Construction company sues contractors for alleged breach of contract

EDWARDSVILLE — A construction company is suing contractors for allegedly failing to make payments.

Lumberyard Suppliers Inc., doing business as LS Building Products filed a complaint on Jan. 11, in the Madison County Circuit Court against AMP Construction & Restoration LLC and John Michael Settlemyer, alleging they failed to fulfill their obligations under the terms of the promissory note.

According to the complaint, the plaintiff alleges that on April 14, 2016, in exchange for goods and valuable considerations, the defendants executed a promissory note in favor of Lumberyard Suppliers in the amount of $235,000. As of Jan. 5, 2017, the balance of $99,995.37 remains due and owing.

The plaintiff alleges the defendants failed and refused to make payments for the said balance account.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally, in the sum of $99,995.37, plus interest, attorney's fees and costs of this suit.

Woman alleges mother died from sepsis in nursing home

EDWARDSVILLE — A surviving daughter is suing a nursing home and care providers after her mother allegedly died due to complications from decubitus ulcers.

Debra King, as special representative of the estate of Barbara Wooley, deceased, filed a complaint on Jan. 11 in the Madison County Circuit Court against Willow Rose Rehab & Health Care Center, Healogics Inc. and Accellecare Wound Professionals LLC, alleging they violated the Illinois Nursing Home Care Act and the Illinois Wrongful Death Act.

According to the complaint, the plaintiff alleges that on Jan. 5, 2016, Wooley died due to complications associated with decubitus ulcers, which caused sepsis in her bloodstream.

The plaintiff alleges that during the last six months of Wooley's residency at the defendants' facility, they allegedly failed to provide necessary and appropriate treatment and services and failed to protect Wooley from abuse and neglect.

The plaintiff requests a trial by jury and seeks judgement against defendants in an amount exceeding the jurisdictional limits of the court, attorney's fees and costs and all other relief that the court deems just and equitable.

EDWARDSVILLE — A property owner is suing bar and grill operators for allegedly damaging the property and failing to pay for repairs. 

Noreen Faye Kelsey filed a complaint on Jan. 17 in the Madison County Circuit Court against Louise E. Benham, Stephanie L. Benham and 2001 Hildebrand Inc., alleging they failed to comply with the terms and conditions of the promissory note.

According to the complaint, Kelsey claims the defendants operate a bar and grill and allegedly damaged the property.

As a result, Kelsey alleges she had to expend time and money repairing the damages and has not received the full payment of $61,200 for the repairs.

The plaintiff alleges the defendants failed and refused, and continue to fail and refuse, to tender payments and misused and altered plaintiff's property.

The plaintiff requests a trial by jury and seeks judgment against defendants in excess of $50,000 for each of them, attorney's fees, interest and costs of this suit.

Edwardsville attorneys sued for alleged legal malpractice

EDWARDSVILLE — A client is suing Edwardsville attorneys Amanda Bradley Verett and Michael E. Reid for alleged legal malpractice.

Christopher Nolan filed a complaint on Jan. 17 in the Madison County Circuit Court against Amanda Bradley Verett and Michael E. Reid, alleging they deviated from the standard of care of a reasonable attorney.

According to the complaint, Nolan alleges he was charged $18,569.03 by the defendants without receiving benefits and was assessed $25,000 in attorney's fees as a result of their breach of contract.

The plaintiff alleges the defendants failed to follow the Illinois Rules of Professional Responsibility.

The plaintiff requests a trial by jury and seeks judgment against defendants in excess of $50,000 for each of them, plus costs of this suit.

Motorist, vehicle owner sued following collision

EDWARDSVILLE — A motorist is suing another driver and the vehicle's owner for allegedly causing a collision.

Cory Rice filed a complaint on Jan. 12 in the Madison County Circuit Court against Diana Foster, Mollie Palmer and Dustin Freytag, alleging Palmer negligently entrusted her vehicle to an unlicensed and careless driver.

