Man alleges Arvinmeritor Inc., others' negligence caused asbestos-related cancer

BELLEVILLE – A laborer alleges exposure to asbestos during his career caused him to develop lung cancer.

Charles Ray Linders filed a complaint on Aug. 16 in the St. Clair County Circuit Court against Arvinmeritor Inc., A.W. Chesterton Co., Borg-Warner Corp., et al. alleging negligence.

According to the complaint, the plaintiff alleges that between 1972 and 1993, during the course of his employment and military service, during non-occupational work projects and/or in other ways, he was exposed to and inhaled asbestos fibers emanating from certain products that were manufactured, sold, distributed or installed by the defendants. The suit states that the plaintiff first became aware that he had developed lung cancer on Dec. 22, 2015. 

The plaintiff holds the defendants responsible because the defendants allegedly included asbestos fibers in their products when adequate substitutes were readily available and failed to provide adequate warnings and instructions on how to safely work with asbestos-containing products.

The plaintiff requests a trial by jury and seeks to award compensatory damages of more than $50,000,costs incurred prosecuting this matter, and to grant such other and further relief as the court deems appropriate. Woman alleges injuries from slip, fall at Granite City Taco Bell

EDWARDSVILLE – A patron at the Taco Bell in Granite City alleges she was injured when she slipped and fell on a wet floor.

Bonnie S. Peters filed a complaint on Aug. 21 in the Madison County Circuit Court against Bell Missouri LLC, doing business as Taco Bell Restaurant No. 029634, and manager Kaleigh Wright, alleging negligence.

According to the complaint, the plaintiff alleges that on July 27, she entered the Granite City Taco Bell restaurant when she allegedly slipped and fell on a wet and slippery floor. 

As a result, she claims she sustained injuries to her legs, knee, feet, elbows, back and shoulders. 

The plaintiff alleges the defendants failed to follow their own rules of sweeping and cleaning the floors and failed to warn the public of the condition of the floor.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount of more than $50,000 plus costs of court.

Motorist sues over Wood River collision

EDWARDSVILLE – A driver and owner of a vehicle are seeking damages after another motorist allegedly failed to yield the right-of-way and caused a collision in Wood River.

Lorene Y. Womack and Tony McCoy filed a complaint on Aug. 22 in the Madison County Circuit Court against James Howard, alleging negligence.

According to the complaint, on Dec. 31, 2015, Womack was operating a motor vehicle owned by McCoy at the intersection of South Sixth Street and East Madison Avenue when the defendant caused his vehicle to collide with Womack. 

The suit states Womack sustained injuries to her neck and right ankle. 

The plaintiffs allege Howard failed to keep careful lookout, failed to reduce speed and failed to yield right of way.

The plaintiffs seek judgment against defendant in excess of the minimum jurisdictional limits of the court plus costs of this action.

Tenants of Alton property file suit against landlords after fall, eviction

EDWARDSVILLE – The tenants of an Alton property allege they were wrongfully evicted after filing a complaint about the property's conditions.

Sheila Shrum-Norman and Terry L. Norman filed a complaint on Aug. 22 in the Madison County Circuit Court against Terry D. Dixon and Dreanna Dixon alleging negligence and other counts.

According to the complaint, the plaintiffs were renting an Alton property from the defendants. Shrum-Norman alleges that on March 23, 2016, she slipped and fell on the stairwell area at the property and sustained severe and permanent injuries to her right arm, neck, back, ribs and skull. The plaintiffs allege that they were evicted in retaliation for complaining to the city inspector's office about the conditions of the property and the defendants refused the plaintiffs' request to refund their security deposit.

The plaintiffs holds Terry D. Dixon and Dreanna Dixon responsible because the defendants allegedly failed to have the rental property inspected by a licensed city inspector and failed to warn plaintiffs of the existence of a dangerous condition.

The plaintiffs seek damages of more than $50,000, plus costs of this action. They are represented by Brian M. Wendler and Angie M. Zinzilieta of Wendler Law PC in Edwardsville.

