Driver, passenger say March 2015 rear-end crash in Belleville caused injuries

BELLEVILLE — A driver and passenger are suing another motorist, citing negligence that resulted in a March 2015 crash and injuries.

Gaetano Patti and Fara Patti filed a complaint on April 7 in the St. Clair County Circuit Court against Windy Yanker alleging that the defendant failed in her duty of ordinary care in the operation of her vehicle.

According to the complaint, the plaintiffs allege that on March 21, 2015, Gaetano Patti was operating his vehicle with plaintiff Fara Patti as passenger when their vehicle collided with the defendant's vehicle. As a result, plaintiffs suffered physical injuries, loss of earnings and medical expenses. 

The plaintiffs hold Yanker responsible because she allegedly failed to keep a proper lookout, failed to properly apply brakes and failed to reduce speed to avoid the accident.

The plaintiffs request a trial by jury and seek judgment in a sum in excess of $50,000, plus the costs of this action and whatever other remedy the court deems appropriate. They are represented by Gregory M. Tobin of Pratt and Tobin PC in East Alton.

Suit claims woman was negligent, followed too closely before 2015 Collinsville Road crash

BELLEVILLE — A driver is suing another motorist, claiming she was negligent in causing a rear-end crash in Collinsville that caused injuries two years ago.

Markes Pruitt filed a complaint on March 16 in the St. Clair County Circuit Court against Cindy Leezy alleging that the defendant failed in her duty to exercise ordinary care for the safety of other motorists.

According to the complaint, the plaintiff alleges that on April 16, 2015, while driving eastbound on Collinsville Road near Complex Drive, he collided with the defendant's vehicle, striking the rear of his automobile. As a result, Pruitt claims he suffered physical injuries, loss of normal life and medical bills. 

The plaintiff holds Leezy responsible because she allegedly failed to keep proper lookout for other vehicles, failed to reduce speed to avoid collision, failed to be attentive and failed to keep a safe distance from the plaintiff's vehicle.

The plaintiff requests a trial by jury and seeks judgment for actual damages in excess of $50,000 together with all costs incurred and other relief to which the court deems proper. He is represented by Kevin Boyne of Kevin Boyne PC in Belleville.

Deck hand alleges sexual harassment at work

BELLEVILLE — A deck hand is suing a marine service company and his manager for alleged discrimination and harassment on the job. 

Nathaniel Graf filed a complaint on March 29 in the St. Clair County Circuit Court against Inland Marine Service Inc., Inland Marine Harbor Service Inc. and manager Terrence D. Williams, alleging they violated Title VII of the Civil Rights Act and the Illinois Human Rights Act.

According to the complaint, the plaintiff alleges the defendants discriminated against him by creating a hostile work environment and allowing sexual harassment. 

As a result, Graf alleges he suffered and will continue to suffer injuries and monetary damages. 

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, costs of this suit and such other relief as this court deems necessary and proper.

Father of murdered son sues strip club for allegedly allowing patron to bring in firearm

BELLEVILLE — A father is suing Pink Slip Exotic Bar for allegedly allowing a patron to bring a firearm inside, claiming his son was shot and killed. 

Marcus Stewart, as special representative for Marques Stewart filed a complaint on April 3 in the St. Clair County Circuit Court against Phillips-Garrett Inc., doing business as Pink Slip Exotic Bar, alleging an employee negligently granted permission to the shooter to bring his fire arm inside the bar.

According to the complaint, the plaintiff alleges that on April 8, 2015, Marques Stewart was a patron at Pink Slip Exotic Bar when he was shot and killed.

The plaintiff alleges Pink Slip failed to provide adequate security inside its premises and failed to protect the decedent from the known danger of the shooter's intention to cause harm.

The plaintiff requests a trial by jury and seeks damages in excess of $50,000, plus costs expended for this action and such other relief as this court deems just and fair.