According to the complaint, the plaintiff alleges that on Jan. 12, 2015, he was operating a 2004 Lincoln LS and was stopped at traffic in the southbound lane of Stanley Road at its intersection with Illinois Rt. 111. At the same time, Foster approached the intersection and negligently collided with the driver's side of plaintiff's vehicle, the suit states.

As a result, Rice claims he sustained severe and permanent injuries, loss of income and medical expenses.

The plaintiff alleges Foster and Freytag failed to operate the vehicle they were driving in a safe manner and failed to maintain careful lookout.

The plaintiff requests a trial by jury and seeks judgment against each defendant for $50,000, pre-judgment interest, costs of this suit and all other relief as the court deems just and appropriate.

Duebbert search warrants moved quickly to public record in St. Clair County

Among 39 St. Clair County search warrants that changed from confidential to public record between Dec. 20 and Jan. 17, two that pertained to Circuit Judge Ron Duebbert changed the quickest.

And on the day a court clerk stamped those two as open records on Jan. 12, the contents of Duebbert’s warrants were the subject of a local news article at 5:25 p.m.

While Duebbert has not been charged criminally, a special prosecutor has been called to investigate whether the newly elected judge obstructed an investigation into the murder of Carl Silas, who was shot in the face with a long gun at an apartment on West Boulevard in Belleville before dawn on Dec. 30.

On that date, sheriff’s deputies took suspect David Fields into custody.

Fields had spent time in prison and, upon release, had stayed at Duebbert’s Belleville home.

Duebbert, a Republican, defeated incumbent Democrat judge John Baricevic in the Nov. 8 election, and was sworn into office Dec. 5.

Controversy related to Fields has overshadowed Duebbert’s tenure as judge from the beginning.

Chief Judge Andrew Gleeson assigned Duebbert to hear traffic cases and specifically not first appearance felony cases that typically would go through his assigned courtroom. Gleeson indicated that Duebbert’s sheltering of a parolee listed as a violent offender gave the appearance of impropriety.

On New Year’s Eve, sheriff’s investigator Justin Biggs applied for warrants to search Duebbert’s phone and Sprint’s records for it.

In one of the warrants, Biggs wrote that witnesses identified Fields as the shooter and that one of them provided his phone number.

Biggs wrote that Sprint identified the account subscriber as Ronald Duebbert.

According to the warrant, Duebbert told investigators he met with Fields on Dec. 29, around 8 p.m., and that he had no further contact with Fields.

However, Biggs wrote that a request to Sprint provided nine text details between their phones on Dec. 29, from 8:10 p.m. to 10:47 p.m.

He wrote that special agent Patrick McGuire took custody of Duebbert’s phone.

Associate judge Stephen Rice signed the warrants around 6 p.m. on Dec. 31.

At 7:11 p.m., Biggs wrote, “Warrant served by fax, return of records pending.”

On Jan. 3, State’s Attorney Brendan Kelly charged Fields with first degree murder.

Gleeson set bail at $2 million.

On Jan. 4, Kelly requested appointment of a special prosecutor for Duebbert.

On Jan. 7, Kelly sent the Illinois Judicial Inquiry Board “documentation containing allegations of violations of the Illinois code of judicial conduct.”

“Specifically, Judge Duebbert allegedly did not uphold the integrity and independence of the judiciary,” Kelly wrote.

Kelly mixed the murder with last year’s election, alleging that candidate Duebbert did not maintain the dignity appropriate to judicial office.

He wrote that Duebbert’s conduct included the use of a racial epithet.

Kelly wrote that he filed an identical report with the Illinois Attorney Registration and Disciplinary Commission.

The phone records that investigator Biggs sought from Sprint arrived on Jan. 9. Although search warrants normally stay with one judge, Gleeson took charge of the warrants Rice had signed.

Gleeson signed a return at 4:27 p.m.

“Warrant was also sent to lawyer on 01-01-17 6:30 p.m.,” Gleeson wrote.

