R.P. Lumber Co. claims contractor never made payments on materials

EDWARDSVILLE — A Madison County lumber company is suing a contracting company and its owner, citing alleged breach of contract.

R.P. Lumber Co. Inc. filed a complaint on Feb. 6 in the Madison County Circuit Court against Darryn Ficken d/b/a FM Contracting Inc. and FM Exteriors Inc. alleging that they violated the agreed contract.

According to the complaint, R.P. Lumber Co. alleges that on June 21, 2012, it agreed to the terms of a contract with Ficken and the he would pay the full amount for all purchased materials. However, the company did not receive any payments, the complaint states. R.P. Lumber Co. holds Darryn Ficken d/b/a FM Contracting and FM Exteriors responsible because the defendants allegedly failed to pay the items received from plaintiff.

R.P. Lumber Co. requests a trial by jury and demands judgment in the amount of $61,520.66, $227 in court costs, $80 for a service fee, $1,100 in attorney's fees, interest, costs to collect overdue account and for such other and further relief as this court deems just and proper. The company is represented by Katherine Smith of Law Office of Katherine Smith in Alton.

Belleville woman accuses Ford dealer of fraud

BELLEVILLE — A Belleville woman is suing Auffenberg Ford North Inc., citing alleged negligent misrepresentation.

Marlene Steinman filed a complaint on Feb. 2 in the St. Clair County Circuit Court against the O'Fallon-based car dealer alleging that it violated the sales contract agreement.

According to the complaint, Steinman alleges that on Oct. 19, 2015, she purchased a 2016 Ford C-Max Hybrid from Mike Krausz, a sales representative, and was promised that a back-up camera system would be installed in her new vehicle. She contacted Krausz and manager Aaron Paton numerous times but no camera system had been installed. As a result, she was damaged for not receiving the back-up camera system she contracted for, the complaint states. Steinman holds Auffenberg Ford North responsible because it allegedly committed fraud by not informing her that a back-up camera was not an available option on every version of the C-Max Hybrid.

Steinman requests a trial by jury and seeks judgment in an amount over of $50,000 and for attorney's fees and court costs and for any further relief the court deems just and appropriate. She is represented by Joseph N. Reames of The Law Office of Joseph N. Reames, LLC in Wood River.

Walnut Hill woman says assisted living facility violated FMLA when it ended her employment

EAST ST. LOUIS — A Walnut Hill woman is suing her former employer, an assisted living center, citing alleged retaliation and wrongful termination.

Dee Ann Heltsley filed a complaint on Feb. 7 in the U.S. District Court for the Southern District of Illinois against Provision Living Associates, LLC d/b/a GreenTree at Mt. Vernon alleging that the facility violated the Family and Medical Leave Act (FMLA).

According to the complaint, Heltsley alleges that on Aug. 13, she suffered significant injury to her foot and was ordered off work by her orthopedist for four weeks. She was unable to perform her job and was terminated on Aug. 19 because of too many absences. As a result, she suffered lost of wages and benefits. Heltsley holds Provision Living Associates, LLC d/b/a GreenTree at Mt. Vernon responsible because the defendants allegedly retaliated against her by terminating her employment for taking FMLA leave.

Heltsley requests a trial by jury and seeks judgment in her favor and against the facility for unpaid wages and benefits, interests and damages, including reinstatement of employment, as well as any other relief this court deems just and proper. She is represented by Ryan D. Rich of Wham & Wham Lawyers in Centralia.

Mother says son's injuries in Cahokia collision were due to driver's negligence

BELLEVILLE — A mother is suing a driver, citing alleged insufficient measures were taken to prevent her son's injuries.

Kiara Agnew filed a complaint on Feb. 2 in the St. Clair County Circuit Court against Winnie Davis alleging that the driver failed to exercise due care to avoid collision.

