Minnesota woman sues for alleged injuries at Collinsville Days Inn

EDWARDSVILLE -- A Minneapolis is suing Days Inn in Collinsville for damages for injuries she allegedly sustained while walking on the hotel’s handicapped walkway.

Georgia Lynch’s lawsuit claims it was the defendants’ duty to ‘’exercise reasonable care to protect Plaintiff from the dangerous condition of the premises’ handicapped ramp and walkway.’’

The Frederick Law Firm LLC of Chesterfield, Mo., filed the suit on behalf of Lynch in the Madison County Circuit Court against BGMR RMDC, LLC, RM Hospitality Management of Belleville, Sneha Bhakta, and Ramanbhai Patel of Collinsville.

According to the complaint, the incident occurred June 27, 2015, when Lynch was a registered guest at the Days Inn of Collinsville.

The suit claims the defendants were responsible for Lynch’s injuries, alleging they did not make a reasonable inspection of the premises, and they allegedly knew that the handicapped ramp was in a damaged, defective and dangerous condition. 

The suit also alleges the defendants failed to exercise reasonable care to protect from injury and they also allegedly failed to barricade, cover and repair the ramp. 

In addition, the suit claims that the defendants failed properly monitor and control the premises and failed to warn the plaintiff of the hazard.

According to the complaint, Lynch has suffered permanent back and spine injuries that has caused great physical pain, suffering and emotional distress.

Lynch also said she has spent money for medical care and treatment of her injuries and has suffered a disability and a loss of a normal life. She also is looking to be compensated for future medical care as well.

In the 12-count, 33-page complaint, Lynch is looking for at least $50,000 per count.


Two drivers, passengers sue man for allegedly causing 2015 crash on East Broadway in Alton

EDWARDSVILLE — Four plaintiffs are suing a motorist, alleging that he was negligent in causing a wreck on East Broadway in Alton.

Najah Bagley, Sandra Cole, Kimberli Holts and Charmaine Terrell filed a complaint on June 9 in Madison County Circuit Court against David Watson alleging that the defendant failed to operate his vehicle with reasonable care for the safety of other persons and for their property. Cole was driver Bagley's passenger, and Terrell was Holts' passenger; the two cars were allegedly both struck by the defendant.

According to the complaint, the plaintiffs allege that, on July 7, 2015, plaintiffs were traveling on East Broadway near Washington Avenue when they collided with the defendant's vehicle, resulting in multiple collisions. As a result, plaintiffs claim they suffered severe physical injuries, pain and medical expenses. 

The plaintiffs hold Watson responsible because the defendant allegedly failed to stop or swerve his vehicle at the appearance of danger, drove his vehicle at a speed that was greater than reasonable and proper with regard to the traffic conditions and failed to stop or yield right of way.

The plaintiffs request a trial by jury and seek judgment in an amount in excess of $50,000, plus costs and such other and further relief as the court deems appropriate. They are represented by Kenneth B. Beljanski and Jaye R. Lindsay of Brown and Brown LLP in Fairview Heights.

Man accused of negligence for Troy crash with then-16-year-old driver, four passengers

EDWARDSVILLE — A driver and her four passengers are suing a motorist for alleged careless driving which caused a collision.

Joelisa Lacey, Tarashay Anderson and Clorin Anderson, and Joyce Anderson as next-of-kin of Nakkia Young, a minor, filed a complaint on June 12 in Madison County Circuit Court against Joe Walker alleging that the defendant failed in his duty to exercise ordinary care in the operation, possession, and control of his vehicle so as not to cause injury to others. Joyce Anderson is the mother of driver Joelisa Lacey, who is now 18 but was 16 at the time of the crash; Young is 17.

According to the complaint, the plaintiffs allege that on July 5, 2015, Lacey was driving northbound on Washington Avenue near Homer M. Adams Parkway in Troy together with her four passengers when her vehicle collided with defendant Walker's vehicle. As a result, plaintiffs suffered physical injuries, disability and medical expenses. 

The plaintiffs holds Walker responsible because the defendant allegedly failed to keep his automobile under proper control, failed to keep a proper lookout for other automobiles on the public street and failed to give a proper signal or sound his horn in time to warn plaintiffs.