“Confirmation was received on 01-03-17 9:30 a.m.”

Biggs never returned the warrant for Duebbert’s phone.

On Jan. 12, an envelope full of warrants moved from Kelly’s office on the second floor of the courthouse to Circuit Clerk Kahalah Clay’s office on the third floor.

It contained the pair of warrants for Duebbert’s phone, a similar pair for Silas’s phone, and four warrants from separate cases.

The contents of Duebbert’s warrants were the subject of a news article at 5:25 p.m.

No other warrant that the clerk received from Dec. 20 to Jan. 17, entered the public record at such high speed.

A warrant on Scott Credit Union reached the clerk 12 days after execution.

A warrant on First Western Inn in Caseyville reached the clerk in 13 days.

Warrants on Sprint in other cases reached the clerk in 15, 62, and 68 days.

Four other warrants on phone providers in a single case reached the clerk in 21 days, and four in another case reached the clerk in 68 to 71 days.

Other warrants:

-For a drug search reached the clerk in 21 days.

-On Snapchat reached the clerk in 33 days.

-On a stolen vehicle in Washington State reached the clerk in 60 days.

-On child pornography reached the clerk in 67 days.

-On a laptop reached the clerk in 90 days.

About half the warrants expired without anyone executing and returning them.

Searching for search warrants

Anyone searching for a particular warrant at the St. Clair County Courthouse needs help finding it, for three reasons.

-First, the envelope that holds the warrant doesn’t identify the suspect.

-Second, no regular schedule governs the movement of a warrant from the investigator to the state’s attorney, or from that office to the circuit clerk. One of the 39 warrants that became public record between Dec. 20 and Jan. 17 reached the clerk after five years, another after 11 months.

-Third, warrants don’t appear in the public record of any ensuing criminal case.

Belleville attorney seeks to dismiss doctor's malpractice suit

Belleville attorney Terry Brown seeks to dismiss a physician’s legal malpractice suit alleging a Jefferson County jury ruled against the doctor after he was advised not to settle a wrongful death suit.

Dr. Manoj Desai, a Mt. Vernon urologist alleges he was a defendant in a 2011 wrongful death lawsuit, in which a jury returned a verdict in favor of plaintiff Marie Clayton, awarding her $3.75 million (11-L-66). Clayton filed her wrongful death suit on behalf of decedent Robert Clayton.

In his legal malpractice suit, Desai claims Clayton offered to settle the case within the policy limits of the liability insurance maintained by Desai.

Desai hired Brown to advise him on how to respond to Clayton’s settlement demand and to advise his insurance carrier to settle the case in order to avoid exposing his personal assets. Desai claims Brown told him it was in his best interest not to settle the Clayton case.

However, a jury later ruled in favor of Clayton and awarded her $3.75 million, which was $2.5 million more than the liability limits maintained by Desai’s insurance.

As a result of the jury verdict, Desai alleges his personal assets are at risk.

Desai alleges Brown failed to investigate the wrongful death claim, failed to advise him to settle the case and failed to monitor the progress of the case.

Brown filed a combined motion to dismiss on Dec. 7 through attorneys Daniel Konicek and Thomas Long of Konicek & Dillon PC in Geneva, Ill.

Brown argues that a legal malpractice claim cannot be assigned by a client to a non-client, third party.

He explains that Desai initially assigned the majority of his legal malpractice claim to Clayton.

“Therefore, Desai no longer possesses the legal right on which his claim against Brown is based. That being the case, he does not have legal standing to pursue the cause of action contained in his complaint. Moreover, given the fact that the assignment of legal malpractice claims is prohibited, the instant action cannot be pursued by Clayton or by Desai for the benefit of Clayton,” the motion states.

Brown also alleges that Desai would have to establish that had the defendant send a “demand letter,” ISMIE would have settled the case prior to trial in order to properly plead a “but for” claim.