BLS report shows weak economy in Illinois, recovery in neighboring states

Illinois lost 8,900 jobs in March and still has fewer jobs than in the year 2000, while businesses are creating more opportunities in neighboring states. A new economic release from the Bureau of Labor Statistics shows that surrounding states continue to outpace Illinois on the road to economic recovery and prosperity.

Illinois’ economic weakness is a long-term problem that exacerbates the state’s near-term financial crisis. The Land of Lincoln is increasingly falling behind, as neighboring states have less debt, lower taxes, smarter regulations and pro-growth approaches that allow their economies to prosper and residents to find rewarding jobs.

Employers created 14,000 jobs in Illinois in the first quarter of 2017. This jobs count compares well with those in neighboring states, but it doesn’t compare well when adjusted for the size of each state’s economy. For example, Illinois’ labor force is twice the size of Indiana’s, and therefore requires twice as many jobs just to keep up in terms of relative employment opportunities. That means it’s more important to measure Illinois’ performance in terms of percentages, as opposed to the total number of jobs created.

To measure the percentage growth, Illinois’ gain of 14,000 jobs should be considered in proportion to Illinois’ total workforce size. For example, Illinois’ increase of 14,000 jobs represents a 0.23 percent gain, while Indiana’s 10,700 jobs gain is a 0.34 percent increase for the Hoosier State. Relative to the size of its economy, Indiana’s jobs creation was better than Illinois’ in the first quarter of 2017, and has been for a long time.

Illinois has gained more jobs than most nearby states so far in 2017. But Illinois is the third-worst among states in the region in terms of percentage growth for the first quarter of 2017, outperforming only Michigan and Missouri.

Manufacturing woes continue: Illinois down 800 manufacturing jobs in first 3 months of 2017

Manufacturing has been a persistent sore spot in Illinois’ labor market, with the state losing 5,000 manufacturing jobs in 2015 and 7,700 manufacturing jobs in 2016. Illinois is down 800 manufacturing jobs in the first three months of 2017, with Michigan as the only nearby state to have losses so far in 2017.

It’s important to point out, however, that while Illinois lost manufacturing jobs over the last two years, Michigan gained 17,200.

Illinois’ economic weakness creates an opportunity deficit for Illinoisans. For example, while manufacturing jobs have recovered elsewhere in the region, Illinois has lagged behind due in part to the anti-growth, anti-jobs taxes and regulations Illinois heaps on manufacturers. Illinois has experienced only 2.8 percent growth in manufacturing jobs since the bottom of the Great Recession. Nearby states have left Illinois behind and have seen tens of thousands more manufacturing jobs created than Illinois has.

Customer alleges injuries from uneven pavement at Mt. Vernon Circle K

BELLEVILLE — A customer claims she was injured while walking into the Mt. Vernon Circle K convenience store.

Reva Jeannine Bonine filed a complaint last month in the St. Clair County Circuit Court against Circle K and Erica D. Hubbard, alleging they failed to exercise reasonable care in maintaining the convenience store property.

According to the complaint, the plaintiff alleges that on March 8, 2015, while walking into the store of the defendant on S. 44th St. in Mt. Vernon, she was injured due to uneven pavement in front of the store. 

Bonine claims the uneven/graduated pavement was poorly lit and had the same color as the rest of the pavement blended together, which was not visible to patrons. As a result, Bonine suffered physical injuries, disability and medical bills. 

The plaintiff alleges the defendants failed to warn her of the hazardous condition of the pavement, failed to provide adequate lighting around the pavement area and failed to exercise reasonable care in the maintenance of their premises.

The plaintiff requests a trial by jury and seeks judgment in an amount greater than $50,000, plus costs and other further relief to which the court deems proper.

Woman alleges collision caused her to deliver baby early

BELLEVILLE — A woman is suing a motorist who allegedly drove drunk and caused a Swansea collision when the plaintiff was eight months pregnant, causing her to deliver her baby four weeks early. 

Karin Santos filed a complaint last month in the St. Clair County Circuit Court against Angela Gavin, alleging she failed to drive in a safe and normal state so as to not cause harm to other motorists.

