Rosenstengel orders U.S. and medical malpractice plaintiff to submit judgment calculations

EAST ST. LOUIS — A U.S. district judge in East St. Louis ordered that parties in a more than $29 million medical malpractice case involving a 36-year-old man who suffered severe kidney damage due to alleged negligence to submit calculations and proposed judgments to the court.

On June 19, U.S. District Judge Nancy Rosenstengel of the U.S. District Court for the Southern District of Illinois ordered that plaintiff Kevin Clanton and defendant the United States of America had to submit calculations, worksheets and proposed judgments in accordance with her instructions. All information had to be submitted by no later than June 30, according to the order.

In March, Rosenstengel awarded Kevin Clanton $29.6 million in damages in his medical malpractice suit against an East St. Louis clinic, which is operated by Southern Illinois Healthcare Foundation (SIHF). Clanton filed his suit against the federal government because it funded SIHF. The damages are to cover future medical expenses to treat Clanton’s kidney condition, which could include two more transplants.

During a hearing on May 22, the parties worked to translate the statute’s dictates into a workable methodology. After comparing the methodologies to the statute, the court held that Clanton’s methodology was “spot on.” The court ordered the parties to submit calculations with modifications.

For future damages, the amount of periodic payments should be calculated based on a life expectancy of 70 years, which Clanton will reach on May 23, 2050. The court found that the amount of future damages that should be included in the present award is $250,000, and declined to authorize an increased amount, according to the order.

The court rejected the defendant’s proposition that this amount should be reduced to present value. Since the defendant agreed to invoke the Illinois periodic payment provision, the court stated that it was obligated to follow all statute rules.

According to the order, the court also rejected the defendant’s proposal to impose a reversionary interest because the statute indicates that a plaintiff may still be entitled to payments after his death, and if so, those payments should be made to his qualifying survivors.


Herndon denies summary judgment in Highland principal's discrimination suit

EAST ST. LOUIS – District judge David Herndon denied the Highland Board of Education’s motion for summary judgment in a discrimination suit, concluding a jury could conclude that the plaintiff was paid less because of her gender. 

Herndon denied the summary judgment request on July 5. 

Plaintiff Karen Gauen filed the complaint on Feb. 26, 2016, against the Board of Education of the Highland Community Unit School District, alleging employment discrimination based on her sex. 

Gauen claims the Board of Education paid her less money than her male counterparts for her work as principal and assistant principal. 

She is currently employed as the principal of the Highland High School, a position she has held for the past four years. She worked as assistant principal for a year prior to her appointment to principal. 

Gauen was first employed as an educator for more than 35 years, spending 24 of those years at the Highland school district. In total, Gauen has over 40 years of experience in the education field. 

She has a doctorate in education administration but had no relevant administrative experience prior to her appointment at Highland High School. 

As assistant principal, Gauen’s salary was $79,000 plus an additional $1,000 for having the National Board Certification. 

She claims her male predecessors made $105,349 and $95,527 per year. Both had less experience in the education field. 

Gauen’s current annual base salary is $103,997. She has a total of four years of administrative experience. Her predecessor made $107,825

The Board of Education answered the complaint on April 26, 2016, denying the allegations. It also filed a motion for summary judgment. 

The defendant argues that the administrator’s salaries are not based on gender, but the candidate’s prior administrative experience and seniority in the position. 

It also argues that Gauen cannot prove she was treated differently than the male employees at the school and they have a legitimate explanation for the pay gap, which they claim is based in administrative experience. 

Gauen filed an opposition the request, arguing that she is paid less because she is a woman. 

The plaintiff alleges she often asked about the pay discrepancies and was told she was a “hometown girl” and “could not expect to get as much as a man moving his family,” according to her testimony. 

Herndon concluded that there are questions of material fact that preclude summary judgment. 

“Gauen and her male counterparts held the same jobs: Gauen and her male counterparts were subject to the same standards: and Gauen and her male counterparts were subordinate to the same supervisor,” the order states. 

Therefore, the motion for summary judgment was denied. 

Trip, fall suit against Fast Eddie’s Bon Air at trial in Mudge’s court

A woman’s trip and fall suit against Fast Eddie’s Bon Air alleging she tripped on an unmarked curb is at trial in Madison County Circuit Judge William Mudge’s courtroom.

The trial began July 18.

Plaintiffs Cleda and George Chestnut are represented in the case by Brian Wendler of Wendler Law PC in Edwardsville.