According to the complaint, the plaintiffs allege that on April 14, her son, Jace Agnew, was at a pedestrian walking at Donald Street near the intersection of Holloran in Cahokia when the defendant's vehicle struck him. As a result, he suffered physical injuries and emotional distress and required medical care and treatment. The plaintiff holds Winnie Davis responsible because the defendant allegedly failed to keep proper lookout for other people, failed to properly apply brakes and operated her vehicle at an excessive rate of speed.

The plaintiff requests a trial by jury and seeks judgment in a sum in excess of $50,000 and her cost of suit. She is represented by William A. Boker III of The Mattea Law Firm in Collinsville.

This is one fever we'd like to catch

It must be contagious. Everyone seems to be catching it.

Everyone but us, that is.

We must be immune to it for some reason, which would be fine if what everyone else is catching were a bad thing. But it's not. It's a really good thing, and catching it would be one of the best things that could happen to us.

It is reform fever: the urge to fix the public policies and governmental practices that infringe upon our liberties, advance the interests of a favored few and drive good, honest, and successful individuals and businesses away from our state.

Indiana, Kentucky, Missouri – they've all caught reform fever, and they're acting on it and benefitting from it while we refuse to face reality and persist in the self-destructive habits that have hindered progress for too long.

In his recent State of the State address, Missouri's new Republican Governor Eric Greitens called for a wide array of reforms: stronger ethical guidelines for legislators, right-to-work legislation (since enacted), tort reform, regulatory reform, tax reform, etc.

Missouri state legislators are feeling the fever, too.

“The passage and signing of right-to-work into law overshadowed almost everything else occurring in the Capitol,” the Missouri Times reported. “However, House Republicans also passed two important tort reform measures last week previously stymied in other years by Gov. Jay Nixon.”

The same rapid progress in making prosperity possible again could be happening here in Illinois if reform measures proposed by Gov. Bruce Rauner were not opposed at every turn by House Speaker Mike Madigan and Senate President John Cullerton, who put their own interests and the interests of their cronies above the interests of citizens made to sacrifice on their behalf.

Sometimes a fever's a good thing, a natural, therapeutic response to disease. Our state is sick and could use a cleansing fever.

Why can't we catch the fever? Because mad doctor Mike Madigan won't let us.

Four reasons Illinoisans can't weather another tax increase

Much of Illinois’ economy is crushed under taxes and regulations. Residents continue to suffer as taxes go up, and more and more people are fleeing the state. Things are dire in Illinois, yet the Illinois Senate, now back in session, is bent on continuing to take more from taxpayers.

Though lawmakers want to hike taxes, they have failed to address any of the state’s major spending drivers – namely government pensions, government union collective bargaining and Medicaid. Lawmakers haven’t even discussed changing the constitution to allow for the type of pension changes Democrats voted for in 2013. Politicians have also failed to tackle countless other cost drivers, including too many units of local government, a prevailing wage law that mandates high construction costs and workers’ compensation costs driving up government payroll costs.

Illinois is at serious risk of becoming a financially failed state. An additional tax hike, while acting as a short-term salve, would drive more people out of Illinois, worsening the state’s already precarious economic and financial position.

Here are four reasons why Illinois cannot weather another tax hike:

  1. Illinois’ battered economy is extraordinarily weak compared to other states.
  1. Taxes are already going up all over the state.
  1. Out-migration has hit record levels – and more taxes will push more people out of the state.
    • Illinois is losing one Peoria worth of people (114,000) each year due to out-migration, the worst the state has ever experienced.
    • Illinois’ state population has shrunk three years in a row due to so much out-migration.
    • A Paul Simon Institute poll finds that the most common reason people want to leave Illinois is due to high taxes.
    • Millenials and prime working-age adults are leaving Illinois fastest. The exodus rate from Illinois is multiples of all surrounding states.
    • Illinois loses population, on net, to every other state in the region according to both Census and IRS data.
  1. The 2011 tax hike did not fix Illinois’ financial problems, and was followed by economic weakness and significant and ongoing wealth-flight.
    • Illinois’ 2011 tax hike raised more than $30 billion in new revenues for pensions. Yet, the state’s unfunded liability grew by $47 billion.
    • Illinois’ average annual loss $2.2 billion per year for 16 years prior to the 2011 tax hike. The loss was $3.6 billion per year during the tax hike. Chicago is the only American city experiencing millionaire flight.
    • The average income of a taxpayer leaving Illinois is $77,000 compared to a $57,000 average income for taxpayers entering Illinois. This $20,000 in-out differential is the worst of any state.
    • Moody’s analysts have thus warned of an Illinois death spiral.
Another tax hike, especially one as significant as the Senate is considering, would be courting disaster. Illinoisans need to see another reason to stay, not another reason to leave.