The plaintiffs request a trial by jury and seek judgment in excess $50,000, together with costs of action, and any other further relief to which the court deems proper. They are represented by Michael P. Glisson of Williamson, Webster, Falb and Glisson in Alton.

Motorcyclist says Affton Trucking, driver responsible for May crash in Edwardsville

EDWARDSVILLE — A Hartford Village motorcyclist is suing a trucking company and its employee, alleging negligence in maintaining and operating a semi-truck.

James Woods filed a complaint on June 8 in Madison County Circuit Court against Affton Trucking Company Inc. and Allan E. Osburn alleging that defendant Osburn failed while in the course of his employment to operate the company's vehicle with reasonable care.

According to the complaint, the plaintiff alleges that on May 16, while operating his Yamaha Star motorcycle on New Poag Road in Edwardsville, plaintiff attempted to make a lefthand turn onto Lakeview Corporate Drive when he collided with defendant Osborn's tractor-trailer that is owned by defendant Affton Trucking Company. As a result, Woods claims he suffered severe physical injuries, trauma and lost income, as well as significant medical expenses. 

The plaintiff holds Affton Trucking Company and Osburn responsible because defendant Osburn allegedly failed to keep the truck under control, failed to keep a proper lookout for others in the intersection and failed to yield the right of way to other vehicles in the intersection.

The plaintiff requests a trial by jury and seeks judgment in excess of $50,000, plus costs of suit and any other relief the court deems just and proper. He is represented by Reed Nelson of Nelson and Nelson Attorneys at Law PC in Belleville.

Driver allegedly negligent for causing crash in Edwardsville parking lot

EDWARDSVILLE — A mother, individually and on behalf of her minor daughter, is suing a driver for breach of duty while he was backing out of a parking space, causing a collision and injuries.

Lauren Celis, individually and as mother and next friend of A'ana Garrett filed a complaint on June 13 in Madison County Circuit Court against Nathan Ash alleging that the defendant failed to use ordinary care for the safety of people riding in other vehicles.

According to the complaint, the plaintiff Celis alleges that on June 15, 2015, she was driving through a parking lot in Edwardsville with her daughter as passenger. Celis claims she collided with defendant Ash's vehicle as he was exiting a parking space. As a result, plaintiffs suffered physical injuries, medical treatment and medical expenses. 

The plaintiff holds Ash responsible because he allegedly failed to keep a proper lookout, failed to yield right of way, failed to stop and failed to maintain a proper speed.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, together with costs of action and other further relief as the court deems just and proper. She is represented by Eric W. Evans of Evans|Blasi in Granite City.

Man files Dram Shop suit against Doc Holliday's

EDWARDSVILLE — A driver is suing a Cottage Hills bar and its operators, alleging that their sale of alcohol to an individual contributed to a crash that caused serious injuries.

Kenneth A. Outhouse filed a complaint on June 8 in Madison County Circuit Court against 308 MacArthur Inc., doing business as Doc Holliday's Saloon and Eatery, and Bret W. Dixon, Steven Vollmer and Alexus Pate, alleging the defendants failed in their duty to properly sell liquor to the general public.

According to the complaint, the plaintiff alleges that on June 28, 2016, he suffered severe injuries when his vehicle was struck by Pate's vehicle. 

Pate allegedly drove her vehicle after drinking alcohol sold by Doc Holliday's Saloon and Eatery. 

As a result, Outhouse claims he suffered great physical and emotional pain, lost wages and medical expenses. 

The plaintiff alleges the defendants sold and gave Pate alcoholic beverages, thereby causing her to drive her vehicle while intoxicated and run a stop sign, striking plaintiff's vehicle.

The plaintiff requests a trial by jury and seeks judgment for an amount in excess of $50,000, plus costs of the suit and other relief the court shall deem proper.

Man claims faulty rifle caused blindness in one eye

EDWARDSVILLE — A man is suing a gun store, claiming it sold him an unsafe firearm that caused blindness in one eye.

Johnny J. Markus filed a complaint on June 13 in Madison County Circuit Court against Precision Outfitters LLC, alleging the defendant failed to use ordinary and reasonable care in its marketing, inspecting and sale of a rifle and rifle cartridges.

