Woman seeks to withdraw preservation order for property destroyed by fire

A woman alleging a landlord’s failure to provide smoke detectors caused her relative to die in a fire is asking the court to withdraw an order preserving evidence after she previously requested the preservation.

Lisa Jones, as special administrator of the estate of Debra Condor, filed her lawsuit on Aug. 26 against Sandra Hernandez, alleging violation of the Smoke Detector Act.

In her complaint, Jones alleges Condor was a tenant in a room in Hernandez’s house, located at 1620 Courtney Blvd. in Granite City. On March 21, a fire occurred at the residence, resulting in Condor’s death from injuries sustained in the fire, the suit states.

Jones alleges Hernandez failed to install a sufficient number of smoke detectors, failed to implement fire safety policy for her tenants and failed to provide written information regarding a smoke detector.

The court entered an order preserving the property, and Jones filed a motion to withdraw the courts order.

Jones originally requested the preservation, but now no longer wants the property preserved. She claims the house is in disrepair and the Madison County Inspector plans to tear it down.

Hernandez filed a motion for substitution of judge on Jan. 20. The case had been assigned to Circuit Judge Andreas Matoesian.

Jones seeks a judgment in excess of $50,000, plus court costs.

A patient voluntarily dismissed BJC Healthcare from her medical malpractice suit alleging she developed sepsis following surgery.

Plaintiffs Paula and Frederick Quinn filed the voluntary dismissal without prejudice for defendant BJC Healthcare ACO, LLC, on Jan. 17 through attorney Craig Anthony Schlapprizzi of Donald Schlapprizzi PC in St. Louis.

The Quinns also filed a first amended complaint on Jan. 17 against Alton Multispecialists LTD, Alton Memorial Hospital and Dr. James Kliefoth.

Madison County Circuit Judge Barbara Crowder had previously granted the defendants’ motions to dismiss for failing to provide separately designated and numbered counts. However, she allowed the plaintiffs to amend their complaint.

The plaintiffs allege that Paula Quinn was injured on July 8, 2013, and needed surgical repairs, described as an “excision of skin fistula in abdominal wound.”

Quinn alleges the defendants failed to take proper precautions given the “thin and friable” nature of the tissue in her abdomen. She claims Kliefoth perforated her bowel and failed to properly repair the damage, resulting in a leakage.

As a result of her perforated bowel, Quinn alleges she suffered postoperative shock, severe sepsis and necrotizing fasciitis. She had to be transported via helicopter to Barnes-Jewish Hospital for emergency surgery to save her life, the suit states.

The Quinns seek $50,000 for each of the four counts in the complaint.

Breese motorist sues delivery service following collision

EAST ST. LOUIS – A Breese motorist is suing a delivery service after one of its drivers allegedly caused a collision.

Zachary W. Luebbers filed a complaint on Jan. 17 in the U.S. District Court for the Southern District of Illinois against Fiers Delivery Service LLC, Fiers Logistics LLC and Gary M. Bell, alleging the corporate defendants negligently entrusted their vehicle to Bell.

According to the complaint, the plaintiff alleges that on Dec. 22, he was driving a 2005 GMC Sierra westbound on State Route 161 near its intersection with Tony Road when Bell allegedly drove across the center line and collided with his vehicle.

Luebbers alleges he sustained severe injuries that resulted in medical expenses, pain and suffering, disability and loss of wages.

The plaintiff alleges Bell failed to keep a proper lookout, failed to keep the vehicle he was driving under control and drove the vehicle at excessive speed.

The plaintiff requests a trial by jury and seeks judgment against defendants in excess of $75,000, costs of this suit and all other relief as the court deems just and proper.

Home sellers sue Alton buyers for allegedly failing to pay

EDWARDSVILLE — A couple who sold their Alton home are suing the buyers for allegedly failing to pay the balance owed for the April purchase of the home.

Antonio and Rose Gonzalez of Florida filed a complaint on Jan. 12 in Madison County Circuit Court against Brandon and Kelly Cope, seeking possession of the property and more than $70,000.

According to the complaint, the plaintiffs allege that on April 29, 2013, they entered into a contract for deed for the sale of their property at 624 E. Fourth Street in Alton to the defendants. The maturity of the contract was extended to April 29 of last year, when the plaintiffs were to receive the full amount due, the suit states.