EDWARDSVILLE – A Granite City man alleges he was injured in a collision in the city caused by a distracted driver.

Richard Holman filed a complaint on Aug. 17 in the Madison County Circuit Court against Betsy A. Maynard alleging negligence.

According to the complaint, the plaintiff alleges that on March 30, 2016, he sustained external and internal injuries when the vehicle he was driving was struck from behind by defendant's vehicle. 

The plaintiff holds Maynard responsible because the defendant allegedly failed to maintain a careful lookout and failed to reduce speed or stop to avoid collision.

The plaintiff requests a trial by jury and seeks damages of more than $50,000, costs of suit and any other relief that the court deems appropriate. He is represented by Gregory M. Tobin of Pratt & Tobin PC in East Alton.

BELLEVILLE – A daughter alleges her late mother's exposure to asbestos during her employment contributed to her death.

Kathryn Forisso, individually and as special administrator of the estate of Barbara Forisso, deceased filed a complaint on Aug. 10 in the St. Clair County Circuit Court against A.W. Chesterton Inc., Alcatel-Lucent USA Inc., AT&T Corp., et al. alleging negligence.

According to the complaint, the plaintiff alleges that in the course of Barbara Forisso's employment from 1951 to 2003, she was exposed to and inhaled asbestos fibers emanating from certain products manufactured, sold, distributed and/or installed by defendants. The suit states the plaintiff's decedent first became aware that she had developed lung cancer in Feb. 22, and passed away in March 28. 

The plaintiff holds A.W. Chesterton Inc., Alcatel-Lucent USA Inc., AT&T Corp. and others responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks economic, punitive and exemplary damages of more than $50,000. She is represented by Randy L. Gori and Barry Julian of Gori, Julian & Associates PC in Edwardsville.

BELLEVILLE – A widow alleges her late husband's death was caused by lung cancer related to asbestos exposure.

Penelope Bidwell, individually and as special representative of the estate of Robert Bidwell Jr., filed a complaint on Aug. 10 in the St. Clair County Circuit Court against Borg-Warner Morse Tec LLC, The Budd Co., Cardinal Industrial Insulation Co. Inc., et al. alleging negligence.

According to the complaint, the plaintiff alleges that at various times during Robert Bidwell Jr.'s employment from 1969 to 2005, he was exposed to and inhaled asbestos fibers emanating from certain products manufactured, sold, distributed and/or installed by defendants. The suit states he first became aware that he had developed lung cancer on Jan. 4, and died in May 10. 

The plaintiff holds Borg-Warner Morse Tec LLC, The Budd Co., Cardinal Industrial Insulation Co. Inc., et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

BELLEVILLE – A New Baden resident claims that he was injured when a Shiloh man failed to stop and collided with his vehicle in Summerfield.

Christopher A. Wininger filed a complaint on Aug. 10 in the St. Clair County Circuit Court against Robert Maguire alleging negligence.

According to the complaint, the plaintiff alleges that on April 14, 2016, he was severely and permanently injured on Summerfield Road when his motor vehicle over turned after it was struck by defendant's motor vehicle. He alleges he sustained injuries to his neck, shoulder, right foot, left wrist and other parts of his body. 

The plaintiff holds Maguire responsible because the defendant allegedly failed to yield the right of way and failed to obey a stop sign.

BELLEVILLE – A New Baden resident claims he was injured when a Shiloh man failed to stop and collided with his vehicle, causing him to overturn.

Christopher A. Wininger filed a complaint on Aug. 10 in the St. Clair County Circuit Court against Robert Maguire, alleging negligence.

According to the complaint, the plaintiff alleges that on April 14, 2016, his vehicle was struck by Maguire's vehicle, causing him to overturn. 

As a result, Wininger claims he sustained severe and permanent injuries to his neck, shoulder, right foot, left wrist and other parts of his body. 

The plaintiff alleges Maguire failed to yield the right of way and failed to obey a stop sign.

Motorist sues over Granite City rear-end collision

EDWARDSVILLE – A motorist alleges he was injured in a rear-end collision in Granite City last year. 