Desai responded to Brown’s motion to dismiss on Dec. 27 through attorney Michael Gras of the Law Office of Christoher Cueto in Belleville.

The plaintiff argues that the defendant’s motion presents questions of fact that are not yet ripe, as the case is only at the pleading stage of the proceedings.

Desai also argues that he does not have to plead that had Brown complied with the duty he owed the plaintiff, ISMIE would have paid the underlying claim.

“Dr. Desai’s damages from Mr. Brown’s failure to comply with the relevant standard of care exist whether or not ISMIE would, or would not, have listened to the request to settle,” the response states. “By not sending such a letter or failing to do what he said he would, Terry Brown harmed Dr. Desai in that when the excess verdict inevitably arrived, Dr. Desai’s personal assets were at risk.

“Had Terry Brown did what he was supposed to do, and ISMIE still refused to settle, Dr. Desai would have had an action against ISMIE for failure to protect him.

“Because of Mr. Brown’s negligence so much of what Dr. Desai had worked his entire professional career was now at risk of loss. His plans for a retirement were at risk. Ultimately, Dr. Desai had to pay personally to avoid the predicament Mr. Brown put him in.”

A hearing is set for Feb. 21 at 9 a.m. with Circuit Judge Vincent Lopinot.

Gleeson grants default judgment in suit alleging sex assault

St. Clair County Circuit Judge Andrew Gleeson granted default judgment in a suit alleging a disabled adult was sexually assaulted.

Gleeson granted default on Dec. 6, awarding the plaintiff judgment for counts I and II. A hearing will be held at a later date to determine damages.

Plaintiff Chinetta Martin, individually and as guardian of the estate of C.D.C., a disabled adult, filed a motion for default judgment on Sept. 9. She argues that defendant Makial Lucas failed to file a responsive pleading, entitling her to default judgment.

Martin filed her complaint on May 25 against Lucas and Samuel Young III.

Martin claims C.D.C. was sexually assaulted in her school on Dec. 16, 2013, which was allegedly proven with a rape examination.

She alleges the experience caused C.D.C. to suffer severe trauma. She has also stopped going to school, leaving her unable to complete her high school education, the suit states.

Martin alleges the defendants removed C.D.C. from her class and forcefully dragged her into a closet to sexually abuse her.

She seeks a judgment of more than $50,000, punitive damages, plus court costs.

Young answered the complaint on June 27, denying the allegations against him.

Young is representing himself pro se.

Madison County school boards pave way for sales tax referendum on April 4 ballot

Madison County voters will decide a proposed sales tax increase in the April 4 election that proponents say will give schools more revenue to pay for school construction costs if it passes. 
Regional Superintendent of Schools Robert Daiber said districts that recently passed resolutions were Roxana, Triad, Highland, Bethalto, Granite City, Alton, Madison and East Alton districts 13 and 14.
“Sixty-three point five percent of the student population’s districts passed resolutions to put it on the ballot,” Daiber said.
County Clerk Mark von Nida has until Jan. 26 to certify the question to appear on the ballot.
“Most likely yes, it is going to be on the ballot,” Daiber said. 
He also said that Wood River Hartford District 15 will be passing the resolution despite not having done so before a Jan. 17 deadline. Only Collinsville voted the resolution down 4-2. Edwardsville and Venice school districts did not vote on the issue.
“They have done what they needed to do to submit it,” Daiber said of the districts. “I would highly encourage them, if they want it to pass, to campaign.”
The proposed 1 percent sales tax would be imposed on consumer goods, many of which are purchased by those outside the county, Daiber earlier told the Record.
“A good percentage of revenue that is generated from this is not paid by Madison County taxpayers," he said. "It is paid for by individuals passing through that may be buying things at interstate marts."
A proposed sales tax increase was overwhelmingly rejected by voters in Madison County in 2011, but Daiber said he believed things may be different this year.
“I think that maybe there is a more sincere need for it, maybe viewed by the public because of the current issues and funding education by the state," he said.
“I think the general public is aware of the issues of funding of education because of the amount of media attention that has been given to it,” he said, adding that he was aware of the concern over property taxes.
“This is a source of revenue that could lower property taxes.”
Daiber also noted that six new schools had just opened in 2011, which may have led residents to believe there was no need of a sales tax.
“Unfortunately to those districts who didn’t have bond issues that were successful for construction they are in greater need right now for facility maintenance,” he said.
However, Madison County Board Chairman Kurt Prenzler has made it clear that he is against the tax in a post on his social media site in which he discussed how the referendum to lower the tax levy for the Madison County government “was approved by the voters by a margin of 4 to 1.”
“The Democrats and AFSCME government employees' union challenged the petitions, but we survived the challenge, because we simply had the necessary signatures,” Prenzler wrote.
Prenzler said that the "real" reason for the proposed sales tax increase was to create a new stream of taxes, between $20-23 million per year. He said that would allow investment bankers to issue more than $300 million of bonds, which would put taxpayers "deep in long term debt."
Yet, Daiber said that things are much different on the financial front for the county.
“There has been an almost $2 million growth in sales tax revenue from 2011 when the initiative was put forth to today,” he said.