As of Nov. 29, the sum of $70,687.17 remained due and owing, the plaintiffs allege.

The plaintiffs allege the defendants failed and refused to pay off the amount specified in the contract and unlawfully withheld the plaintiffs' property.

The plaintiffs request a trial by jury and seek judgment for the possession of the premises, an award for damages in the amount of $70,687.17, plus interest and costs of this suit.

Madigan's move to force budget resolution digs at Lechien for undermining legislative process

Illinois Attorney General Lisa Madigan pleads that St. Clair County Circuit Judge Robert LeChien undermined the Illinois Constitution when he ordered the comptroller to continue paying state employees at normal rates.
 
Madigan petitioned to intervene in LeChien’s court on Jan. 26, for the purpose of filing a motion to dissolve a preliminary injunction he signed in August 2015.
 
“By allowing the legislature and the executive to avoid their constitutional role in the budget process, the injunction has undermined the budget process and resulted in great public harm, damaging the integrity of the state’s constitutional form of government,” Madigan wrote in the motion.

“Because of the injunction, which is broad and covers all state employees, not only members of the plaintiff unions, the state is spending money without the constitutionally required authorization by the legislature and executive.”

She wrote that the state operated for the last fiscal year and the first half of this fiscal year without appropriations legislation authorizing payment of wages, and proposes to dissolve the order on Feb. 28, so that the legislative and executive branches would have time to enact appropriations.

“With no possibility of a government shutdown to force action by the legislative and executive braches, the state has continued to operate without a budget to fund many services provided by vendors and grantees,” she wrote.

“Those vendors and grantees and the many Illinoisans they serve are bearing the brunt of this egregious and untenable budget impasse.”
 
She wrote that she acted on behalf of the people, not of any elected official.
 
She wrote that comptroller Susana Mendoza did not join the motion but would abide by any ruling of the court.
 
The last state budget expired on June 30, 2015, and collective bargaining agreements between the state and its unions expired on the same date.
 
To preserve the normal payroll, the unions sued Gov. Bruce Rauner and former comptroller Leslie Munger in St. Clair County chancery court.
 
Rauner and Munger retained private counsel, but Madigan sent assistants to a hearing to argue that they represented Munger.
 
They argued that federal law required payment of all employees at minimum wage pending passage of a budget.
 
LeChien allowed Munger to keep her lawyer, who described temporary conversion to minimum wage as a nearly impossible task.
 
On July 10, 2015, LeChien entered a temporary restraining order requiring Munger to authorize a normal payroll.
 
He converted it to a preliminary injunction on Aug. 13.
 
Rauner and the unions agreed to preserve the terms of all bargaining agreements until negotiations succeeded or reached an impasse.
 
No further proceedings took place in LeChien’s court, until Madigan filed her petition for intervention and motion for dissolution.
 
She argued that LeChien can’t make his order permanent because the Illinois Supreme Court rejected the position of the unions in a separate case last March.

In that case, six of seven Justices found that pay raises in a collective bargaining agreement are always contingent on legislative funding.
 
They reversed First District appellate judges in Chicago, who had ruled in favor of Local 31 of the American Federation of State, County and Municipal Employees.
 
Justice Mary Jane Theis wrote, “The power to appropriate for the expenditure of public funds is vested exclusively in the General Assembly; no other branch of government holds such power.”
 
The Justices denied rehearing last May and issued a mandate in June.
 
Madigan’s motion for dissolution argues that the Supreme Court spoke directly to the issues before LeChien, and that plaintiffs cannot prevail.
 
She quoted Theis on the General Assembly’s exclusive power and wrote, “Consistent with the Supreme Court’s ruling, this court should restore that power to the proper branch of government and dissolve the preliminary injunction.”
 
Meanwhile, litigation continues in LeChien’s court and elsewhere over Rauner’s declaration that negotiations reached an impasse and the old contract expired.

Judges of the First, Fourth, and Fifth Districts have involved themselves in cases out of Cook County, the state Labor Relations Board, and St. Clair County.
 
All the cases relate to three labor board declarations of an impasse, the first one oral, the second in writing without a public vote, and the third by public vote.
 
The union has asked the Supreme Court to consolidate the First District and Fourth District cases at the First District, which ruled in its favor.
 
Rauner has asked the Justices to consolidate the First District and Fourth District cases at the Fourth District, which ruled in his favor.
 