According to the complaint, the plaintiff alleges that on Nov. 26, 2016, he purchased a Springfield M1 Garand rifle and 10 boxes of American Eagle ammunition that he placed in his gun safe shortly after purchasing. 

Markus claims he was later struck in the right eye as he pulled the rifle's trigger when the bullet exploded, causing a shard of metal to strike his eye. 

Markus claims that, as a result, he suffered complete loss of vision in his right eye, necessitating medical treatment and expenses. 

The plaintiff alleges Precision Outfitters failed to properly inspect and/or test the rifle and failed to warn its customer that the rifle had not been tested or inspected.

The plaintiff requests a trial by jury and seeks judgment in an amount of $50,000, plus costs of suit and such further relief as the court deems just and proper.

Insurance company alleges roof lifted off building from wind gusts

EDWARDSVILLE — An insurance company is suing a roofing installation contractor after the roof allegedly lifted off a corner of the building from wind gusts.

Hastings Mutual Insurance Company, as subrogee of Honke Properties LLC, filed a complaint on June 12 in Madison County Circuit Court against Elmer Valladares, alleging the defendant failed to perform all roofing work in a workmanlike manner and according to standard practices.

According to the complaint, the plaintiff alleges that on Jan. 10, Honke Properties' roof, which was installed by Elmer Valladares, failed when it broke loose and lifted off the building in the southwest corner due to wind gusts. 

The plaintiff claims the roof was not installed properly, leading to leaking and water damage in the building. The insurance company paid $103,457.86 to its insured in order to cover damages. 

The plaintiff alleges Valladares failed to secure the perimeter of the roof as required by the manufacturer and failed to comply with all applicable codes, regulations, guidelines, instructions, policies, procedures and industry customs and practices.

The plaintiff requests a trial by jury and seeks judgment in the amount of $103,457.86, plus costs of suit and any other further relief to which the court deems proper.

Should shooter have been allowed to retain FOID card?

The gunned down shooter from Belleville who on Wednesday brought the country to its knees possessed a valid Firearms Owner Identification (FOID) card, authorities say.

But several authorities think he shouldn’t have.

Six charges against James T. Hodgkinson stemming from a violent episode in 2006 with a 16-year-old girl with whom he and his wife held legal guardianship were boiled down from domestic battery, aggravated discharge of a firearm, battery and criminal damage to a motor vehicle to three: two counts of battery and one count on damage to vehicle.

And in spite of an arrest report that showed Hodgkinson punched a 19-year-old woman in the face and hit 19-year-old man in the back of his head with the stock of a shotgun, among other offenses, he was not tried, nor convicted, as the state dropped charges against him.

"At some point in time, there should have been alarms triggered," said O'Fallon attorney Paul Evans. "I can see a one time failure, but this man seems to have had a history of connections to violence."

On March 24, a neighbor of Hodgkinson's rural Belleville home, Bill Schaumleffel, notified St. Clair County Sheriff's Department that Hodgkinson was firing shots with what appeared to be a rifle into a field while children were nearby playing outdoors. Sheriff Rick Watson said officers responded, but because he wasn't breaking any law and his FOID card was valid Hodgkinson did not face arrest.

Illinois State Police can deny issuing a FOID card or revoke one that has been granted if a person is convicted within the past five years for battery, assault, aggravated assault, violation of an order of protection or a substantially similar offense in another jurisdiction in which a firearm was used or possessed.

It can also deny or revoke a card of anyone who has ever been convicted of domestic battery or aggravated domestic battery or a substantially similar offense in another jurisdiction.

But without a conviction, the state cannot revoke the privilege.

State Rep. Charlie Meier (R-Highland) said court systems must uphold the law. "But if it never convicts, just arrests and pleads down," that is problematic.

Court record expungements, which he says he sees "constantly," also are problematic if they end up exposing the public to dangerous persons.

Meier said the state should be doing better with inter-agency and departmental connectedness, where instant access to information could be useful among law enforcement and the justice system. But the state being broke has sidelined IT systems updates, though he says plans are being advanced by the Rauner administration to move forward on an upgrade plan.