Next talc-cancer case scheduled in St. Louis Feb. 6; Trial set after J&J loses jurisdictional appeal

ST. LOUIS – The latest lawsuit in the nation's controversial talc-related litigation center is set to begin in St. Louis next month with more than 60 women and family members seeking damages against New Jersey-based Johnson & Johnson.

Swann vs Johnson & Johnson et. al., which combines the claims of mostly non-residents of Missouri, is expected to begin Feb. 6 before Judge Rex Burlison in Missouri's 22nd Judicial Circuit Court at the Carnahan Courthouse in St. Louis.

The trial date was set after Johnson & Johnson attorneys failed to get an appeals court to deny jurisdiction in the case for the 22nd Circuit Court to hear cases of out-of-state plaintiffs. Most of the plaintiffs with claims against Johnson & Johnson in Missouri courts are not residents of the state.

On Jan. 3, Chief Judge Angela T. Quigless issued a one-page order denying Johnson & Johnson's jurisdictional appeal.

Over the last few years, St. Louis Circuit Court has become known for being plaintiff-friendly, as seen by an increase in product liability and asbestos litigation. In a Sept. 29 article, Bloomberg Business referred to St. Louis as the "New Hot Spot for Litigation Tourists" with "a reputation for fast trials, favorable rulings, and big awards."

St. Louis was identified as a “judicial hellhole” by the American Tort Reform Association in its most recent report of the same name, saying St. Louis is very attractive to out-of-state plaintiffs for Missouri's lax standard for expert testimony and laws that allow for ease of forum shopping.

Things could change given the recent election of Missouri Governor Eric Greitens, who mentioned the dubious 'hellhole' distinction in his first State of the State address. Greitens is a strong supporter of tort reform, including advocating for the adoption of the more exacting Daubert standard for expert evidence and an end to "junk science" lawsuits.

Litigating the link between talc and ovarian cancer

Talc cases have become so lucrative, that Mass Torts Made Perfect conference in October, in the Bellagio Hotel Grand Ballroom in Las Vegas, offered tips for plaintiff and venue selection for the most friendly courts and the highest awards.

"The epidemiology is already there," James B. Matthews III, an attorney with Blasingame Burch Garrard & Ashley in Athens, Ga., told trial lawyers attending the conference. "You have to work to prove specific causation in these cases. You have to get the pathology, then you have to have good experts to explain these things. You need to be able to find the talc in the cells on the pathology slides but you've got to have somebody who can explain what that means."

A St. Louis Record request to Johnson & Johnson seeking comment was not answered. However, a page on the company's website maintains that talc is accepted as safe for use in cosmetic and personal care products by the European Union, Canada and many other countries, including Argentina, Brazil, China, India, Israel, South Africa, Turkey and Indonesia.