Fourth District judges branded simultaneous review of an administrative decision as an offense against judicial efficiency.
 
“Not only was it perversely unhelpful to split this matter up between the First District and the Fourth District, but the apparent forum shopping insults both districts by implying that they are sympathetic to one party or the other and that they therefore lack judicial integrity,” they wrote.

The dispute involved the Fifth District after LeChien signed an order in the union’s favor, preserving the status quo under the old contract.

Fifth District judges ruled that the legal basis for LeChien’s order no longer existed because the labor board took formal action after he signed it.
 
They issued a mandate on Jan. 27, directing LeChien to “make a determination on the temporary restraining order under the facts as they currently exist.”
 

Materials supplier sues construction company for alleged failure to make payments

BELLEVILLE — A construction materials supplier is suing Miese Brothers Construction for allegedly failing to make payments.

Liese Lumber Co., Inc. filed a complaint on Jan. 17, in the St. Clair County Circuit Court against Miese Brothers Construction Inc. alleging the construction company failed to fulfill its contractual obligations.

According to the complaint, Liese Lumber alleges that on numerous days and numerous times it delivered goods and services to Miese Brothers, but the defendant failed to make payments on the transaction. The balance amount of $68,241.20 remains due and owing, the suit states.

The plaintiff alleges Miese Brothers failed and refused to make payments for the debt despite demands for payment.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $68,241.20, plus pre-judgment interest, costs of this suit and such other just and appropriate relief.

Former employee sues common carrier for alleged negligence

BELLEVILLE — The special administrator of a former Union Pacific employee alleges the decedent developed lung cancer from toxic exposures.

Mary Donahue, special administrator of the estate of John Donahue, deceased filed a complaint on Jan. 17, in the St. Clair County Circuit Court against Union Pacific Railroad Company alleging that the common carrier violated the Federal Employee Liability Act and the Locomotive Inspection Act.

According to the complaint, the plaintiff alleges that during the course of the decedent employment with Union Pacific from 1979 to 2012, he was exposed toxic substances that caused him to develop and suffer from lung cancer.

Prior to his death on March 13, 2016, he suffered physical and mental pain, disability and medical expenses, the suit states. Mary Donahue alleges she suffered great pecuniary loss.

The plaintiff alleges Union Pacific failed to provide a safe place to work and failed to provide adequate equipment to protect him from toxic substances.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount exceeding $50,000, plus costs of this suit.

Property owners sue insurer for alleged breach of contract

BELLEVILLE — Two property owners allege an insurer has failed to satisfactorily settle their claim.

Jonathan and Carla Hubbard filed a complaint on Jan. 10 in St. Clair County Circuit Court against United Services Automobile Association, Rehkemper Construction Co. and Huntington Chase Homes Corp., alleging they breached their duty to fulfill their contractual obligations.

According to the complaint, the plaintiffs allege that on Dec. 26, 2015, they sustained property damage due to high winds. They allege they timely filed a claim and fulfilled their contractual requirements for the loss, but to date their claim has not been settled satisfactorily.

The plaintiffs allege USAA refused and continues to refuse to tender insurance benefits, Rehkemper failed to construct trusses in a good and workmanlike manner and Huntington failed to install the trusses properly.

The plaintiffs request a trial by jury and seek judgment against each defendant in an amount in excess of $50,000, plus costs of this suit and other just and proper relief.

Widow alleges husband fell at Four Fountains nursing home

BELLEVILLE — A widow has filed a wrongful death claim against Four Fountains nursing home after her husband allegedly fell.

Helen Schulte, as wife and next of kin for Joseph Schulte, deceased, filed a complaint on Jan. 6 in the St. Clair County Circuit Court against Helia Southbelt Healthcare, doing business as Four Fountains, alleging the nursing care provider breached its duty when the decedent was allowed to fall.

According to the complaint, the plaintiff alleges her husband fell when the defendant failed to monitor him properly. As a result of Four Fountains' alleged negligence, Joseph Schulte died on Jan. 7, 2015, the suit states.

Helen Schulte alleges she suffered loss of support, society and relationship with her husband.

The plaintiff requests a trial by jury and seeks judgment against the defendant in excess of $50,000, plus costs of this suit.

BELLEVILLE — A motorist is suing another driver for allegedly causing a rear-end collision.