According to the complaint, the plaintiff claims that on Feb. 21, Gavin was allegedly intoxicated above the legal alcohol limit and collided with Santos' vehicle, who was eight months pregnant. 

As a result, Santos claims she was severely injured, including a torn placenta, and began having contractions, causing her child to be delivered four weeks early. 

The plaintiff alleges Gavin failed to keep control over the vehicle she was operating and was under the influence of alcohol.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs of suit and such other relief as is allowed by law. 

The suit also states that Santos will seek to amend her complaint to add punitive damages up to 10 times actual damages.

Driver was negligent in December 2016 crash on I-64 in Washington County, suit claims

BELLEVILLE — A passenger is suing over a crash last December on Interstate 64 in Washington County.

Joshua Hess filed a complaint last month in the St. Clair County Circuit Court against Cameron Dietz alleging that the defendant failed in his duty to exercise ordinary care while operating his vehicle.

According to the complaint, the plaintiff alleges that on Dec. 23, 2016, plaintiff claims he was a passenger in a motor vehicle traveling eastbound on I-64 when the defendant's vehicle struck the front side of the vehicle he was riding in. As a result, Hess claims he suffered physical injuries, loss of earning capacity and medical expenses. 

The plaintiff holds Dietz responsible because the defendant allegedly failed to keep proper lookout for other vehicles, failed to apply brakes and failed to yield the right of way to oncoming traffic.

Mother alleges son lost testicle from delayed surgery

BELLEVILLE — A mother claims her son lost his testicle after several health care professionals failed to timely diagnose his condition and provide appropriate treatment.

Brandi Humpries, as mother and next friend of the minor child Zaquan Pinkmey, filed a complaint on March 9 in the St. Clair County Circuit Court against Andrew Harger MD, Protestant Memorial Medical Center Inc., Nicolete Weeks PA, Cep America-Illinois PC and Cep America Inc., alleging they failed to provide or recommend appropriate treatment for the child.

According to the complaint, Humpries alleges the defendants failed to timely diagnose Pinkmey's twisting spermatic chord and testicular torsion, which delayed his surgery and caused him to lose his testicle. 

As a result, he has suffered disfigurement and disability, pain and loss of enjoyment of life. Humpries claims she incurred medical expenses for the care of her child. 

The plaintiff requests a trial by jury and seeks damages in excess of $75,000, plus costs of this action.

Resident alleges St. Paul's Home failed to change dressing on wound

BELLEVILLE — A resident is suing a Belleville nursing home for allegedly failing to properly treat her heel would or change the dressing. 

Ellen Paule filed a complaint on March 10 in the St. Clair County Circuit Court against St. Paul's Home, alleging the defendant violated the Nursing Home Care Act.

According to the complaint, the plaintiff alleges that on April 15, 2015, Paule was admitted to the defendant's nursing home with a diagnosis of mildly necrotic right heel ulceration. However, she claims that throughout her stay, her heel wound dressing was never changed and that live larvae were found in the wound. 

As a result, Paule claims she suffered deterioration of her prior physical and mental condition, prevention from attending to her usual duties and affairs of life and lost value of time. 

The plaintiff alleges St. Paul's Home failed to care for her in a manner and environment that promoted maintenance or enhancement of her quality of life, failed to employ sufficient staff to provide adequate services to meet the total needs of its residents and failed to provide necessary care and services to attain or maintain the well-being of residents.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, with attorney's fees, costs and other relief the court deems just.

Customer says Kennedi Auto Sales sold him defective vehicle

BELLEVILLE — A customer is suing a Cahokia used car dealer for allegedly selling him a defective vehicle.

Reginald E. Welch filed a complaint on March 29 in the St. Clair County Circuit Court against Ken's American Motors Inc., doing business as Kennedi Auto Sales, alleging the dealer violated the Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiff alleges that, on Feb. 25, 2017, he purchased a 2001 Ford Escape from Kennedi Auto Sales in Cahokia. He purchased the vehicle by paying $1,200 in a down payment and $253 for insurance. Immediately after purchase, Welch claims, the vehicle was defective. 