Many parts of Illinois are already in a recession and one in five homeowners is deeply underwater on their mortgage. Local tax hikes are occurring all over the state. And tax hikes have not solved Illinois’ problems in the past, yet spending reforms remain untried.

Moody’s analysts have even pointed to the risk to Illinois’ long-term ability to balance its budgets because pension payments are ramping up while the population is shrinking. Spending reforms are critical to avoid a financial death spiral.

The Senate proposal would not fix the state’s primary spending drivers – pensions, mandatory collective bargaining and Medicaid – and thus would not bend down the cost curve of government. The Senate proposal contains $5-7 billion of tax increases with very little in terms of pro-growth measures to offset the anti-growth effects of increased taxation.

If another tax increase is passed, Illinois will almost certainly see its population continue to shrink while its financial problems will not be solved.

Madison County law firm alleges other firms breached joint venture agreement

EDWARDSVILLE — A Madison County law firm is suing several other law offices for allegedly breaching a joint venture agreement.

Torhoermann Law LLC filed a complaint on Feb. 1 in the Madison County Circuit Court against Thomas Keel & Laird LLC and Burke Wise Morrissey and Kaveny LLC, alleging they abruptly terminated their joint venture agreement.

According to the complaint, Torhoermann Law alleges the defendant firms wrongfully discharged the plaintiff as co-counsel in a case, directed the firm to cease communicating with injured parties and wrongfully withheld information relating to the terms of settlement.

Torhoemann alleges that as a result of the defendants' breach of the agreement, it was deprived of its share of profits from their joint venture and has sustained damages of over $50,000.

Torhoermann Law requests a trial by jury and seeks judgment against defendants of more than $50,000, plus costs of this suit and all other relief as the court deems just.

It is represented by David L. Antognoli of Goldenberg Heller & Antognoli PC in Edwardsville.

Mother sues driver who allegedly hit son while walking

BELLEVILLE — A mother is suing a driver for allegedly hitting her son while he was walking, causing him injuries.

Kiara Agnew filed a complaint on Feb. 2 in the St. Clair County Circuit Court against Winnie Davis, alleging the driver failed to exercise due care to avoid collision.

According to the complaint, the plaintiff alleges that on April 14, her son, Jace Agnew, was a pedestrian walking at Donald Street near the intersection of Holloran in Cahokia when the defendant's vehicle struck him.

As a result, he allegedly suffered physical injuries and emotional distress and required medical care and treatment, the suit states.

The plaintiff alleges the defendant failed to keep proper lookout for other people, failed to properly apply brakes and operated her vehicle at an excessive rate of speed.

The plaintiff requests a trial by jury and seeks judgment in a sum in excess of $50,000 and the cost of suit.

She is represented by William A. Boker III of The Mattea Law Firm in Collinsville.

Union Pacific employee alleges injuries while using de-clipping tool

BELLEVILLE — A trackman for Union Pacific alleges he sustained injuries while using a de-clipping tool.

Russell Dossett filed a complaint on Jan. 20 in the St. Clair County Circuit Court against Union Pacific Railroad Company, alleging the railroad corporation violated the Federal Employers Liability Act.