Fast Eddie’s is represented by James Leritz of Leritz, Plunkert and Bruning PC in St. Louis.

The plaintiffs filed the lawsuit on March 13, 2014.

In their three-count complaint, Cleda Chestnut claims she was a customer at Fast Eddie’s on Sept. 29, 2013, when she allegedly tripped and fell while walking on the enclosed street on the defendant’s Alton premises.

She alleges the street contained unmarked curbs and did not have transgression ramps from the pavement surface to the sidewalk.

She accuses the defendant of failing to warn of the alleged dangerous conditions.

As a result, Cleda Chestnut alleges she sustained severe and permanent injuries to her right leg, hip and related areas, requiring medical treatment.

She also claims she suffered great pain, mental anguish and permanent scarring from her injuries.

George Chestnut alleges he has been deprived, in whole or in part, of the support and services of his wife and is responsible for her medical bills.

Fast Eddie’s denies liability and argues that Cleda Chestnut contributed to her own injuries by failing to keep a proper lookout; failing to insure her own safety; failing to take adequate precautions to protect herself while in an unfamiliar area; and negligently walking on an area that was uneven, rough and dark.

Fast Eddie’s also argues that the condition of the premises was open and obvious.

The defendant sought summary judgment on Oct. 30, 2015.

“Whether a dangerous condition is open and obvious is determined by the objective knowledge of a reasonable person, not the plaintiff’s subjective knowledge,” the motion states.

“Based on the deposition testimony of Plaintiffs, Plaintiffs’ witnesses and Plaintiffs’ expert and looking at the circumstances objectively, it is clear that a reasonable person in Mrs. Chestnut’s position, exercising ordinary perception, intelligence and judgment, would have avoided the open and obvious hazard posed by the step,” it continues.

Mudge took the motion for summary judgment under advisement on Jan. 28, 2016. He ordered the defendant to produce additional photographs and ordered the plaintiffs to produce a copy of Eddie Sholar’s deposition.

On Nov. 28, 2016, Mudge entered an order requiring the parties to mediate.

The Chestnuts filed a motion to enforce the mediation order on Jan. 12.

They argue that after Mudge ordered mediation, the defendant failed to respond to emails seeking to select a mediator.

Then the defendant requested a settlement demand. The plaintiffs allegedly reminded Fast Eddies of the need to comply with the mediation order.

The defendant did not respond.

Mudge granted the motion that same day and appointed retired judge Daniel Stack to mediate the case.

On Jan. 25, Mudge set the case for trial this month.

Then on April 20, Mudge entered an order stating, “By agreement of the parties the Court’s prior Order appointing Hon. Daniel Stack as mediator does not preclude the parties from agreeing to mediation with a different mediator.”

Nothing further on the topic appears on the record.

Jury selection began July 18.

The Chestnuts seek a judgment of more than $50,000 each.

Karmeier deposition key factor in State Farm's summary judgment move in multi-billion RICO case

EAST ST. LOUIS – Illinois Supreme Court Justice Lloyd Karmeier swore he knew nothing of campaign contributions from State Farm in 2004, according to a motion the insurer filed against a $10 billion racketeering claim on July 17.

Ronald Safer of Chicago quoted a deposition of Karmeier in support of a summary judgment motion challenging federal jurisdiction.

Safer wrote that while plaintiffs seek relief from State Farm, they also seek relief from a decision of the Illinois Supreme Court.

That decision overturned a Williamson County judgment awarding more than $1 billion to policyholders whose vehicles crashed from 1987 to 1998.

Safer wrote that according to plaintiffs, Karmeier participated in a racketeering enterprise and knew the sources of his contributions.

“Plaintiffs have asserted that the factual basis for that claim would be provided by testimony from Justice Karmeier and Al Adomite,” Safer wrote.

“But theproof is not forthcoming.

“Plaintiffs have no evidence that Justice Karmeier knew that any campaign contributions came from State Farm or anyone related to State Farm or that he knew of any State Farm support of his campaign.”

“Justice Karmeier’s uncontroverted testimony is that he had no knowledge of campaign contributions from or in any way related to State Farm.”

“Likewise, Al Adomite testified at his deposition in this case that he had no knowledge that Justice Karmeier knew anything about the sources of his contributions and that Adomite himself had no knowledge of State Farm providing any support to Justice Karmeier’s campaign.”

Adomite, who worked for the campaign, currently serves as mayor of Troy.