The plaintiff alleges Kennedi Auto Sales fraudulently represented that the vehicle was in good running condition and fraudulently concealed that the catalytic converters required replacement.

The plaintiff requests a trial by jury and seeks the sum of $1,453 for compensatory damages, plus $50,000 for punitive damages, plus costs of this suit.

Camp Drug Store accuses medical supply company of sending unwanted faxes

EAST ST. LOUIS — A Madison County drug store has filed a class-action lawsuit against a Florida-based medical supply company, citing alleged invasion of privacy by sending numerous advertisements through fax.

Camp Drug Store Inc., individually and as the representative of a class of similarly situated persons, filed a complaint on April 14 in the U.S. District Court for the Southern District of Illinois against Emily Corporation, doing business as DDP Medical Supply, alleging the defendant violated the Telephone Consumer Protection act.

According to the complaint, Camp Drug Store alleges that on March 7, it received numerous facsimile messages about goods, products or services available for purchase from the defendant's medical supply company. 

Camp Drug Store claims it never subscribed nor gave consent to receive any fax messages from the defendant that resulted in undue wear and tear of the fax machines, loss of paper and ink toner and loss of valuable time. 

The plaintiffs allege the defendant failed to ask permission in writing or otherwise before sending advertisements.

The plaintiffs request a trial by jury and seek judgment for damages, attorneys' fees, costs of suit and such further relief as the court may deem just and proper.

Madison County jury awards passenger $17,500 in auto accident suit; Reaches opposite verdict from arbitrators’ assessment

After arbitrators assessed total fault to one driver in an Alton collision and no fault to the second driver, a Madison County jury reached a completely opposite verdict on Tuesday. 

The jury found defendant Theresa Harrison 100 percent at fault in her passenger’s auto accident suit after deliberating an hour and a half. They found that defendant Suzanne Crancer was not at fault in the collision. 

They awarded plaintiff Gloria Teague $17,500. 

The two-day trial was held in Circuit Judge David Dugan’s courtroom after Crancer previously rejected an arbitrator’s award in favor of Teague and against Crancer for$22,500. The arbitrators found in favor of Harrison in both Teague’s complaint and Crancer’s counterclaim for contribution. 

Teague, of Alton, was represented by Timothy Chartrand of Williamson Webster Falb & Glisson in Alton.

Crancer, of Godfrey, was represented by Marcus Raymond of Maryland Heights, Mo.

Harrison, of Alton, was represented by Roger Wilson of St. Louis.

Teague filed her complaint on Aug. 31, 2015, against Crancer and Harrison. She argued that Harrison was driving a 2006 Buick Lucerne CX southbound on Henry Street in Alton while Teague was riding along as a passenger. At the same time, Crancer was driving a 2014 Ford Escape on US-67 and approaching the intersection with Henry Street.

Crancer allegedly drove her vehicle into the intersection, running a red light, while Harrison was also crossing the intersection. The two vehicles collided.

Teague alleged the defendants failed to obey a traffic signal, failed to reduce speed to avoid an accident, failed to warn each other of the imminent accident, failed to keep a proper lookout, failed to decrease speed and failed to yield the right of way.

As a result, Teague alleged she suffered injuries to her arm, shoulder, hip, knee and strain to her C-spine.

Crancer answered the complaint on Sept. 16, 2015, denying liability.

In her affirmative defenses, Crancer argued that Harrison’s negligence caused or contributed to the plaintiff’s injuries. She alleges Harrison failed to obey a traffic control device or signal, failed to reduce speed in order to avoid an accident, failedto warn the plaintiff of an imminent accident, failed to keep a proper lookout, failed to decrease speed when approaching the intersection and failed to yield the right of way to Crancer.

Harrison answered the complaint on Dec. 7, 2015, denying liability in the accident.

In her affirmative defenses, Harrison argued that the accident was a direct and proximate result of Crancer’s negligence.