Richard Holman filed a complaint on Aug. 17 in the Madison County Circuit Court against Betsy A. Maynard, alleging negligence.

According to the complaint, the plaintiff alleges that on March 30, 2016, he was rear-ended by the defendant's vehicle. 

As a result, he claims he sustained internal and external injuries. 

Holman alleges Maynard failed to maintain a careful lookout and failed to reduce speed or stop to avoid collision.

The plaintiff requests a trial by jury and seeks damages of more than $50,000, costs of suit and any other relief that the court deems appropriate. 

He is represented by Gregory M. Tobin of Pratt & Tobin PC in East Alton.

McCarter: Rauner is 'the best Republican Democrats have ever had'

Calling Gov. Bruce Rauner "the best Republican Democrats have ever had," fellow GOPer State Sen. Kyle McCarter believes the sanctuary state bill signed into law yesterday will negatively effect the governor's re-election hopes.

"This is not just bad policy," McCarter said of Rauner's adoption of the Trust Act. "It's bad politics."

The "sanctuary state" measure in Senate Bill 31 limits the role local and state police can have in enforcing federal immigration laws.

While Rauner touts the Act as one that will improve "connectivity between immigrants and law enforcement, making Illinois safer for all residents," critics like McCarter say it shows the governor "is not committed to protecting the citizens of Illinois but criminal Illegals."

Leading up to Rauner's action yesterday, McCarter addressed criticism he faced for not backing his fellow Republican. McCarter said that party loyalty can only go so far.

"You can't overlook what's right and wrong, and you can't defend what's wrong as though it's right just because your party leader says this is the way it is," McCarter said in a Facebook post. "We all need to be held accountable."

In a radio interview with radio hosts Dan Proft and Amy Jacobson at AM 560 in Chicago on Tuesday morning, McCarter said he was concerned about "my party" and its brand being tainted, or at least "confused."

He said that within the congressional district he is considering taking a run at - the 15th Congressional District currently represented by Republican John Shimkus - a majority in the 33 counties of the southern Illinois district voted for President Trump.

"His immigration policy was one of the reasons they voted for him," McCarter said. "I think this is going to negatively effect Rauner's election."

When asked whether Rauner might face a primary challenge, McCarter said he wasn't sure it was a practical idea as any rival would run against "a very wealthy man."

But he also said that primaries are good because they make candidates better, forcing them to focus on what they stand for.

In a final segment of the radio program, Proft turned to an article in a news outlet Proft established - Prairie State Wire - that examines state contracts totaling $16.88 billion amassed for clients of Nancy Kimme, a Republican, whom he described as a "longtime inside player."

Kimme had served as chief of staff to the late Judy Baar Topinka, who passed away shortly after being elected state comptroller in 2014. After Topinka's passing, Kimme turned to lobbying, and according to Proft, had worked out of the governor's office under the "previous regime" before a staff shakeup in July.

Proft asked McCarter about Rauner's promise to "shake up" Springfield and turn around Illinois, as in his version of "draining the swamp."

"Unfortunately, Republicans in Illinois dwell in the swamp as well," McCarter said. "It's not just a home for Democrats. Cultures of corruption don't change overnight, no culture does...typically what happens when it does change, you have spectacular principled leaders and it's those leaders that stand strong and can really move culture in the right direction."

McCarter said he "knew the reality" of how things work in Spingfield when he had asked a state agency director about employment for someone he knew.

"I had asked a director one time in this administration if there was a place to provide a job to a man who was unjustly treated by the previous administration, and one of best workers we had in the state," McCarter said. "And he told me he couldn't do anything about that, but he told me that I should go to the firm of Nancy Kimme...I thought that was just a little odd."

Proft said, "The agency director couldn't do anything but the shadow government could, if you wanted to enlist them at a price."

"Exactly," McCarter said. "That is disappointing and shows you the depth of this culture of corruption."

Tenants of Alton property sue landlords after fall, eviction

EDWARDSVILLE – The tenants of an Alton property allege they were wrongfully evicted after filing a complaint about the property's conditions.

