov. 14, 2011. While the minimum payout at the time of the accident in 2011 was $20,000 per person, the suit states that Progressive denied the claim on July 29, 2014, arguing that the bodily injury coverage exceeded the underinsured motorist coverage and that the vehicle did not meet the definition of an underinsured motor vehicle.

The plaintiffs seek statutory and common-law damages, punitive damages, attorneys’ fees and court costs. They also seek an order prohibiting the defendant from offering the coverage in its current form.