Harrison filed a counterclaim against Crancer on Dec. 17, 2015.

She argued that Crancer failed to keep a proper lookout, failed to keep her vehicle under proper control, failed to obey a lawful traffic signal, failed to yield the right of way and failed to avoid a collision.

If found liable, Harrison sought contribution from Crancer.

Teague filed a motion to transfer the case to the arbitration docket on May 3 through attorney Michael Glisson. In his affidavit, Glisson stated that at that time, the total damages sought did not exceed $50,000.

Circuit Judge Andreas Matoesian granted the motion to transfer on May 13.

On Aug. 25, the arbitrators assessed 100 percent fault to Crancer in the incident.

On Sept. 20, Crancer rejected the arbitration award and requested a jury trial.

On Nov. 18, the case was transferred to the law docket for trial.

Belleville woman says AAA Contracting caused damage while remodeling home

BELLEVILLE — A homeowner is suing a remodeling company for allegedly causing damage during a basement remodel project.

Veronica Rencher filed a complaint on March 30 in the St. Clair County Circuit Court against Joseph E. Netemeyer, doing business as AAA Contracting Services, alleging the defendant violated the Home Repair and Remodeling Act.

According to the complaint, the plaintiff alleges that on April 4, 2015, Netemeyer agreed to remodel the basement of plaintiff's property in Belleville. Instead, plaintiff's property was damaged and she claims she incurred additional expenses for repairs. 

The plaintiff alleges Netemeyer failed to complete her basement remodeling in a workmanlike manner as promised.

The plaintiff requests a trial by jury and seeks compensatory damages in excess of $50,000 plus costs of this suit.

New Report Confirms Need for Lawsuit Reforms in Illinois

It should not come as any surprise but personal injury lawyers have found a new way to game the system in Illinois. 

According to a new report from the Illinois Civil Justice League - Illinois Asbestos Trust Transparency – personal injury lawyers are manipulating the timing of asbestos personal injury lawsuits to allow them to essentially double dip for the same injury. 

Here is how it works. Plaintiffs’ attorneys file a claim in court against small businesses and other defendants. Then after the case is resolved they file claims against various asbestos trust funds which then allows them to get paid twice for the same claim. There is nothing wrong with filing claims against businesses currently doing business and also filing claims against the different trust funds set up by now bankrupt companies to pay asbestos claims. Plaintiffs have a right to collect from the companies that contributed to their asbestos exposure. 

The problem is that by waiting until after a court claim to file claims against asbestos trust funds, the trial court can only base a judgment or settlement on the exposure the defendants in the courtroom contributed to the asbestos exposure. Without any information on what role now bankrupt companies contributed to the exposure – the trial court has little choice but to hold the defendants in the court room 100 percent responsible for the damages. 

This situation results in higher judgments and settlements. The lack of transparency in Illinois courts is costing businesses dearly and we all pay and we all lose as a result. According to the study, in 100 asbestos cases in Illinois examined,  there was a failure to expose “double dipping” in 92 percent of the cases. 

This study confirms what we already know here in Illinois. The Land of Lincoln has become the land of lawsuits. The lack of transparency in asbestos cases is costing small businesses dearly. 

This is especially troubling given the fact that Missouri legislators are pushing through numerous lawsuit reforms to make their state more attractive to prospective employers. 

The ‘Show Me State’ is showing Illinois how to make an abused lawsuit system fairer and more attractive to employers. If Illinois doesn’t follow Missouri’s lead, we can expect to see Illinois businesses leaving the ‘Sue Me State’ and crossing the Mississippi River for a state where they won’t have a lawsuit target on their backs. 

Companies look to locate or expand where the litigation climate is fair. Surrounding states are leading the way when it comes to lawsuit reforms while here in Illinois there is little being done to enact the kind of reforms we so desperately need.

No one is saying that asbestos victims should not receive the compensation they are due. Absolutely, they should be made whole, but the process must be fair. It must be balanced. And it must be transparent. This is a reform everyone we all can and should get behind and support.