"We have a state that is so dysfunctional," he said. "None of our systems talk amongst each other."

When the state was flush with cash in the 1980s, Meier said Illinois led the way in computerizing data with other states "following what we did."

Laura Cutilletta, legal director at Law Center to Prevent Gun Violence in San Francisco, said that even though Hodgkinson's FOID card was not subject to revocation, he might have been "a good candidate" for something her group advocates for - gun violence protective order.

She pointed to legislation pending in Springfield, HB 2354, which would allow a family member or law enforcement official who sees "red flags" to petition to have a gun temporarily removed and prevent the purchase of new guns while an order is in place.

"We very strongly support that policy," she said, which has passed in California and the state of Washington.

She also said that a 2013 "clear and present danger" Illinois law that requires, among other things, that law enforcement officials report to state police behaviors deemed dangerous in order to prevent access to firearms and ammunition, might have had an effect on the "horrible situation" involving Hodgkinson's 2006 arrest.

"If that had happened after 2013, there's a good chance law enforcement would have reported and he would have lost his FOID card," she said.

Hodgkinson was shot and killed by Capitol Police after he opened fire during a House GOP practice for a charity baseball game. He had critically wounded Louisiana Rep. Steve Scalise, Majority Whip, whose condition has recently been upgraded to "serious."

Details of the St. Clair County Sheriff's report at 5:49 p.m. on April 1, 2006, say that 19-year-old Joel Fernandez confronted Hodgkinson because he had "punched his girlfriend in the face with a closed fist."

The report indicates Fernandez and his girlfriend Aimee Moreland were at an address across the street from Hodgkinson.

When Fernandez approached Hodgkinson's outside porch, Hodgkinson walked outside with a shotgun and aimed it at Fernandez's face, the report states.

"Fernandez attempted to get away from the shotgun and was struck in the left side of his head with the wooden stock by Hodgkinson," the report states.

While running to the house across the road, Hodgkinson fired a round, it states.

Then Moreland, friend of Hodgkinson's ward "Cathy,” said Hodgkinson forced his way into the neighboring house, grabbed Cathy "by the hair and pulled her off the floor."

Court records indicate that “Cathy" was a great niece of James and Suzanne Hodgkinson.

"Aimee observed James (Hodgkinson) throwing (Cathy's name redacted) around the bedroom area," it states. "(Cathy) was able to get away from James and ran into an adjacent bedroom and went on top of the bed. James followed (Cathy) and started hitting her arms, pulling hair and started grabbing her off the bed. (Cathy) once again broke free and both (Cathy) and Aimee ran out of the residence."

The two got inside Aimee’s vehicle. Hodgkinson cut the ignition and cut a seatbelt with a knife. He was choking Cathy while she was holding onto the steering wheel, the report states.

Aimee said she would call the police, according to the report.

"James became upset and punched Aimee in the face with a closed fist," the report states.

At the age of 25, Cathy is reported to have died of a drug overdose on July 26, 2015.

Mother of Belleville murder victim wants justice for son

GREENWOOD, Miss. – Six months after the murder of Carl Silas in Belleville, his mother wants to know who murdered him and why. 

“I am very suspicious of everyone up there,” Leisa Silas said on June 17. “I believe all those people up there are working together,” she said. 

Silas said she received notice of trial for defendant David Fields on May 19, and she drove up for it.

“They didn’t do anything. It wasn’t worth coming for,” she said. 

Silas said Fields’s lawyer told the judge she wasn’t ready for trial.

Fields is represented by attorneys Brittany Kimble of Chicago and Ryan Neal of St. Louis, according to the St. Clair County Circuit Clerk.

“The judge seemed happy to do whatever she said,” Silas said. “They should have taken him to trial.” 

St. Clair County Circuit Judge Robert Haida continued trial to July 21.

“Nothing adds up that they’re telling me,” she said. “It was more than David Fields. I believe he murdered my son but there’s someone else.

“They have a special prosecutor from outside. Why can’t they get a judge out of another place? If all the judges are together, they shouldn’t use the judge they have.”