"Notably, plaintiffs now contend that they do not need to show that Justice Karmeier knew anything about supposed State Farm contributions in order to prove their claims,” Safer

He wrote that plaintiffs couldn’t rely on precedents they cited without proving that Karmeier knew State Farm supported him and knew his vote was corrupt.

They can’t meet their burden, he wrote.

Patrick Murphy of Marion filed the original suit in 1997, as local counsel for a national team representing policy holders in 48 states.

Murphy later served as U.S. district judge, returning to private practice in 2013.

His complaint alleged that State Farm provided inferior parts for repairs.

At trial before Williamson County associate judge John Speroni, jurors awarded almost $1 billion to lead plaintiff Michael Avery and his class.

Speroni added damages under Illinois consumer fraud law, pushing the judgment above $1 billion.

Fifth District appellate judges shrank it a bit in 2001, leaving it above $1 billion.

State Farm appealed to the Supreme Court.

In 2004, Karmeier ran for the Supreme Court as a Republican.

Fifth District judge Gordon Maag, author of the Avery decision, ran as a Democrat.

Karmeier won, and took office on Dec. 6, 2004.

On Jan. 26, 2005, Avery’s counsel moved to disqualify him.

The Court denied the motion, and Avery moved for reconsideration.

The Court denied it, and decided the case in August 2015.

Avery moved for rehearing, again challenging Karmeier’s participation.

The Court denied it.

Avery sought relief at the U.S. Supreme Court, and didn’t get it.

In 2011, he petitioned the Illinois Supreme Court to vacate its judgment and recall its mandate.

The Court denied his petition.

His lawyers sued State Farm in U.S. district court in 2012, on behalf of lead plaintiff Mark Hale of New York State.

Hale sought to recover the judgment, plus interest, with triple damages.

He named State Farm employee William Shepherd and Illinois Civil Justice League director Ed Murnane as parties to the conspiracy.

State Farm moved to dismiss the suit, and Herndon denied the motion.

State Farm moved for reconsideration, and he denied it.

State Farm petitioned Seventh Circuit judges to stop the proceedings, but they denied the petition.

Herndon certified aclass action identical to the Avery class last year, and the Seventh Circuit denied a petition to decertify it.

Class counsel moved to expand the class definition, and Herndon granted it.

State Farm sought relief at the Seventh Circuit, and didn’t get it.

Herndon has set trial next May, but Safer’s motion aims to close the case.

“There can be no reasonable dispute that plaintiffs are attempting to use this federal case to seek redress for the Illinois Supreme Court’s reversal of the $1.05 billion judgment in Avery,” he wrote.

He wrote that Karmeier testified he had no memory of meeting Shepherd, and that Shepherd never served on his campaign committee or finance committee.

He quoted a Seventh Circuit precedent that delving into whether fraud tainted a state court’s judgment amounts to exercise of de facto appellate jurisdiction.

“Plaintiffs, moreover, had a reasonable opportunity to litigate in the Illinois Supreme Court the same due process and other issues they now raise in this federal court, and repeatedly did so.”

He wrote that all six participating Justices in Avery reversed the judgment for three reasons and decertified the class.

He wrote that two Justices who partially dissented would have remanded the case to circuit court to identify possible sub classes claiming breach of contract.

“Plaintiffs state that they do not contend that any of the rulings in theIllinois Supreme Court’s decision on the merits in Avery were erroneous," he wrote.

He wrote that they admitted that they claimed in each of five challenges that Karmeier’s participation violated their due process rights.

He wrote that they produced a document stating that they didn’t file a petition at the U.S.Supreme Court after the decision of the Illinois Supreme Court in 2011, out of concern that it might have a negative impact on a racketeering suit.  

Herndon denies remand to St. Clair County in personal injury suit against Dillard's

EAST ST. LOUIS – St.Clair County resident Toni Perrin concealed the value of a suit against retailer Dillard’s in bad faith to defeat federal jurisdiction, U.S. District Judge David Herndon ruled on July 13.

He denied a motion to remand Perrin’s personal injury suit to St. Clair County circuit court, where lawyer Lanny Darr of Alton filed it in 2015.

Herndon granted a bad faith exception to a rule that prohibits removal more than a year after commencement of an action in state court.

He wrote that Perrin deliberately failed to disclose an amount in controversy in excess of the $75,000 requirement for federal diversity jurisdiction.

Perrin’s suit fits the other requirement, a difference in state citizenships.

Herndon wrote that the history of the case lulled Dillard’s into believing the jurisdictional amount had not been met.

