The sun is shining, and it's a dark day for asbestos plaintiff lawyers

Asbestos attorneys are feeling the earth move under their feet, they're feeling the sky tumbling down, a-tumbling down, and they can't get that Carole King tune out of their heads.

Next in the never-ending, ever-unsettling subconscious queue: the Fifth Dimension and the Beatles.

This is the dawning of the age of transparency, and it's becoming obvious that the sun is going to shine in whether devotees of darkness – and the deeds done in it – want it to or not.

Here comes the sun, from every direction. There's no shade anywhere, nowhere to hide.

Year after year, legislation has been introduced in the U.S. House of Representatives to promote fairness and honesty in asbestos litigation and to increase transparency in asbestos trusts, but it's never gone anywhere. This year is different. This year, with a Republican president in the White House, the bill has a chance of becoming law.

But wait, there's more.

Utah’s Attorney General is suing four of the largest asbestos bankruptcy trusts to make them comply with civil investigative demands from 13 states that think they aren't being reimbursed for Medicare and Medicaid expenses as required by federal law.

Plus, last September, Aetna, Humana, and Unitedhealthcare Services filed a $19 million suit in Texas federal court against six asbestos law firms for failing to use settlement funds to reimburse the insurers for medical coverage their clients received.

And, just last month, General Motors sued asbestos trusts in Delaware, New York, and Pennsylvania bankruptcy courts seeking recovery of trust money paid to the estate of an employee who also received workers’ compensation payments from the automaker to settle asbestos exposure claims.

“If these cases get the attention of the Department of Justice, then it’s a whole new ball game,” says Mark Behrens of Shook, Hardy & Bacon's Public Policy Group in Washington, DC.

It's a  new ball game, and the forecast is for a nice sunny day.


Appellate court dismisses postconviction petition challenging drug conviction but offers defendant credit toward fine

The Fifth District Appellate Court has upheld a lower court’s decision to dismiss a post-conviction petition appealing a drug conviction but decided that the defendant was entitled to $5 per day for each day he was held before sentencing.

The court's decision dealt with the case of Gilbert Evans, who had been convicted of unlawful delivery of drugs. Evans was sentenced to five years in jail and a fine of $1,040. 

Evans appealed the decision, claiming St. Clair County Circuit Court judge John Baricevic had erred by allowing a police officer to offer inadmissible hearsay in his testimony. Evans further claimed that testimony that he referred to an undercover officer and an informant as "those white mother***" was racially charged and prejudicial and, therefore should have been excluded and that he should get $5 credit towards his fine for every day he spent in jail before his sentencing.

The case came after Evans was caught selling crack cocaine when he attempted to sell to Master Sergeant Joe Beliveau, director of the Metropolitan Enforcement Group of Southern Illinois (MEGSI). 

Beliveau testified that during undercover operations where he was attempting to purchase drugs, there was a white Cadillac at the scene. 

Beliveau identified the driver's shoe as a "unique 'old school' blue Adidas sneaker," while noting he also had on gray sweat pants. He was later identified as Evans.

The defendant objected to sections of Beliveau’s testimony to the court, alleging it was hearsay regarding what was said and done at the scene. 

However, the appellate court panel comprised of Justices Melissa Chapman, Judy Cates and John Barberis, sided with Baricevic.

“We find that two of the statements were properly admitted under the hearsay exception for the statements of co-conspirators, and admission of the third statement was harmless error,” wrote Chapman for the panel.

The court acknowledged that some statements that Beliveau made that claim a person named “Gil” was expected at the scene to sell drugs were admitted in error. 

However, the panel found the testimony harmless. 

“We recognize that the use of the defendant's name provided the jury with strong evidence that the defendant was in fact the driver of the white Cadillac," wrote Chapman. "However, because we will conclude that the remaining statement was properly admitted under the co-conspirator exception, the use of his name was merely cumulative, and neither statement contained any additional information that could harm the defendant.”

The panel also acknowledged the state's concession that defendants in Evans’ position are entitled to $5 a day against fines, as stated in statutes. It held that Evans was due a credit of $765.

Driver allegedly rear-ended motorist due to excessive speed, suit says

BELLEVILLE — A driver is suing Tamara Harris claiming she was negligent for a 2015 crash in Cahokia.

Thomas Crouch filed a complaint on March 26 in the St. Clair County Circuit Court against Harris alleging that the motorist negligently operated her vehicle at an excessive rate of speed.