Fields, age 20, allegedly murdered Carl Silas, age 28, on Dec. 30. 

Around 4:30 a.m., according to investigators, Fields and another man broke into an apartment that Silas shared with Jamie Lott, mother of his infant son. 

Investigators said Fields shot Silas and the other man struck Lott with a gun. 

Officers arrested Fields that day. They never arrested the other man, who they described only as light skinned. 

Although Silas said she has learned little about her son’s death, she has learned much about St. Clair County judges. 

Silas knows that the late associate judge Joe Christ died of a cocaine overdose in 2013.  She knows that former circuit judge Michael Cook served a prison sentence for possessing heroin and using it while possessing firearms.

“I have a bad feeling about this case,” she said, because of what she has read about judges in St. Clair County.

Silas said she has kept up with the sensational events that followed her son’s death.

In January, special prosecutors began investigating Circuit Judge Ron Duebbert as a suspect in obstructing the murder investigation. 

Duebbert had taken Fields into his home for a time while in private practice, after Fields completed a prison sentence for domestic battery. 

State’s attorney Brendan Kelly reported Duebbert to the judicial inquiry board. 

Chief Judge Andrew Gleeson blocked Duebbert from performing judicial duties, pending completion of the investigation. 

Silas said she wants to know why Fields and Duebbert communicated by text messages a day before the murder.

Silas said she saw pictures of Fields on Facebook, in Duebbert’s Porsche. She said Duebbert’s nickname is “Dollar Bill.” 

She said she learned of Carl’s death through a call from Lott around 6:30 a.m., and asked Lott why police hadn’t called her. Silas said Lott gave the phone to police who were there. 

Silas and three daughters drove up and arrived in Belleville between 7 and 8 p.m. on the day of the murder. 

“They said they interviewed lots of witnesses,” Silas said. 

Silas said she asked them what weapon was used. 

“They said they can’t tell me everything because it would blow the case,” she said. “They never told me what kind of gun it was.” 

Silas’s suspicion extends to Lott’s injury. 

“That was just a little peck on the head,” Silas said. 

“Jamie Lott says her mother wrestled with a man but she doesn’t know which one. I think everybody in that house knew what happened. 

“Lots of people know what happened to my son. I’m not going to ever stop trying to find the truth. My son’s death is not going to be swept under the rug.” 

Silas showed a picture of Carl as an honor student. 

Silas said she has a PhD in psychology and he wanted to be a psychologist. She said he was in New Green Grove Church since he was 12.

“He was a good child and well respected,” she said. 

Silas said he had no criminal record, only some traffic tickets. She said he went back and forth from Mississippi to St. Louis. He left in October because Lott was about to have a baby. 

Silas showed a picture of Carl’s daughter, born in October.

“That is the child who was sleeping on her mother and her father,” she said. “The blood was all over that baby.” 

Silas’s suspicion extended to a reporter’s request for an interview on Saturday. She asked for a photograph in advance and for a first meeting at a restaurant, Silas brought a police officer.

For that meeting, Silas also brought daughter Mary Silas.

She agreed to an on-record interview on Sunday in a neighborhood park.

“Why haven’t they come up with anything?” Silas said. “I don’t think they’re doing anything.”

She said she has no fear in raising questions.

“I want justice for my son Carl Silas,” she said. “I got to live with this the rest of my life…my son had a lot to live for. They are cold, bloody murderers and I want justice.”

St. Clair County Sheriff Rick Watson has not returned phone calls seeking information about the weapon used in the Silas murder.

Mass actions have come to an end in state courts, Sotomayor laments

WASHINGTON – Supreme Court Justices have put an end to mass actions in state courts against two or more defendants, according to a dissent they don’t dispute. 

The dissent, by Justice Sandra Sotomayor, mourned the Court’s June 19 rejection of California state court jurisdiction over drug maker Bristol-Myers Squibb. 

“It will make it impossible to bring a nationwide mass action in state courts against defendants who are ‘at home’ in different states,” Sotomayor wrote, 

“There will be no state where both defendants are at home, and so no state in which the suit can proceed.” 

That suited the other eight Justices. 

They held that plaintiffs could join together for consolidated actions in courts with general jurisdiction over a defendant, or they could sue in their home courts.  