Perrin claims she slipped on vomit and fell at Dillard’s in St. Clair Square, in 2013.

She filed an arbitration proceeding in St. Clair County circuit court in 2015, seeking $50,000 plus costs.

Dillard’s served an interrogatory for the dollar amount of damages.

Darr answered,“Plaintiff’s suit was filed in AR division which is for claims of $50,000 orless.”

At an arbitration hearing before Associate Judge Heinz Rudolf in December 2015, Perrin testified that back surgery might be beneficial.

Rudolf entered anaward, which Perrin rejected.

She moved for transfer to the law docket, and Rudolf granted it in January 2016.

Dillard’s moved for summary judgment, and Associate Judge Christopher Kolker denied it this Jan.30.

He set a bench trialfor April 19.

On Jan. 31, Darr served a demand for $350,000.

On Feb. 23, Dillard counsel David Dimmitt of Maplewood, Mo., removed the suit on the basis of diversity jurisdiction.

On March 13, Darr moved to remand the action to St. Clair County.

He argued that Dillard’s knew the claim exceeded $50,000 after arbitration, when Perrin moved for transfer to the law docket.

He argued that a deposition of surgeon Thomas Lee also put Dillard’s on notice.

“Under any theory of removal, the defendant’s actions are too late to achieve federal court jurisdiction,” Darr wrote.

He wrote that seeking removal on the eve of trial was the type of activity that U.S. Code was intended to prevent.

He wrote that Dillard’s conduct warranted an award of fees and expenses.

On April 12, Dimmitt wrote that Perrin knew she would need back surgery in 2015, but didn’t communicate that to Dillard’s.

He wrote that bad faith doesn’t have to amount to malicious or unsavory conduct.

He wrote that it exists,“if the plaintiff deliberately failed to disclose the actual amount in controversy to prevent removal.”

“Moreover, plaintiff did not testify at her arbitration proceeding about the need for back surgery.”

His argument convinced Herndon, who held that the motion for transfer from arbitration to the law docket did not put Dillard’s on notice.

“Had the motion to transfer been accompanied with an update in discovery a contrary conclusion may result.”

He found no affirmative conclusion that surgery was necessary in a note that surgeon Lee signed last year.

“In fact, the note indicated epidural steroids were effective in relieving her pain; she experienced no acute distress, good range of lumbo sacral spinemotion, and normal gait,” Herndon wrote. 

He wrote that most importantly, Lee estimated she would need six steroid injections over the next two years. 

Herndon concluded that convoluted medical records and failure to supplement interrogatory responses satisfied the bad faith exception.

He has set trial next May.

Rex Carr continues to win court battles; Fourth District decides malpractice claim

SPRINGFIELD – Rex Carr, who won most of his court battles while alive, has won a court battle in death. 

On June 27, Fourth District appellate judges ruled that State Bar Association Mutual Insurance Company must defend Carr’s estate in a malpractice suit. 

The judges found that Carr’s misrepresentation of facts in a policy application for a single year did not void his coverage in following years. 

The judges affirmed Sangamon County Circuit Judge John Schmidt, who granted summary judgment to Carr’s estate and the firm he led. 

The underlying malpractice suit remains pending before St. Clair County associate judge John O’Gara, who plans a status conference on Sept. 25. 

In that suit, Bruce Siddle and Sandra Siddle of Millstadt blame Carr for a $2,160,000 judgment that a Tennessee court entered against them. 

In 2001, Bruce Siddle formed a joint venture between his security training firm, PPCT Management Systems, and a firm named Homeland Security Company. 

Doctor Crants Jr., and Doctor Crants III owned Homeland Security. 

Siddle took 25 percent ownership of their firm, in exchange for turning his firm into a wholly owned subsidiary. 

By 2005, the Siddles began to suspect that Crants and Crants cheated them by favoring other entities they controlled. 

The Siddles retained a Tennessee firm that the late U.S. Senator Howard Baker once led, and resolved the dispute without going to court. 

Crants and Crants agreed to depart, and the Siddles signed releases of all claims. 

One release obligated the parties to file any litigation in Nashville, Tenn. 

The release provided that if any suit should arise, the prevailing party would recover all legal fees and costs. 

Another suit arose in 2008, after the Siddles retained Rex Carr and son Bruce Carr. 

They sued Crants, Crants, and other defendants at U.S. district court in East St. Louis, challenging the validity of the releases they signed. 

In 2009, District Judge Patrick Murphy transferred the case to district court in Nashville. 