Thomas Kammler filed a complaint on Jan. 6 in the St. Clair County Circuit Court against Amanda Combs, alleging she failed to maintain proper control of her vehicle.

According to the complaint, the plaintiff alleges that on April 18, 2016, he was operating his 2004 Impala eastbound on West Main Street near its intersection with South 23rd Street when he was struck from behind by Combs.

As a result, he claims he sustained severe and permanent injuries resulting in great pain, mental anguish, loss of income and medical expenses.

Kammler alleges Combs failed to yield right of way, failed to maintain careful lookout and failed to reduce speed to avoid collision.

The plaintiff requests a trial by jury and seeks compensation in excess of $50,000, plus costs expended for this suit.

Motorist alleges injuries from Lenzburg collision

BELLEVILLE — A man claims he was injured when his vehicle was struck on the driver's side by a truck.

John and Kathleen Walker filed a complaint on Jan. 4 in St. Clair County Circuit Court against Jacqulin Laumbattas, Joe Nell Hummert and Lynn Hummert, alleging Lynn Hummert negligently entrusted a GMC truck owned by Joe Nell Hummert to Laumbattas.

According to the complaint, the plaintiffs allege that on April 25, 2015, John Walker was operating his vehicle in Lenzburg when it was struck on the driver's side by Laumbattas.

As a result, John Walker allegedly sustained severe and permanent injuries resulting in pain, mental anguish, disability, lost income and medical expenses.

The plaintiffs allege  Laumbattas failed to keep a careful lookout and maintain proper control of the truck.

The plaintiffs request a trial by jury and seek judgment against each defendant in excess of $75,000, plus costs of this suit.

Man alleges injuries from being handcuffed behind his back

BELLEVILLE — A St. Clair County motorist is suing the Village of Freeburg and a police officer, alleging he suffered injuries from being handcuffed behind his back following neck surgeries.

Bruce Anderson filed a complaint on Jan. 10 in St. Clair County Circuit Court against the Village of Freeburg and Christopher Flynn, alleging Flynn acted negligently, willfully and wantonly.

According to the complaint, the plaintiff alleges that on May 10, he was operating his truck on Freeburg Street when he was pulled over by Flynn for rolling through a stop sign.

He was then handcuffed behind his back and allegedly forced to sit in a police car for 25 to 30 minutes, despite informing Flynn that he had undergone three neck surgeries in the previous year and should not be handcuffed behind his back, the suit states.  

As a result of Flynn's actions, the plaintiff alleges he was injured, causing him to suffer pain and and permanent disability.

The plaintiff requests a trial by jury and seeks judgment in an amount exceeding $50,000, plus costs of this suit and other just and proper relief.

Insurer says motorist negligently damaged street sweeper

EDWARDSVILLE — An insurance provider for the City of Alton is suing a motorist for allegedly damaging a street sweeper in a collision.

Illinois Municipal League Risk Management Association, a/s/o City of Alton, filed a complaint on Jan. 17 in Madison County Circuit Court against Gary Claxton, alleging he negligently caused damage to a city street sweeper that was insured by the plaintiff.

According to the complaint, the plaintiff alleges that on May 8, the street sweeper, insured by the plaintiff, was traveling southbound on Washington Avenue in Alton. Claxton attempted to pass the street sweeper, causing his trailer and track hoe to strike the sweeper.

As a result, the plaintiff alleges it suffered damages, depreciation and incurred losses in the amount of $206,500.

The plaintiff alleges Claxton failed to yield right of way, failed to keep careful lookout and failed to maintain proper control of his vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $206,500, plus costs of this suit.

Todd Sivia named to Rising Stars list

EDWARDSVILLE – For a fourth consecutive year, Todd Sivia has been named to the Super Lawyers list of 2017 Rising Stars.

Sivia is managing partner of Edwardsville-based Sivia Business & Legal Services, an asset-protection law firm that mainly focuses on general business law, real estate, estate planning, probate and elder law.

The annual list is compiled by Super Lawyers, a rating service of legal professionals. All peer-nominated candidates undergo the group’s selection process, which includes independent research and peer evaluations.

To be eligible for the honor, Rising Star nominees must be under 40 years of age or in practice for less than 10 years. According to Super Lawyers, no more than the top 2.5 percent of lawyers in each state are named to the annual Rising Stars list.