The case began years ago, as eight suits claiming injuries from blood thinner Plavix. 

Among 678 plaintiffs, 86 resided in California. 

Texas topped that number with 91, and Ohio came close with 71. 

Plaintiffs also sued McKesson Corp., a California company that distributes drugs for Bristol-Myers Squibb and other drug makers. 

Bristol-Myers Squibb moved to quash service of summons from plaintiffs in other states, and the California Superior Court denied the motion. 

The California Court of Appeal denied a petition for a writ. 

In 2014, the U.S. Supreme Court tightened general jurisdiction in a case involving automaker Daimler Chrysler. 

In light of that decision, the California Supreme Court directed the Court of Appeal to vacate its order denying relief. 

The Court of Appeal changed its logic but not its result, finding the state court lacked general jurisdiction but could exercise specific jurisdiction. 

California Supreme Court Justices affirmed the ruling, on the basis of extensive contacts between Bristol-Myers Squibb and California. 

They held that the more wide ranging the contacts, the more readily a plaintiff could show connection to a forum. 

Three Justices dissented, finding the majority rendered specific jurisdiction indistinguishable from general jurisdiction for many categories of cases. 

Their view prevailed in Washington. 

Justice Joseph Alito wrote that the California court’s definition of specific jurisdiction “resembles a loose and spurious form of general jurisdiction.” 

Alito described general jurisdiction as all purpose, specific jurisdiction as case linked. 

He wrote that general jurisdiction for an individual depends on domicile, and general jurisdiction for a corporation depends on domicile or its equivalent. 

He wrote that a court with general jurisdiction may hear any claim against a defendant, even if all incidents underlying the claim occurred in a different state. 

“Specific jurisdiction is very different,” he wrote. 

Alito wrote that it requires affiliation between the forum and the controversy. 

He quoted a precedent from 1958, that restrictions on personal jurisdiction are more than a guarantee of immunity from inconvenient or distant litigation. 

Quoting from that decision, he wrote, “They are a consequence of territorial limitations on the power of the respective states.”

He quoted a precedent from 1945, that continuous activity within a state “is not enough to support the demand that the corporation be amenable to suits unrelated to that activity.” 

“The present case illustrates the danger of the California approach,” Alito wrote. 

“The state court found that specific jurisdiction was present without identifying any adequate link between the State and the nonresidents’ claims.” 

Sotomayor called the decision a first step toward contraction of specific jurisdiction similar to the contraction of general jurisdiction in 2014. 

She wrote that the majority appeared to concede that the case was not about fairness but was about power. 

“Such a rule hands one more tool to corporate defendants determined to prevent the aggregation of individual claims and forces injured plaintiffs to bear the burden of bringing suit in what will often be far flung jurisdictions,” she wrote. 

She predicted piecemeal litigation and bifurcation of claims. 

“And there is nothing unfair about subjecting a massive corporation to suit in a state for a nationwide course of conduct that injures both forum residents and nonresidents alike,” she wrote. 

Sotomayor wrote that Bristol-Myers Squibb employs about 25,000 persons worldwide, with annual revenues greater than $15 billion. 

She wrote that McKesson is responsible for about a fourth of its revenue.  

“All of the plaintiffs, residents and nonresidents alike, allege that they were injured by the same essential facts,” she wrote. 

“Our cases require no connection more direct than that.” 

She wrote that the people of California had an interest in efficient regulation of resident and nonresident corporations. 

In a footnote, she wrote that the Court didn’t address whether a plaintiff in state court can represent a class of persons not injured in that state.

Radical left-wingers often use the banner of “social justice” to implement their hidden agendas, and the “racial sobriety” program offered by Fr. Clarence Williams is a perfect example.

Fr. Clarence comes across as an affable, well-intentioned man of the cloth, but his program is diabolical. The premise is that all white people are racists, and all blacks victims of racism. Anyone who denies this preposterous premise is considered dishonest or delusional. The program, which is supposedly modeled on the Alcoholics Anonymous 12-step plan but might just as well have come from the pages of George Orwell's 1984, requires white participants to admit they are racists in order to be healed. 