“This release agreement was negotiated between two sophisticated businessmen who had known each other for some time,” Murphy wrote. 

“The claim that fraud, coercion, and failure of consideration were involved in the release agreement doesn’t help Siddle.” 

Rex Carr and Bruce Carr filed another suit in East St. Louis two weeks later, with the same claims against other defendants. 

That suit also bounced to Nashville. 

Defendants there moved for summary judgment, and District Judge Aleta Trauger granted it in 2010. 

Sixth Circuit appellate judges affirmed the decision in 2012. 

Defendants then moved to recover legal fees as prevailing parties. 

The motion created a conflict for the Carrs, who withdrew from the case. 

The Siddles retained Tony Duncan of Nashville, who filed a third party complaint seeking to hold the Carrs liable for all fees and expenses. 

The Carrs notified State Bar Mutual Insurance of the complaint, and the insurer asked Sangamon County court to relieve it of any duty to defend them. 

The insurer argued that it wouldn’t have insured Rex Carr if he hadn’t made material misrepresentations in his policy application of 2008. 

The Carrs needed no defense at that point, however, for Trauger dismissed it without prejudice. 

She ruled that the Siddles hadn’t asked for permission to file it. 

In 2013, she found the Siddles jointly and severally liable for $2,159,738.04 in fees and expenses. 

She found Bruce Carr jointly and severally liable for $412,500, and Rex Carr jointly and severally liable for $31,500. 

Rather than request Trauger’s permission to sue the Carrs in Nashville, the Siddles sued them in St. Clair County. 

The Carrs notified State Bar Mutual, which continued to deny its duty to defend. 

The insurer argued that it covered only damages, not legal fees and expenses. 

Judge Schmidt ruled that State Bar Mutual must defend the Carrs, and Fourth District judges agreed. 

Justice Thomas Appleton wrote that, “in the eyes of the law, each renewal of an insurance policy results in a new contract, a new policy.” 

He wrote that under section 154 of Illinois insurance code, misrepresentations in other policies are irrelevant. 

“Plaintiff criticizes this requirement as unfair and against sound public policy, but section 154 says what it says, and we are powerless to rewrite it,” Appleton wrote. 

He wrote that on April 4, 2012, when Rex Carr signed the application, he answered no to a question asking if any claim had been made in the past 12 months. 

He wrote that Carr answered no to a question asking if he became aware of any circumstance that might result in a claim. 

Appleton asked what claim was made that wasn’t reported, or what unreported circumstance Rex Carr became aware of that might result in a claim. 

“The answers to these questions should be front and center in plaintiff’s argument for rescission, but they are not,” he wrote. 

Appleton rejected the argument that the policy did not cover the suit because it applied to damages and not to fees. 

He wrote that the complaint pleads damages including but not limited to the entry of judgment in Tennessee. 

“Unless it is clear that the complaint fails to state any facts that are within, or potentially within, the coverage of the policy, the insurer has a duty to defend the insured,” he wrote. 

Justices Lisa Holder White and James Knecht concurred.

Suit alleges negligence following riding mower roll over death

BELLEVILLE — A man is suing John Deere for allegedly manufacturing a defective riding lawn mower that caused his father's death.

Dale Sudholt, as independent administrator of the estate of Duane Sudholt, deceased, filed a complaint on June 19 in St. Clair County Circuit Court against John Deere Company, Deere & Company and WM Nobbe and Company Inc., alleging the defendants violated the Wrongful Death Act.

According to the complaint, the plaintiff alleges that on July 29, 2015, Duane Sudholt died while operating a riding lawn mower manufactured by the defendants. The plaintiff claims the lawn mower rolled over and fuel was released or ejected, which ignited and engulfed the decedent in flames. 

The plaintiff alleges the defendants failed to provide adequate devices to prevent fuel leaks in the event of a rollover.

The plaintiff requests a trial by jury and seeks judgment in a sum reasonable and equitable and in excess of $50,000, plus cost of suit and any other further relief the court deems just and proper.

Unclaimed property bill requires excess funds go towards curing pension debt

SPRINGFIELD - A provision of the omnibus budget bill that allows the Illinois treasurer to offset "actuarial reserve deficiencies" in the state's woefully under-funded pensions, faces criticism among business interests.

Proposed by Treasurer Michael Frerichs, the new law gives his office discretion to turn over any amount received through the sale of abandoned property to state pension systems during the fiscal year; and on April 15 and Oct. 15 of each year the treasurer is required to deposit any amount in the Unclaimed Property Trust Fund exceeding $2.5 million into state pensions.