According to the complaint, the plaintiff alleges that on May 15, 2015, he was driving a motor vehicle traveling southbound on Range Lane in Cahokia when defendant negligently struck the rear of his vehicle. The plaintiff sustained injuries all over his body that made him suffer disability, pain and suffering and incur medical expenses. The plaintiff holds Harris responsible because she allegedly failed to keep proper lookout for other vehicles, failed to properly apply brakes and followed plaintiff's vehicle more closely than reasonable.

The plaintiff requests a trial by jury and seeks just award in excess of $50,000, plus costs of this suit. He is represented by Thomas C. Rich, Kristina D. Cooksey and Michelle M. Rich of Rich, Rich & Cooksey PC in Fairview Heights.

Man claims Save-A-Lot failed to clean up water in aisle, resulting in fall

BELLEVILLE — A grocery store patron is suing Save-A-Lot Food Stores Ltd., citing alleged insufficient measures were taken to prevent injuries in a slip and fall.

Eddie Hobson filed a complaint on March 24 in the St. Clair County Circuit Court against Save-A-Lot Food Store Ltd. alleging that the store operator breached its duty to maintain a safe premises.

According to the complaint, the plaintiff alleges that on Sept. 20, 2015, he was walking down an aisle inside defendant's Save-A-Lot Food Store #412 when he slipped on standing water at the front of the store's freezers. 

He claims he sustained injuries because of the fall that resulted in pain, wage loss and medical treatment expenses. 

The plaintiff alleges the defendant failed to remove or wipe up the water on the floor and failed to warn plaintiff of the dangerous condition.

The plaintiff requests a trial by jury and seeks damages in an amount in excess of $50,000 and for any further relief that is just and proper.

NFL defeated St. Louis promoters’ lawsuit 20 years ago; New suit echoes the old one

Titans of 20th Century government lured the Rams football franchise to St. Louis on desperate terms, and a suit filed in the ‘90s to cover the resulting losses failed.

Echoes of that episode ring through a suit that St. Louis city and county filed against the Rams and the National Football League in the city’s civil court last week. What may come of the new litigation remains to be seen, but the NFL came out the winner in a promoter’s lawsuit decided 20 years ago in federal court in St. Louis.

In 1997, U.S. District Judge Jean Hamilton granted judgment to the NFL, finding it had not caused St. Louis promoters to negotiate under duress.

She stopped a trial that featured former U.S. Sen. Thomas Eagleton, U.S. Rep. Dick Gephardt, and St. Louis County executive Buzz Westfall.

Eagleton led a group that organized to attract a team after the league rejected the city’s bid for an expansion franchise in 1993.

State and local government had committed $258 million for a stadium, but the league awarded franchises to Charlotte and Jacksonville instead.

Gephardt contacted Eagleton’s group after reading a newspaper report that the Rams might move from Anaheim to Baltimore.

He urged the group to contact then Rams owner John Shaw, and that contact resulted in an agreement for exclusive negotiation.

Talks stalled at first, because the St. Louis Convention and Visitors Commission did not control the rights to the stadium lease.

Two thirds of the rights belonged to Jim Orthwein and one third to Jerry Clinton, persons with no relation to the commission.

That arrangement had caused the failure of the city’s expansion bid.

The commission at last acquired control of the lease, and promoters quickly reached an agreement with Shaw.

The Rams would pay $25,000 rent per game and half of game day expenses. The team would get all ticket revenue, all profit from game day concessions, and a portion of profits from other events in the stadium.

Further, the Rams would get 75 percent of the first $6 million in advertising, and 90 percent of the remainder.

The commission would assume $28 million in obligations from bonds on the stadium in Anaheim, and it would build a $10 million training facility. The commission also would cover the cost of moving.

In 1995, Shaw applied to the league for permission to relocate.

He needed approval from three fourths of the owners, 24 of 32, and he didn’t get it on the first vote.

The commission then offered $7.5 million toward a voluntary relocation fee that Shaw could offer for the second vote.

The league had levied a fee of that amount on the former St. Louis Cardinals in 1988, when they moved to Phoenix.

Shaw offered the league almost four times that amount, $29 million, plus $12 million to indemnify extra television expenses.

He agreed to forego shares of any fees from the league’s next two relocations. He also agreed to share $17 million in seat licenses with the league.