Sheila Shrum-Norman and Terry L. Norman filed a complaint on Aug. 22 in the Madison County Circuit Court against Terry D. Dixon and Dreanna Dixon, alleging negligence.

According to the complaint, the plaintiffs claim they were renting an Alton property from the defendants. Shrum-Norman alleges that on March 23, 2016, she slipped and fell in the stairwell area at the property and sustained severe and permanent injuries to her right arm, neck, back, ribs and skull. 

The plaintiffs allege that they were evicted in retaliation for complaining to the city inspector's office about the conditions of the property. They also claim the defendants refused their request for a refund of their security deposit.

The plaintiffs allege the defendants failed to have the rental property inspected by a licensed city inspector and failed to warn plaintiffs of the existence of a dangerous condition.

The plaintiffs seek damages of more than $50,000, plus costs of this action.

Seventh Circuit upholds $60K Rosewood fine finding it failed to investigate kiss

CHICAGO – Rosewood Care Center of Swansea must pay a $60,500 penalty for abuse including failure to separate employees too angry at each other to help a helpless person, Seventh Circuit appellate judges ruled on Aug. 22. 

They denied Rosewood’s petition to review an order of the U.S. Department of Health and Human Services, imposing a daily penalty of $6,050 for 10 days. 

The federal agency found Rosewood failed to protect a resident from abuse, failed to report or thoroughly investigate allegations, and failed to follow policies. 

An investigation was sparked on May 8, 2014, when the wife of a resident told the Illinois Public Health Department that a staff person kissed her husband. 

The Seventh Circuit opinion identified the husband as R6, the wife as Z4. 

The wife told the department that Rosewood covered up the harassment. 

As compliance regulator for Medicare and Medicaid, the state agency sent surveyors Christiane VonRonnakirk and Teresha Viverette to Rosewood. 

The husband told them a staff person kissed him on both cheeks. 

He told them that she said, “I really, really love you.” He said it shocked him and made him very uncomfortable. 

His wife said she reported it to administrator Ken Kabureck, who later told her he didn’t know who did it and wouldn’t investigate it. 

VonRonnakirk and Viverette questioned Kabureck, who said the wife was upset. 

He told them the wife said it happened in physical therapy, so he asked physical therapy staff about it, and staff didn’t know anything. 

He said he didn’t talk to the husband because he believed the husband made it up. 

On May 12, 2014, with the survey in progress, nursing assistant Tara Schlesinger lost her temper in a shower with a resident 92 years old. 

The opinion didn’t identify the resident, who suffered from end stage dementia and needed two assistants for a shower. 

According to the other assistant, Emily Schmidtling, Schlesinger cursed the resident and told him to sit down several times. 

Schmidtling said Schlesinger asked, “Why do I always get your shower?” 

They finished his shower and put him to bed, where his bowels moved. 

Schlesinger shoved him so hard in turning him over that she had to grab him back, according to Schmidtling. 

Schmidtling walked to the licensed practical nurse on duty, Jennifer Schmidtling. 

The Seventh Circuit opinion didn’t indicate any relation. 

Nurse Schmidtling didn’t respond, and assistant Schmidtling returned to work. 

Nurse Schmidtling would later say she didn’t see any merit in the report. 

She said the two assistants had been “snipping and sniping” behind each other’s backs for the better part of three weeks. 

She said each complained about the other not helping the resident. 

Nurse Schmidtling didn’t report the allegation or relieve Schlesinger. 

Assistant Schmidtling then reported Schlesinger’s conduct to registered nurse Jennifer Haukap, who reported it to Kabureck. 

Rosewood would later fire Schlesinger. 

The kissing complaint returned to the foreground on May 14, 2014, when Kabureck reported it to the state health department. 

He submitted statements of staff members who hadn’t seen any kissing. 

As it turned out, the husband told the truth. 

On May 24, 2014, Kabureck informed the department that a registered nurse kissed the husband while he walked with a walker and a therapist. 

Kabureck reported that at the request of a therapist, the nurse had encouraged the husband to leave his bed for therapy. 