The website also points out that talc in consumer products has been asbestos-free since the 1970s and that Johnson & Johnson's baby powder products contain only U.S. Pharmacopeia grade talc. "The U.S. Centers for Disease Control and Prevention (CDC), which identifies potential risk factors for many diseases, has not identified talc as a risk factor for ovarian cancer," the website says.

Johnson & Johnson also cites two widely accepted studies, Harvard School of Public Health's "Nurses’ Health Study", published in 2009, and the U.S. National Institutes of Health's Women’s Health Initiative Observational Cohort, published in 2014. Both found no association between talc and ovarian cancer.

The latest data available, published in 2015 by the independent Cosmetic Ingredient Review Expert Panel, referred to talc as "safe in the present practices of use and concentration described in this safety assessment.”
 
Last summer, and outside counsel for Johnson & Johnson said there were strong grounds for appeals against multimillion-dollar jury verdicts linking talcum powder and ovarian cancer.

However, those scientific findings have not been able to counter opposite findings claimed by plaintiffs' attorneys in various legal venues. In 2015, juries in St. Louis handed down separate verdicts against Johnson & Johnson of $55 million, $70 million and $72 million respectively. Johnson & Johnson faces hundreds of similar lawsuits and the pressure is great to settle those lawsuits rather than use science to defend itself in court.



Sears denies liability in mechanic's wrongful termination suit

Sears denies liability in a mechanic’s suit alleging he was wrongfully accused of stealing by a co-worker in order to cover the defendant’s own thefts.

Karlo Matanzo filed the complaint on Oct. 4 against Sears Holding Corporation, doing business as Sears Auto Center, and Christopher Boone.

However, Sears Holdings Corporation was voluntarily dismissed without prejudice, and Sears Roebuck and Co. was substituted in as defendant.

Sears Holdings Corporation filed a stipulation for dismissal on Nov. 30 through attorney Misty Martin of Seyfarth Shaw LLP in Chicago.

It argued that the correct legal entity that employed the plaintiff and Bone is Sears, Roebuck and Co.

Associate Judge Christopher Kolker granted dismissal and substitution on Dec. 5.

According to the complaint, Matanzo alleges that in September 2015, he was terminated from his employment with Sears Auto Center after Boone allegedly fabricated accusations” that the plaintiff was stealing from the company. Matanzo alleges Boone made the false accusations to cover his own thefts from the company.

Sears Roebuck and Bone answered the complaint on Dec. 12.

They filed 14 affirmative defenses, arguing that there was no unprivileged publication to a third person, barring Matanzo’s defamation claim, and that any alleged defamatory statement “may reasonably be innocently interpreted.”

They argue that a corporate employer cannot interfere with its own business relationship with its employees.

The defendants also argue that the plaintiff was an at-will employee and could be terminated at any time for no cause at all.

Sears also claims that any alleged unlawful manner would have been outside of the course and scope of the individual’s employment and would not have been authorized or condoned by Sears.

A status conference is set for Jan. 30 at 9 a.m.

Construction company alleges Ameren was negligent in wrongful death suit

A construction company argues that Ameren Illinois was negligent when it installed a gas pipeline that allegedly exploded when an employee dug too deep, resulting in his death.

Angela Behme, as special administrator of the estate of John Douglas Behme, filed the lawsuit on June 20 against Ameren Illinois Company, A.B. Construction & Development LLC, doing business as Keystone Construction & Development, Sheppard Morgan & Schwaab Inc., doing business as SMS Engineers, and Villas of Nottingham.

Behme alleges the decedent was employed with Keller Construction on a Villas of Nottingham project in Maryville on April 6. He was operating the excavating equipment when he allegedly struck an underground gas pipeline owned and operated by Ameren. The pipeline ruptured and exploded, resulting in Behme’s death.

The plaintiff claims the defendants failed to monitor the gas pipeline for appropriate depth and the line’s integrity, failed to provide the actual location of the pipeline and failed to monitor the gas pipeline during construction and excavation in the area.