Francesca Moroney Cooper may not be a graduate of this brainwashing program, but she sure sounds like one.

When she addressed the 25th reunion of DePauw's Class of 1992 two weekends ago, she acknowledged her white privilege, confessed her status as a recovering racist, and encouraged all the white alumni in attendance to do the same.

It was virtue signaling taken to a nauseating extreme. If this rambling, whiny, coyly self-deprecating and affectedly pious gibberish represents her best attempt at “critical thinking,” then DePauw should take back her diploma and refund the money wasted on her education.

The ironic thing is, Moroney Cooper does enjoy substantial privileges – and they have come at great cost to others, black and white – but they cannot be attributed to her pigmentation. They come from the wealth her husband, Jeffrey Cooper, accumulated as one of the most prolific asbestos attorneys in the country.

Her husband and attorneys like him are responsible for destroying more than one hundred once-thriving American businesses and putting tens of thousands of their diversely-colored employees out of work.

That's for what she should apologize.

Instead, Francesca Moroney Cooper flaunts her “sobriety,” in the process contributing to and exacerbating the racial discord that agitators have ginned up over the last decade, to the detriment of all Americans.

Notice of impending dismissal filed in nurse's suit alleging termination following breast cancer

Notice of impending dismissal was given in a nurse’s discrimination suit alleging she was wrongfully terminated after she took leave for breast reconstruction surgery following breast cancer.

On June 13, a notice of impending dismissal for want of prosecution was filed by Deputy Clerk Reid Hermann.

The notice states that either plaintiff Donna Crow has failed to effectuate service as required or defendant Southern Illinois Healthcare Enterprises Inc. has been served but failed to move, answer or respond to the complaint.

The parties were given 21 days to effect service, move for default or move to voluntarily dismiss the case.

Crow filed the complaint on Feb. 6 in the U.S. District Court for the Southern District of Illinois, alleging she was diagnosed with breast cancer for a second time on Sept. 11, 2013. She claims she had to apply for leave under the Family Medical Leave Act for breast reconstruction surgery.

She allegedly returned to work on April 14, 2014, and learned she had been replaced.

She was later terminated from her employment for what she claims was a pretextual reason, the suit states.

As a result, Crow claims she suffered loss of income and benefits, mental anguish and loss of reputation.

Crow alleges Southern Illinois Healthcare Enterprises failed to accommodate her for her second reconstruction surgery, retaliated against her for seeking surgery outside of her employer and replaced her with a younger employee at a lower rate of pay.

She seeks a judgment in her favor including back pay and loss of employment benefits, injunctive relief, reinstatement to her previous position and any other relief the court deems just.

She is represented by Teresa Machicao-Hopkins of Machicao and Associates in Marion.

Kolker denied dismissal in legal malpractice case involving divorce dispute

St. Clair County Associate Judge Chris Kolker denied the Blake Behme Law Group’s motion to dismiss a former client’s $1.15 million legal malpractice suit, in which they argued that she agreed to a divorce settlement on her own after her attorneys advised against it.

Plaintiff Bobbi Jo Fults filed her complaint on Nov. 22 against Edward J. Blake Jr., Megan M. Gilbreth and the Blake Behme Law Group PC.

Fults married and divorced Kenneth J. Fults four times. During the fourth divorce, Fults retained the defendants as counsel. She claims she lost at least $1 million for her share in the couple’s marital property.

She also alleges she sustained attorneys’ fees in excess of $50,000 and suffered emotional distress worth more than $100,000.

Fults alleges the defendants failed to protect her interest, failed to discover all the marital property that should have been included in the property settlement and abandoned her on the hearing date of Nov. 23, 2015.

The defendants filed a motion to dismiss the complaint on Dec. 28 through attorneys Richard Korn and Margaret Gentzen of Fox Galvin LLC in St. Louis.

They argued that they withdrew from their representation on Nov. 23, 2015, but Fults continued to enter into her 2015 Marriage Property Settlement Agreement with her ex-husband against the previous advice of the defendants.

Kolker denied the defendants’ motion to dismiss on April 18.