Her log dated the interaction on April 28, 2014. 

She said that about a week later, she saw him with a walker and a therapist. 

She said she kissed him on the forehead and told him he was doing great. 

She said he smiled but said nothing. 

She said he wasn’t upset. 

The Seventh Circuit opinion didn’t identify the registered nurse. 

On May 28, 2014, the department recommended to Medicare and Medicaid Services a finding that Rosewood placed residents in immediate jeopardy of abuse. 

Such a finding raised the possible daily penalty from a normal range between $50 and $3,000 to a range between $3,050 and $10,000. 

The department specifically held that Rosewood failed to protect the 92 year old. 

The department generally held that Rosewood failed to investigate allegations thoroughly and failed to follow its abuse prevention policy. 

The department set the daily penalty at $6,050, for 10 days. 

Medicare and Medicaid Services adopted the recommendation. 

Rosewood appealed to an administrative law judge, who upheld the penalty. 

The law judge wrote that the 92 year old was “caught in the direct line of fire” between the assistants. 

The law judge found Rosewood’s investigation of the kiss “palpably incomplete,” because no one took a statement from husband or wife. 

Rosewood lost an appeal before a board in the U.S. Department of Health and Human Services, and lost again at the Seventh Circuit. 

Justice Kenneth Ripple wrote that nurse Schmidtling’s failure to take Schlesinger off duty pending an investigation put the 92 year old at risk of additional harm. 

“The fact that two certified nursing assistants would not assist each other in rendering his care clearly placed him in jeopardy of continued abuse,” Ripple wrote. 

He wrote that evidence about the kiss was equivocal. 

“That, however, was not known to Rosewood at the time that R6 and his wife complained,” he wrote. 

“The regulations did not permit Rosewood to assume that the version offered by its own employees was the end of the matter.” 

Justices Richard Posner and Diane Sykes concurred. 

Mark Brooker, regional counsel of the U.S. Department of Health and Human Services in Chicago, represented the department.

Passenger seeks more than $50,000 after Frank Scott Parkway collision

BELLEVILLE – A passenger in a vehicle involved in a collision in Stookey Township alleges she was injured and is seeking damages.

Emily Paul filed a complaint on Aug. 16 in the St. Clair County Circuit Court against Deena Scott alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 19, 2015, she was passenger in a motor vehicle stopped at a red signal on southbound Frank Scott Parkway at its intersection with Belleville Crossings when defendant Scott's vehicle stuck the vehicle. 

The plaintiff holds Scott responsible because the defendant allegedly drove the motor vehicle at a speed that was greater than reasonable and proper with regard to the traffic conditions, failed to keep adequate lookout and failed to stop or yield the right of way in compliance with the traffic signal erected at the intersection.

Former prosecutor pursuing age discrimination suit, confesses to mishandling tickets for friend

EAST ST. LOUIS – Former Madison County prosecutor Julia Matoesian, wife of Circuit Judge Andy Matoesian, rigged tickets for clients of their friend, Alton attorney Steve Selby, according to a confession she submitted in U.S. district court on Aug. 26. 

Her statement apparently ends an age discrimination suit she filed against State’s Attorney Tom Gibbons and the county in 2015. 

Alton lawyer Lee Barron submitted the statement in response to a summary judgment motion that Gibbons and the county filed in June. 

In the statement, Barron wrote that Matoesian was 75 when defendants terminated her. 

He wrote that they replaced her with a substantially younger employee, and that they first informed her husband. 

He wrote that these facts and other matters gave her a good faith basis to believe age was a factor in her termination. 

He wrote that given a Supreme Court standard as the Seventh Circuit applies it, “plaintiff confesses the defendants’ motion for summary judgment.” 

In that motion, county counsel Narcisa Symank wrote that an anonymous tip led Gibbons to review cases of driving under the influence. 

She wrote that Gibbons came to believe Matoesian grossly mishandled cases. 

Symank provided details in a separate statement of uncontroverted material facts. 