Owners approved relocation on April 12, 1995.

In June, the commission paid $20 million of the relocation fee.      

In September, the Rams began playing in the Trans World Airline dome.

Almost immediately, the commission found it couldn’t keep up with obligations.

It sued the league and team owners, alleging conspiracy and monopoly under the Sherman Act as well as tortious interference.

The commission estimated its losses between $77 and $122 million.

At trial, the commission argued that the league’s relocation policy created an atmosphere against relocation.

The commission argued that the policy created a “one buyer market.”

Eagleton testified that the policy harmed cities and fans.

Marquette Sports Law Journal authors would later write that he testified in direct contradiction of the justification for the Professional Sports Community Protection Act, which he sponsored as Senate Bill 259 in 1985.

“Much of the language in Senate Bill 259 is virtually identical to the language in the NFL’s relocation guidelines which the St. Louis Convention and Visitors Commission was challenging,” the authors wrote.

After the commission closed its case, Hamilton dismissed the claims of monopoly and interference.

For the league, commissioner Pete Rozelle described a relocation fee as reflecting among other things the increased value of the team after moving.

After the league closed its case, Hamilton dismissed the conspiracy claim and directed a verdict in favor of the league.

Appellate judges of the Eighth Circuit in St. Louis affirmed her in 1998.

They found no evidence that the relocation policy caused other teams to refrain from competitive bidding.

The appeals court panel found that the commission made no effort to solicit other bids and consciously decided to negotiate with one team at a time. The judges held that the commission didn’t challenge the vote of the owners or the application of the rule.

Nor was St. Louis unable to obtain a team, they held.

Shaw couldn’t identify any other interested team, the judges found, and he wasn’t a disinterested witness.

St. Louis city and county sued the team and the NFL in St. Louis Circuit Court on April 12.  

In addition to damages to be determined at trial, the city, the county, and their regional sports authority want the league to turn over a $550 million relocation fee that the Rams paid.

The city, the county and the authority claim the Rams breached a contract by violating the league’s relocation policy.

They allege intentional false representations, interference with business expectations, and unjust enrichment. They further allege willful and wanton conduct, qualifying for punitive damages.

Robert Blitz and Christopher Bauman, both of Blitz, Bardgett and Deutsch in Clayton, represent the city, the county and the authority.

So do James Bennett and Edward Dowd, of Dowd Bennett in Clayton.

In their complaint they asserted that the city, the county and the authority paid expenses and interest on 30-year bonds to finance construction.

The complaint alleges that the city and the county both paid 25 percent of bond obligations including millions in maintenance.

The city and the county each incurred bond cost obligations of $180 million, according to the complaint, and collected hotel taxes to service obligations and pay obligations out of general revenue.

The lawyers wrote that plaintiffs installed a new playing surface and performed $30 million in renovations including end zone video scoreboards.

“The annual rent was such that the Rams could largely cover the annual cost of the lease with advertising they sold in the Dome,” they wrote.

Plaintiffs hired professionals and entered into contracts to plan, develop, finance and construct a new stadium complex, they claim.

They also began land assembly including option contracts on land.

“Contrary to the statements of the NFL, the relocation policy and relocation process are a sham meant to disguise the avarice and anti competitive nature of the entire proceeding,” the lawyers wrote.

“The relocation policy was adopted to avoid antitrust liability by circumscribing the members’ subjective decision-making but in reality, the policy is ignored whenever convenient to pursue a greater profit.”

They wrote that according to Forbes magazine, the value of the Rams doubled to $3 billion.

“This increase in value was at the expense of plaintiffs,” they wrote.

Rosenstengel denies former deck crew's request to declare what constitutes a thunderstorm

BENTON – District judge Nancy Rosenstengel denied a former crew member's request for a judicial notice determining what constitutes a thunderstorm in a suit alleging he was injured while working on a boat during severe weather conditions.

On April 12, Rosenstengel denied Ryan Ruddell’s motion for the court to take judicial notice that “thunder accompanies lighting, and a thunderstorm is a storm accompanied by thunder” in his case against his former employer, Marathon Petroleum Company LP. 

The court ruled that the parties may present evidence to establish the weather conditions at the time of the incident, according to court records.

Ruddell filed the suit on Nov. 11, 2015, in the U.S. District Court for the Southern District of Illinois against Marathon Petroleum, claiming he was injured when the boat he was working on sailed into inclement weather that was too severe for safe navigation due to storm and lightning conditions. 