“While a Motion for Summary judgment may show the case cannot succeed, there are alleged facts regarding discovery that may present a legal cause of action. Nothing in this Order should preclude Defendants from later presenting any of the arguments in the instant motion to dismiss,” he wrote.

Fults filed an amended complaint on Feb. 21 through attorney David M. Duree of O’Fallon.

On April 27, the defendants answered the amended complaint, arguing that Fults consented to the defendants’ withdrawal prior to her voluntary marital settlement. As a result, they claim they owe her no duty.

“Plaintiff’s claim fails as a matter of law because defendants were ethically required to withdraw from representation of plaintiff under the Illinois Rules of Professional Conduct, including but not limited to Rule 3.3,” the affirmative defenses state. “In particular, Defendants obtained further information that plaintiff and her former husband, Kenneth Fults, Jr., were in (sic) engaging in settlement discussions ‘under the table’ and without the input of Defendants.”

They add that the plaintiff agreed to settlement terms that were different than what was represented to the court at the Nov. 23, 2015, hearing.

They also argue that the plaintiff’s request for attorney’s fees is barred by the voluntary payment doctrine.

“Plaintiff received, reviewed and paid Defendants’ monthly itemized bills for professional legal services, including but not limited to the Defendants’ ‘final bill,’ receiving, reviewing and paying the same in full prior to the Defendants’ withdrawal as her counsel and Plaintiff’s voluntarily going forward with the prove-up of the Marital Settlement Agreement,” the affirmative defenses state.

Fults answered the defendants’ affirmative defenses on May 4, denying each and every allegation.

She also argues that each of the defenses fail to state a recognizable affirmative defense.

The case has been set for trial for Jan. 22, 2018.

St. Clair County and former treasurer Charles Suarez filed a response to several residents’ motion to strike their reply supporting summary judgment, claiming that their reply sufficiently argues “exceptional circumstances” to file the reply in a suit alleging they participated in a bid rigging scheme.

The defendants filed their reply to plaintiff attorney Nelson Mitton’s response to their combined motion for summary judgment on May 26.

The plaintiffs filed a motion to strike the reply on June 1 through attorney Aaron Weishaar of Reinert Weishaar & Associates in St. Louis.

He argues that Rule 7.1 holds that “reply briefs are not favored and should be filed only in exceptional circumstances.”

“Motions for summary judgment are not exempt from this rule, which emphasizes this Court’s objective to eschew reply briefs,” Weishaar wrote.

On June 16, St. Clair County and Suarez filed a response to the plaintiffs’ motion to strike through attorney Garrett Hoerner of Becker, Hoerner Thompson & Ysursa PC in Belleville.

They argue that their reply to the plaintiffs’ response to their combined motion for summary judgment “expressly states the ‘exceptional circumstances’ compelling such brief reply, specifically certain misrepresentations of law and improper reliance on purported fact therein, beyond mere argument.”

However, the defendants also requested leave to file a reply to the plaintiffs’ response to the combined motion for summary judgment and memorandum “to the extent deemed necessary.”

St. Clair County and Suarez’s reply was filed after several tax buyer defendants sought leave to file their own reply in support of their motion for summary judgment. U.S. District Judge Staci Yandle denied their motion on May 30.

The parties also filed a joint motion to extend the trial date and all related deadlines on June 13.

They argue that the court has not yet ruled on the plaintiffs’ pending motion for class certification or the defendants’ motions for summary judgment, which “will have a significant impact on the scope of the trial as well as the evidence and witnesses that will be necessary for trial.”

They claim “time is now too short to take all necessary steps before the scheduled August 7, 2017 trial date” and seek to extend the deadlines.

According to the complaint, two couples sued Suarez and several tax buyers in the U.S. District Court for the Southern District of Illinois on Oct. 17, 2014, alleging a conspiracy similar to one that sent former Madison County treasurer Fred Bathon to prison.

John Bloyer Jr., Adrianne Bloyer, Kevin Dvorak and Kathleen Dvorak, all of O’Fallon, claim the alleged conspirators artificially inflated interest rates at tax sales in 2007 and 2008. They claim Suarez illegally rigged bids at sales of delinquent taxes to enrich Democratic campaign contributors.