However, if the treasurer determines that $2.5 million is not enough on those dates to pay the rightful owners of property, which includes unclaimed life insurance policies, abandoned bank deposits and safety deposit boxes, for example, the office may retain more in the trust fund.

The unclaimed property bill - known as House Bill 302 - passed both chambers before the end of the regular session in May. It became law after withstanding the governor's veto action earlier this month while packaged up with other legislation - including tax increases - under SB9.

Among other things, the new legislation expands the reach of the Unclaimed Life Insurance Benefits Act passed last year, and now requires insurance companies to locate beneficiaries of unclaimed life insurance policies by comparing names to the Social Security Administration’s Master Death File back to Jan. 1, 2012. Before the bill was amended in the Senate, the requirement reached back to 1996.

Pro-business groups have been critical of a provision in the bill that allows contingent fee auditors to try to find abandoned property owners and collect fees for services, saying that it doesn’t allow the targeted institutions much certainty as to when they can assume that an unclaimed asset will no longer be redeemed.

In a letter to the Treasurer's office, the Illinois CPA Society said it was principally opposed to any contingency audit arrangement.

"The basis of our opposition to contingent fee audit arrangements is that it obscures or clouds the auditor's objectivity, which is a fundamental tenant of an audit," says the May 9 letter written by the group's vice president for government relations Martin Green.

"Professional standards require all CPAs both in public practice and business and industry to maintain objectivity in rendering professional services."

The executive director of the Illinois Chamber of Commerce Tax Institute, Keith Staats, wrote in opposition to a bill similar to HB 302 - the Revised Uniform Unclaimed Property Act (HB 2603) - saying it would adversely affect the business community. 

"Current law forbids the hiring of third party contingent fee auditors to conduct audits of Illinois-based businesses," he wrote. "Current law recognizes resource limitations of the Treasurer by authorizing the hiring of such auditors to conduct out-of-state audits. In our estimation, any fears of a possible constitutional infirmity created by disparate treatment of in-state and out-of-state audits is misplaced."

State Sen. Kyle McCarter (R-Lebanon), who voted against the measure, said in May that the bill was not constitutional because it would be a new law applied retroactively to previously existing contracts.

Other local legislators who supported its passage included State Sen. James Clayborne (D-East St. Louis); and State Reps. Jerry Costello (D-Red Bud), Katie Stuart (D-Collinsville), LaToya Greenwood (D-East St. Louis), Jay Hoffman (D-Belleville) and Dan Beiser (D-Alton).

The under-funded problem

The state's pension liability from six different funds - General Assembly Retirement System (GARS), Judges’ Retirement System (JRS), Teachers’ Retirement System (TRS), State Universities Retirement System (SURS), State Employees’ Retirement System (SERS), and the Illinois Municipal Retirement Fund (IMRF) - has been estimated to exceed $250 billion.

"Actuarial deficiencies" were aided in the recent omnibus budget bill SB 9, which raised the personal income tax rate from 3.75 percent to 4.95 percent, and the corporate income tax rate from 7.75 percent to 9.5 percent.

The group Taxpayers United of America, which has fought for funding reform of pensions, claims that Democrat legislators who pushed for the increase “are just getting warmed up.”

Jim Tobin, TUA president, said pro-tax increase legislators plan on putting on the statewide ballot “a proposal to convert the state’s already high income tax to an even higher graduated income tax.”

“If put on the ballot, this income tax increase amendment to the state constitution will be presented to Illinois voters, and I can assure you that all state government employees, active and retired, will vote ‘Yes’ on this measure,” he said.

He added that almost all of money raised would go to the state’s “insolvent” pension plans.

“Nearly 100,000 Illinois government retirees collect annual pensions totaling $50,000 or more, and 17,000 of those former government employees collect annual pensions totaling $100,000 or more,” Tobin said. “This is outrageous.”

State tax hike means Harrisburg's richest get richer

School’s out in the summertime.

So when Harrisburg’s Mike and Angella Gauch decided they would drive to Springfield earlier this month, getting out of work wasn’t a concern.

He’s the superintendent of the Harrisburg School District, and she’s a teacher in Carbondale. Unlike most working adults in Saline County, they are off work in July.

This year, they spent part of their summer vacation successfully lobbying for a state income tax hike. 

When the tax hike passed, Angella Gauch lauded state legislators on Facebooktelling them thanks for “standing strong for kids.”