According to the complaint, the plaintiff alleges that on Dec. 5, 2014, he sustained injuries to his neck while using a de-clipping tool while working as a trackman for Union Pacific.

As a result, he claims he suffered an aggravation to a pre-existing neck condition, incurred medical bills and loss of income.

The plaintiff alleges Union Pacific failed to provide a reasonably safe place to work, failed to teach the plaintiff the proper method of using a de-clipping tool and failed to provide sufficient manpower to safely accomplish the assigned task.

The plaintiff requests a trial by jury and seeks judgment be entered in his favor in an amount in excess of $50,000 plus court costs.

Vehicle service contract seller accused of failing to pay

BELLEVILLE — Marathon Administrative is suing a vehicle service contract seller for allegedly retaining funds and failing to pay.

Marathon Administrative Co. Inc. filed a complaint on Jan. 20 in the St. Clair County Circuit Court against John Velasco, doing business as Assured Auto Protection, alleging the vehicle service contract seller failed to fulfill its contractual obligations.

According to the complaint, the plaintiff alleges Assured Auto failed to timely remit payments received from the sale of fully paid vehicle service contracts and unlawfully retained the funds.

As a result of defendant's actions, Marathon Administrative alleges it suffered damages of at least $60,594.81.

The plaintiff requests a trial by jury and seeks judgment against defendant for the amount of at least $60,594.81, plus interest, costs of this suit and all other relief as the court may deem plaintiff is justly entitled.

United Services Automobile Association accused of denying claim following fire

BELLEVILLE — Two property owners are suing United Services Automobile Association after their claim for fire damage on their rental property was denied.

Darrell Polk and LaShianda Polk filed a complaint on Jan. 19 in St. Clair County Circuit Court against United Services Automobile Association, alleging it violated the Illinois Insurance Code.

According to the complaint, the plaintiffs allege that on Dec. 6, the plaintiffs' rental property was destroyed by a fire. Pursuant to the terms of an agreement, they filed an insurance claim for the fire damage, but their claim was denied, the suit states.

The plaintiffs allege the defendant's agents allegedly conspired to deny the plaintiffs' insurance claim for damages and allegedly retaliated for their complaint with the insurance commission by canceling the plaintiffs' insurance coverage and credit cards.

The plaintiffs request a trial by jury and seek judgment against the defendant for damages in the amount of $2 million.

Worker alleges injuries after falling from makeshift scaffolding

EDWARDSVILLE — A workman is suing a property owner after he fell from a makeshift scaffolding apparatus.

Todd Bechel filed a complaint on Feb. 3 in Madison County Circuit Court against Susan M. Silk, alleging she breached her duty of reasonable care while the plaintiff was working at her property.

According to the complaint, the plaintiff alleges that on Sept. 3, 2016, he was working at the defendant's property when he fell from a makeshift scaffolding apparatus while he was attempting to pry on a board.

As a result, the plaintiff alleges he suffered extensive injuries, loss of earning and become obligated for large sums of money for medical treatment.

The plaintiff alleges Silk failed to provide a secure scaffolding and failed to properly inspect the scaffolding to avoid injury to anyone working at her property.

The plaintiff requests a trial by jury and seeks judgment against the defendant for a sum in excess of $50,000, for costs of suit and for such other and further relief as the court deems just.

Alex Wilson filed a complaint on Feb. 2 in the Madison County Circuit Court against RHP Properties Inc., doing business as Mallard Lake Mobile Home Park, and Nicole Crosby, alleging defamation that substantially damaged his business.

According to the complaint, the plaintiff alleges that on Feb. 7, 2016, Crosby said he and his employees were drug addicts at a birthday part in front of several people. More specifically, he claims she accused them of using cocaine and methamphetamine while working. 

He alleges the statements were made in an attempt to weaken the lawn company and drive down its prices after the plaintiff's company had done substantial work for the defendants.

As a result, the plaintiff claims, he suffered mental stress and his business was damaged.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000 plus costs of suit.