While working during the severe weather on Aug. 27, 2014, he claims he was injured due to overexertion. Ruddell argues that the storm and lightning conditions contributed to his injuries.

Marathon Petroleum denied Ruddell’s many requests for its understanding of what constitutes a “thunderstorm,” including his requests for admissions that a thunderstorm is a storm characterized by the presence of lightning and that every thunderstorm produces lightning, according to court records.

Ruddell then turned to the court, asking it to take judicial notice of the terms. 

Judicial notice "substitutes the acceptance of a universal truth for the conventional method of introducing evidence,” according to court records. When a court takes judicial notice, a court is required to instruct the jury to accept the fact as conclusive.

To back his claim that a thunderstorm is a storm accompanied by thunder, Ruddell offered various dictionary definitions of thunder, as well as an interrogatory response by Marathon Petroleum stating that "Defendant's understanding of a thunderstorm is that it is a storm accompanied by thunder," according to court records.

Marathon Petroleum argued that taking judicial notice of these supposed facts would skew witness testimony about the weather conditions at the time of Ruddell’s alleged injury.

The court declined to take judicial notice. 

“Although his intentions are unclear, it appears to the Court that Ruddell is attempting to somehow demonstrate that MPC must be liable for his injuries if lightning was present at the time of the incident because MPC has a rule against working in lightning conditions,” the court held.

While the court agreed with Ruddell that it is generally “beyond reasonable controversy” that a thunderstorm includes thunder and that thunder follows lighting, it also agreed that judicial notice may mischaracterize testimony by Captain Michael Scott. 

Scott referred to a thunderstorm on the day of the incident, but further stated that lightning doesn’t need to be present for a thunderstorm to occur. He also testified that though there was heavy rain while the crew was working, there was no lightning until the crew was back on board the vessel, according to court records.

Railway worker alleges back injury due to poor safety precautions

BELLEVILLE — A railway worker is suing Alton & Southern Railway Company, alleging he suffered a back injury on the job.

Terry Breier Jr. filed a complaint on March 24 in the St. Clair County Circuit Court, alleging the railroad company failed to comply with the Federal Employers' Liability Act.

According to the complaint, the plaintiff alleges that on May 15, 2014, he was performing his assigned duties when he sustained severe and permanent injuries to his back.

As a result, he claims he suffered pain and mental anguish, lost earnings and medical expenses. 

The plaintiff alleges Alton & Southern failed to provide a reasonably safe place to work and to provide proper tools and equipment that reduce the risk of injury.

Breier requests a trial by jury and seeks damages in excess of $50,000, plus costs of this suit.

Motorist accuses other driver of negligence

BELLEVILLE — A motorist is suing Michaele Hines, citing alleged insufficient measures were taken to prevent injuries in causing a car crash last November.

Rollie Nevilles filed a complaint on March 17 in the St. Clair County Circuit Court alleging that the other motorist failed to maintain proper control of her vehicle.

According to the complaint, the plaintiff alleges that, on Nov. 5, 2016, he was traveling westbound on St. Clair Avenue in Belleville when defendant struck the rear of his vehicle. As a result, he sustained injuries that made him sick, lame and disordered. He has also suffered disability, pain and suffering and medical expenses. The plaintiff holds Hines responsible because the defendant allegedly failed to maintain careful lookout for other vehicles, followed plaintiff's vehicle more closely than was reasonable and failed to properly apply brakes.

Norguard alleges auto repair company failed to pay nearly $50,000 in premiums

BELLEVILLE — An insurance company is suing an automotive repair and maintenance company, citing alleged breach of contract for refusing to pay coverage premiums.

Norguard Insurance Co. filed a complaint on March 15 in the St. Clair County Circuit Court against B.J. Diversified Inc. alleging that the defendant failed in its duty to pay insurance premiums.

According to the complaint, the plaintiff alleges that the defendant requested for the plaintiff to provide workers' compensation and employers liability insurance coverage, but the insurance polices were canceled due to unpaid insurance premiums amounting to $47,756.60. The plaintiff holds B.J. Diversified responsible because it allegedly failed and continues to refuse to pay insurance coverage premiums amounting to $47,756.50.

The plaintiff requests a trial by jury and seeks payment for the insurance premiums with the total of $47,756.50, plus costs and other further relief which the court deems proper. The plaintiff is represented by Michael S. Baim of The CKB Firm in Chicago.