She didn’t thank them for standing strong for the Gauch family, although she might have.

Angella and her husband pulled in more than $220,000 from taxpayers last year. 

According to the Illinois State Board of Education, Mike earned $148,033, to go with seven weeks of paid personal or vacation days worth another $20,000. Angella earned $73,667.

The state income tax increase will cost their Harrisburg neighbors more: Saline County workers will send an additional $5 million per year to Springfield, according to estimates, while simultaneously protecting the Gauches' taxpayer-funded pensions and guaranteed annual salary increases amid steady school enrollment declines.

But Mike Gauch insists this isn’t about him.

“These are the people that matter,” Gauch said at a Vandalia rally with Chicago Public Schools Chief Forrest Claypool, gesturing to children holding “Save our Students” poster boards. “Not us: them.”

Southern Illinois’ new elite: paid by taxpayers

The Gauches represent a new reality in Southern Illinois: a public employee power couple whose income ranks them among the wealthiest families in Saline County.

Working just nine months a year, they earned more than five times the median household in Saline County, at $38,258 in 2015, according to the U.S. Census. 

And their home -- a four-bedroom, three-bath house two blocks from Shawnee Hills Country Club for which they paid $219,000 in 2015 -- is worth more than four times as much as their average neighbor's. The median home sale price in Harrisburg over the past 12 months was $46,500, according to Trulia.com.

Paying for accelerating lifestyles of public employees like the Gauches has come at the expense of private industry in this corner of Southern Illinois, which pays higher taxes to foot the bill.  

When it comes to speaking up for themselves -- against an income tax increase -- working men and women are at a major disadvantage.

“Myself along with hundreds of others were working and couldn’t go to Springfield to lobby,” Bob Sandidge, a 40-year veteran of the coal mining industry who lives in Carrier Mills, said. “Coal mines in Saline County were operating and carrying on business as usual.”

Sandidge says that it is unsustainable to continue to pay teachers and other public employees more as private-sector workers have seen their wages stagnate or fall. He blames higher taxes for making Southern Illinois less competitive than nearby Indiana and Kentucky, driving industrial jobs across the border.

“I think teachers should be compensated for their commitment and dedication, but not to the extreme that they are in Illinois,” Sandidge said. “The education system could stand to manage their cash the way a business manages its own cash. Numerous industries across the nation have been forced to make concessions in order to remain profitable, the education system might try following suit.”

“If there isn’t enough cash to provide a pension, then they should be offered some kind of a 401K system that matches a certain percent of their own contribution; likewise with health insurance and other benefits,” Sandidge said.

Teacher salaries and property taxes -- both higher in Illinois 

The average teacher's salary in Harrisburg District 3 is $51,744, according to the Illinois State Board of Education. That’s 35 percent more than the median income in Saline County.

It’s also higher than Harrisburg’s out-of-state peers. 

The median salary for a teacher in nearby Morganfield, Kentucky, is $45,655.

In Mt. Vernon, Indiana, it is $41,691.

In fact, Both Mt. Vernon ($92,300 median sale price) and Morganfield ($84,100) have higher costs of living than Harrisburg, as measured by real estate values.

That’s because property taxes are higher in Illinois, which makes it more expensive to own real estate.

An 800-square-foot, two-bedroom home at 8801 Darnell School Road in Mt. Vernon, Indiana, sold on June 30 for $82,500; its tax bill is $226. 

In Harrisburg, a 1,600-square-foot three bedroom home at 617 W. Ogara St.-- twice the size of the Mt. Vernon house -- sold for $89,000 earlier this spring. Its tax bill is seven times as high, at $1,680.

Sandidge, a West Kentucky native, said soaring property taxes make it difficult to put down roots here.

“When I lived in Kentucky, I owned a home valued at $250,000, and the property taxes ran around $1,700 per year,” he said. “In Illinois, I put in a double-wide home on a 2.5-acre lot valued at $85,000, and my estimated property taxes are in excess of $3,800. Something is wrong with that.”

LeChien denies injunction that would have forced payment to social services providers

Agencies that provide social services to the state can’t claim the same right of payment as state employees in the absence of appropriations, St. Clair County Circuit Judge Robert LeChien ruled on July 17.

LeChien denied an injunction against the Department of Human Services, finding an appellate court in Chicago had already decided the issue.

He hammered the department directors, however, even as he ruled in their favor.

“Here it is alleged that the directors act in bad faith which is outside the scope of their authority,” LeChien wrote.