In 2010, Symank wrote that Matoesian was assigned to the case of a repeat offender who drove his vehicle through a bar with patrons inside. 

“Despite the egregious circumstances and substantial evidence supporting suspension of the defendant’s driver’s license, plaintiff rescinded the statutory summary suspension of the individual’s driver’s license without justifiable cause,” she wrote. 

Symank wrote that state’s attorney William Mudge, now circuit judge, instructed Matoesian never to rescind another suspension without a supervisor’s approval. 

She wrote that Gibbons served a portion of Mudge’s term and was elected in 2012. 

In November 2012, she wrote that an assistant state’s attorney received an anonymous note expressing concern about disposition of 11 cases. 

She wrote that Gibbons and Katie Wycoff, chief of the misdemeanor and traffic division, reviewed the cases. 

In seven cases, Matoesian rescinded suspensions, she wrote. In five of those seven, Selby was defense attorney. 

“Mr. Selby is a close personal friend of plaintiff and her husband, the Honorable Andreas Matoesian, who serves as a circuit judge in the Madison County circuit court,” Symank wrote. 

Symank wrote that Gibbons realized she rescinded suspensions improperly. 

She wrote that he decided not to reappoint Matoesian for a swearing in ceremony on Dec. 3, 2012. 

She wrote that Gibbons tried to meet her on Nov. 30, but couldn’t locate her. 

“That same day, Mr. Gibbons was visiting with the Honorable Andreas Matoesian, as happened often, on at least a weekly basis,” she wrote. 

“Mr. Gibbons had, for over a decade, considered Judge Matoesian a close personal friend and mentor.” 

She wrote that the judge said, “I’m assuming Julie is safe.” 

“In response, Mr. Gibbons, caught off guard and unsure of what to say, said, ‘That is something we are going to have to talk about,’” she wrote. 

“In response, Judge Matoesian became extremely angry and told Mr. Gibbons to get out of his office. 

“The personal friendship of Judge Matoesian and Mr. Gibbons ended that day.” 

Symank wrote that on Dec. 3, 2012, Gibbons met Julia Matoesian and told her he had grave concern about her exercise of sound judgment. 

She wrote that he told her he couldn’t reappoint her until a full review of her caseload had been completed. 

A full review revealed that Matoesian handled 90 cases of driving under the influence from Jan. 1 to Nov. 30, 2012, Symank wrote. Matoesian rescinded suspensions in 26 cases, a rate significantly higher than the office’s general rate, she wrote. 

She wrote that Selby represented defendants in 19 of 26 rescissions. 

“Given the result of the full investigation, Mr. Gibbons decided not to reappoint plaintiff to serve as an assistant state’s attorney,” she wrote. 

Magistrate Judge Donald Wilkerson received Symank’s motion on June 19, and set a July 24 deadline for a response. 

Barron missed the deadline, and moved the next day for an extension. 

On Aug. 7, Wilkerson extended the deadline to Aug. 18. 

On Aug. 17, Barron moved to extend it again. 

On Aug. 18, a Friday, Wilkerson extended it a week. 

Barron missed the Friday deadline, and filed the confession on Saturday, Aug. 26.

Grain company alleges horse feed manufacturer failed to make payments

EDWARDSVILLE — A grain and field bean company is suing a horse feed manufacturer for allegedly failing to make payments.

Kenson Grain Company, LP as assignee of McClaskey Grain Company, Inc., filed a complaint on Aug. 25 in the Madison County Circuit Court against McClaskey Feed Company, Inc., alleging that the defendant violated the agreed contract despite plaintiff performing all obligations under the parties' agreement.

According to the complaint, the plaintiff alleges that between October 2013 and December 2015 they sold and delivered oats to the defendant on an open account. Kenson claims that it has performed all obligations and satisfied all conditions under agreement but has not received payment requested in its invoices. 

The plaintiff alleges the defendant failed to pay the balance due despite demand amounting to $657,440.26.

The plaintiff requests a trial by jury and seeks judgment for the sum of $657,440.26, plus pre-judgment interest, costs of collection and further relief the court deems just.