MRT LLC claims tenant at Fairview Heights property owes over $50K in rent, interest

BELLEVILLE — A proerty owner is suing its tenant Select Management Resources LLC, citing alleged breach of a sublease agreement for failing to pay rent.

MRT LLC filed a complaint on March 21 in the St. Clair County Circuit Court alleging that the defendant failed to fulfill its obligation under the terms of their contract.

According to the complaint, the plaintiff alleges that it entered into an agreement to sublease a Fairview Heights property to defendant. From July 1, 2016 to the present, plaintiff claims to have not received any rent from defendant. Plaintiff has incurred damages in the amount of $42,000.03 and will suffer future damages for the holdover period in the amount of $9,333.34. The plaintiff holds Select Management Resources responsible because it allegedly did not pay the rent requested by plaintiff within seven days of the notice of default and retained possession of the subject property without paying rent.

The plaintiff requests a trial by jury and seeks damages in the total amount of $51,333.37, plus costs of court and such other relief as this court deems just and proper. It is represented by P.K. Johnson of Johnson & Johnson in Belleville.

Lender sues St. Clair County man for failure to pay back student loan

BELLEVILLE — A student loan lender is suing a St. Clair County ma citing alleged breach of promissory note for an outstanding balance.

National Collegiate Student Loan Trust 2007-4 filed a complaint on March 20 in the St. Clair County Circuit Court against William A. Clay alleging that he failed to fulfill his contractual obligation to pay back his student loan.

According to the complaint, the plaintiff alleges that, in May 2007, defendant signed a note for a student loan with the plaintiff. After all offsets and credits, the balance amount of $50,359.36 plus interest of $15,724.98 remains due and owing. The plaintiff holds Clay responsible because despite demands, defendant has allegedly failed to make payments.

The plaintiff requests a trial by jury and seeks damages in the amount of $50,359.36 plus interest of $15,724.98, post-judgment interest and costs of this action. It is represented by Brad Pierce of Kramer & Frank PC in St. Louis.

Settlement reached in suit alleging woman injured when elevator suddenly stopped

East St. Louis — A settlement was reached in a nursing home employee's suit alleging she was injured in an elevator when it abruptly stopped and caused her to fall. 

The undisclosed settlement was reached on Jan. 25, but Magistrate Judge Stephen Williams dismissed the suit with prejudice and without costs on April 4 after the court took time to process the settlement. 

Oak Hill Nursing Home employee Janet Layne of Randolph County filed the lawsuit in 2015 with the United States District Court for the Southern District of Illinois in East St Louis against Otis Elevator Company. 

In her complaint, she claimed she was traveling down an Otis elevator in 2011 inside the Magnolia Terrace assisted living facility when is allegedly abruptly stopped and threw her against the side of the elevator. The incident allegedly caused her to fall to the floor and suffer "severe and permanent injuries and disfigurement" that required medical care. 

Layne accused the defendant of outright negligence and occurrence of an accident that implied negligence. She alleged Otis failed to properly maintain and repair the elevator, failed to properly train its employees to service it correctly and failed to protect those using the elevator. 

She sought a judgement in her favor of $100,000, plus costs of the suit. 

Within three months, three different judges presided over the case. Initially, Judge David Herndon and Judge Phillip Frazier were assigned and a jury trial month was set. The case was reassigned for final disposition to Frazier after Herndon was removed. Fraizer was recused 12 days later.

On separate occasions, incorrect and missing documents were filed, which prevented the case from moving forward—including the defense being asked to file a Federal Rule of Civil Procedure disclosure and the plaintiff being allowed to file an amended complaint. 

Both parties had to refile separate documents because the incorrect filing type was selected, the incorrect document was attached or none was attached at all. 

The case was administrated via telephone conference except on one occasion when the plaintiff’s attorney filed a motion to appear.

After the settlement was reached, Williams filed an order for the case to be dismissed in 60 days to give the court time to process the settlement.

Woman alleges injuries from trip, fall at East Alton apartment

EDWARDSVILLE - A Wood River woman alleges she was injured after tripped at an East Alton apartment complex. 

Dorothy Kelley filed the complaint against Sugar Creek Capital, Sugar Creek Realty LLC, Promex Midwest Corp, and Township Village Apartments, alleging they violated the Illinois Premises Liability Act. 