Customer allegedly lost leg from trip, fall at Jerseyville Hardee's

EAST ST. LOUIS — A Jerseyville Hardee's customer alleges she tripped and fell due to a difference in elevation in the parking lot, resulting in leg amputation.

Margaret Lorsbach, of Jersey County, filed a complaint on Jan. 10 in the U.S. District Court for the Southern District of Illinois against Pioneer Restaurants LLC, Tony Terry and Hardee's Restaurant LLC, alleging they breached their duty to exercise reasonable care to provide a safe environment.

According to the complaint, the plaintiff alleges that on Nov. 11, 2015, she was walking from her vehicle to the south entrance of the defendants' premises when she tripped and fell due to a difference in elevation from a parking lot to a sidewalk. As a result, she alleges she suffered injuries that led to a leg amputation.

Lorsbach alleges the defendants allowed a hazardous condition on the premises and failed to warn about it.

The plaintiff requests a trial by jury and seeks judgment against each defendant for a sum exceeding $50,000, plus costs of this action.

Lisa Madigan still trying to stiff state workers

“Why has she stood silently by each year in office as [the] General Assembly passed unconstitutional budgets for 12 years?”
That's the question Illinois State Representative Grant Wehrli tweeted last Saturday in response to State Attyorney General Lisa Madigan's filing of a motion in St. Clair County Circuit Court two days earlier to strip state workers of their pay pending resolution of a contract dispute.
Intervening in a lawsuit brought against Gov. Bruce Rauner by the American Federation of State, County and Municipal Employees, Madigan moved to dissolve by Feb. 28 a preliminary injunction requiring state workers to be paid in the absence of a budget.
Wehrli's question was a rhetorical one. Familiar with the Madigan M.O., he knows that Lisa's latest ploy is solely intended to obstruct the governor's agenda and gain political advantage.
As Mark Glennon of WirePoints noted a year and a half ago when she first attempted to thwart payment of state workers, “Illinois Attorney General Lisa Madigan went to court yesterday to stop state worker paychecks during the government shutdown or to allow payment of no more $7.25 an hour – the minimum wage. That action, together with the background story behind it – use of the courts to deliberately sabotage an agreement both workers and the state want – comprise one of the most sordid chapters of Illinois politics in recent memory.”
As it happens, during a prior state budget crisis, Madigan actually helped ensure that public employees were paid their proper wages on time. On that previous occasion, of course, there was a Democrat governor involved, instead of a Republican. That, apparently, made all the difference.
“Lisa Madigan wants chaos and hardship to result from the budget impasse for the purpose of embarrassing the Rauner administration,” Glennon explained, “and she has sacrificed the interests of workers and the state towards that goal.”
Rather than suspend state worker pay, let's suspend Lisa's-- until she stops playing politics and starts doing her job.

Josh Evans joins Unsell and Schuman as partner; Expands firm to Jerseyville

Attorney Josh Evans joined The Law Offices of Unsell and Schuman as a partner at the beginning of this year.

He is running the East Alton firm’s new Jerseyville office, which was where Evans previously operated his personal law firm.

“I’m looking forward to serving the Unsell law firm’s clients as well as bringing my own clients into the mix,” Evans said. “I hope to continue their work to fight for the little guy.”

Evans focuses primarily on personal injury litigation, but also does criminal defense litigation.

The Unsell firm specializes in cases involving personal injury, wrongful death, workers' compensation, domestic law, criminal and probate.

Evans grew up in Green County. He joined the military after graduating high school in 2005. His service included two tours in Iraq and Afghanistan.

After leaving the military in 2009, Evans attended St. Louis University Law School, graduating in 2014.

During his time at law school, Evans worked for the personal injury firm Myercord and Myercord in St. Louis. He also completed an internship with Bryan Cave in St. Louis.

While finishing law school, Evans chose to run for state representative for District 100.

Evans said he would campaign during the day and study for the bar exam at night.

He lost the 2014 election and started practicing law.

“Even though I lost, the great thing about running for office is I met a lot of people,” Evans said.

He added that it helped him gain exposure for his legal career.

Evans worked for a small firm in Jersey County for about a year before he branched out on his own.

He practiced personal injury litigation, criminal defense and general litigation at his own firm.

Evans currently serves as the commander for the Jersey County veterans’ organization Amvets.

He was also appointed to fill a vacancy with the Jersey County school board.