“The defendant directors are without authority, and are beyond the scope of their discretionary decision making powers, when they act in violation of public policy.

“It is the public policy of the state of Illinois that its executive officers discharge their duties in good faith.

“The directors are presumed to know that, at the time of entering contracts with plaintiffs that the state had decided that it will deny payment.

“While defendant directors have no duty to terminate the providers’ contracts, they must honor the contracts to the extent that it is not impossible to perform and they cannot impair contracts by accepting services for our citizens knowing that the providers will not be paid.”

He wrote that plaintiffs have no remedy in the Court of Claims, which hears contract disputes and other claims against the state.

“These agencies will fail because the governor and the General Assembly could not act together to take care of the needs of our citizens,” he wrote.

“Plaintiff providers are advised that their remedy is to lobby the members of the General Assembly for all the process they are due.

“If providers’ only option to be paid is to lobby the General Assembly to get paid, then providers have no remedy.” 

Caritas Family Solutions, a Catholic agency, stood as lead plaintiff.

Illinois had operated without a budget since June 30, 2015 - until legislators came up with a plan on July 6 – during which time members of state employee unions had worked without a contract. 

When the budget ran out, LeChien granted an injunction authorizing the state comptroller to process a normal payroll in the absence of appropriations. 

Earlier this year, attorney general Lisa Madigan moved to dissolve the injunction. 

She argued that it has allowed Gov. Bruce Rauner and legislators to shirk their constitutional duty to adopt a budget.

LeChien denied the motion.

City of Fairview Heights seeks order to authorize demolition of property

BELLEVILLE – The city of Fairview Heights is seeking demolition of a property it alleges is unsafe.

City of Fairview Heights, Illinois filed a complaint on June 2 in the St. Clair County Circuit Court against Evelyn I. Youmans; City of O'Fallon, Illinois; Sabre Investments LLC; and St. Clair County as Trustee for Taxing Districts

According to the complaint, Youmans owns a Caseyville Township property and that the remaining defendants either bought the delinquent taxes or hold a lien on the property.

The plaintiff alleges that on July 25, 2016, it mailed a letter to Youmans informing that it would apply for an order authorizing demolition unless said building is put into safe condition or demolished within 15 days.

The plaintiff holds Youmans; city of O'Fallon; Sabre Investments LLC; and St. Clair County as Trustee for Taxing Districts responsible because the defendants allegedly failed to demolish the property and that it remains dangerous and unsafe.

The plaintiff seeks expedited judgment for an order authorizing demolition of the building, payment for costs of suit, and for such other relief as the Court deems just and proper. It is represented by James L. Gehrs of Becker, Hoener, Thompson & Ysura, PC in Belleville.

Anderson Hospital patient seeks more than $50K over alleged injuries from surgery

EDWARDSVILLE – A Madison County woman alleges that she was injured because of the negligent conduct of a Maryville physician.

Brittany Brown filed a complaint on July 10 in Madison County Circuit Court against James Fernandez, M.D. alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 19, 2015, she came under the care and treatment of defendant Fernandez at Anderson Hospital for a scheduled excision of the left submandibular gland. She alleges that the defendant failed to remove the salivary stone that was identified before the operation and failed to remove the gland.

The plaintiff holds Fernandez responsible because the defendant allegedly failed to prescribe a full 10 days of antibiotics for treatment of sialoadenities prior to surgery and failed to follow conservative treatment measures before resorting to surgery.

The plaintiff requests a trial by jury and seeks judgment in an amount of more than $50,000, plus costs and other further relief the court deems proper and just. She is represented by John J. Hopkins of John J. Hopkins & Associates, PC in Alton.

Woman seeks $50K in damages over alleged injuries from Alton collision

EDWARDSVILLE – A woman alleges her head and neck were injured as a result of a collision in Alton.

Lindsay Thien filed a complaint on July 10 in Madison County Circuit Court against Erin D. Hall alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 23, 2016, she was driving in an easterly direction on Homer Adams Parkway when the defendant's vehicle rear-ended her vehicle. As a result, Thien claims she suffered physical injuries, lost wages and incurred large sums of money in medical bills. 

The plaintiff holds Hall responsible because the defendant allegedly failed to keep vehicle under proper control, failed to keep a proper lookout, failed to apply brakes and failed to reduce speed to avoid the accident.

The plaintiff seeks judgment of more than $50,000, plus costs of suit, and any other further relief deems appropriate and just. She is represented by Jane Unsell of Unsel, Schattnik & Phillips, PC in Wood River.