In her complaint, Kelley alleges she tripped and fell while visiting one of the defendants' apartment complexes in East Alton on Feb. 29, 2016. 

The plaintiff alleges that the hinges to the screen door at the apartment were broken and there was a metal piece sticking out, presenting a tripping hazard for anyone visiting the apartment, including Kelley.

She also claims that Sugar Creek Capital, individually or through its employees, should have known about the issue and the risk it posed to residents and visitors. It also indicated that the issue was something that residents and visitors likely wouldn’t notice.

According to the complaint, the company and its employees failed to inspect the premises, failed to avoid dangerous conditions, failed to warn of dangerous conditions, failed to repair, remedy or protect against dangerous conditions and failed to do so in accordance with industry norms, failed to make the repair in a reasonable length of time and maintained a dangerous condition.

As a result of the existing issue, Kelley alleges she tripped and fell, injuring her left shoulder and left knee. She also fractured her left humeral bone. 

Kelley argues that the issue was not open and obvious and she did not misuse the property in any way.

The complaint alleges that Kelley endured pain and suffering and her life was adversely impacted and as a result of the conditions at the apartment that led to the fall, and she will become liable for the resulting medical expenses.  It also alleges that she suffered loss of a normal life while she was injured and recovering.

The complaint alleges counts of negligence and breach of duty against each defendant and seeks a sum of more than $50,000 and costs for each count.

Passenger’s auto accident suit at trial in Dugan’s court; One driver found not liable by arbitrators before case was taken to trial

A jury trial for a passenger’s auto accident suit began Monday in Madison County Circuit Judge David Dugan’s courtroom.

Plaintiff Gloria Teague, of Alton, is represented by Timothy Chartrand of Williamson Webster Falb & Glisson in Alton.

Defendant Suzanne Crancer, of Godfrey, is represented by Marcus Raymond of Maryland Heights, Mo.

Defendant Theresa Harrison, of Alton, is represented by Roger Wilson of St. Louis.

Teague filed her complaint on Aug. 31, 2015, against Crancer and Harrison. She argues that Harrison was driving a 2006 Buick Lucerne CX southbound on Henry Street in Alton while Teague was riding along as a passenger. At the same time, Crancer was driving a 2014 Ford Escape on US-67 and approaching the intersection with Henry Street.

Crancer allegedly drove her vehicle into the intersection, running a red light, while Harrison was also crossing the intersection. The two vehicles collided.

Teague alleges the defendants failed to obey a traffic signal, failed to reduce speed to avoid an accident, failed to warn each other of the imminent accident, failed to keep a proper lookout, failed to decrease speed and failed to yield the right of way.

As a result, Teague alleges she suffered injuries to her arm, shoulder, hip, knee and strain to her C-spine.

Harrison answered the complaint on Dec. 7, 2015, denying liability in the accident.

In her affirmative defenses, Harrison argues that the accident was a direct and proximate result of Crancer’s negligence.

Crancer answered the complaint on Sept. 16, 2015, denying liability.

In her affirmative defenses, Crancer argues that Harrison’s negligence caused or contributed to the plaintiff’s injuries. She alleges Harrison failed to obey a traffic control device or signal, failed to reduce speed in order to avoid an accident, failed to warn the plaintiff of an imminent accident, failed to keep a proper lookout, failed to decrease speed when approaching the intersection and failed to yield the right of way to Crancer.

Harrison filed a counterclaim against Crancer on Dec. 17, 2015.

She argues that Crancer failed to keep a proper lookout, failed to keep her vehicle under proper control, failed to obey a lawful traffic signal, failed to yield the right of way and failed to avoid a collision.

If Harrison is found liable, she argues that she is entitled to contribution from Crancer.

Teague filed a motion to transfer the case to the arbitration docket on May 3 through attorney Michael Glisson. In his affidavit, Glisson stated that at this time, the total damages sought do not exceed $50,000.

Circuit Judge Andreas Matoesian granted the motion to transfer on May 13.

On Aug. 25, the arbitrators entered an award in favor of Teague and against Crancer for $22,500. However, the arbitrators found in favor of Harrison on both Teague’s complaint and Crancer’s counterclaim for contribution. They assessed 100 percent fault to Crancer in the incident.

On Sept. 20, Crancer rejected the arbitration award and requested a jury trial.

On Nov. 18, the case was transferred to the law docket for trial.