Third-party defendant Keller Construction answered the complaint on Dec. 16 through attorney Charles Schmidt of Brandon & Schmidt in Carbondale.

The third-party defendant alleges Ameren failed to install the gas pipeline with appropriate cover, failed to minor the gas pipeline for appropriate depth location, failed to monitor the location and integrity of the gas pipeline, failed to provide notification of the actual location and depth of the gas pipeline, failed to ensure proper marking and re-marking of the actual location of the gas pipeline and failed to monitor the gas pipeline during construction and excavation of the “Villas of Nottingham” subdivision construction project.

Behme filed a motion to compel on Dec. 22 through Belleville attorney Thomas Keefe.

The plaintiff filed her first interrogatories and requests for production on Nov. 9, seeking “information related to Ameren’s own locating and marking programs for gas pipeline facilities as well as information related to Ameren’s relationship with third-party locating and marking companies.”

Ameren objected to the request on Dec. 3, arguing that “those discovery requests – to the extent they seek information regarding Ameren’s own internal locating policies/procedures/programs, as opposed to information regarding Ameren’s involvement with third party locators – are irrelevant.”

However, Behme argues that Ameren’s internal locating and marking policies and procedures could reasonably lead to the discovery of evidence that “Ameren failed to ensure proper marking and re-marking of the gas pipeline location.”

Ameren filed a memorandum in opposition to plaintiff’s motion to compel on Dec. 30 through attorneys Stephen Wigginton, Karen Baudendistel and Tod Stephens of Armstrong Teasdale in St. Louis.

The defendant argues that Behme seeks documents beyond the scope of the Illinois Underground Utility Facilities Damage Prevention Act and the Illinois State-Wide One-Call Notice System, making them irrelevant.
Ameren further alleges that the plaintiff’s requests “are so broad that they also seek documents created by AIC’s counsel and claims representatives in investigating the occurrence, preparing a defense to the lawsuit, and gathering information and documents responsive to the parties’ written discovery.”

“AIC has no obligation to create a privilege log of such activities and documents in this case. AIC requests this court to sustain its objections to these requests. To the extent AIC withholds any document created by a non-attorney or claims representative based on attorney-client privilege or work product doctrine, AIC will create a privilege log of such documents,” the memorandum continues.

Judge Kievlan expected to return to work Feb. 1

St. Clair County Associate Judge Patricia Kievlan is expected to return to work next week after spending roughly one month out sick.

Chief Judge Andrew Gleeson said Tuesday that he anticipates Kievlan to return Feb. 1. So far, she has been out for about three weeks, he said.

Kievlan presides over the family docket. Gleeson said the remaining associate and circuit judges have helped cover the docket as needed.

Kievlan was appointed associate judge in May 2013 and was retained in 2015.

Her current term of office began July 1, 2015, and will run until June 30, 2019.

Just before she was retained, Kievlan earned a 91.60 rating in the “meets requirements of office” category in the 2015 judicial evaluation poll conducted by the Illinois State Bar Association.

Prior to her appointment to the bench, Kievlan worked as an attorney with Pessin, Baird and Wells in Belleville.

She received her undergraduate degree in 1979 from the University of Kansas in Lawrence, Kan. She received her M.S.W. in 1980 and her juris doctor in 1995 from St. Louis University in St. Louis.

Legal malpractice suit seeks attorney fee assessment and cost to defend protracted battle

O'Fallon attorney Amanda Kelton Bradley Verett, suspended for 90 days in 2008 for her handling of a family law matter, is being sued for allegedly putting her client "in an extemely worse position legally and financially" than before she represented him.

Christopher Nolan filed a complaint on Jan. 17 in Madison County Circuit Court against Verett, alleging she deviated from the standard of care of a reasonable attorney by filing and obtaining ex parte relief against his ex-wife and a Missouri hospital despite knowing she was not entitled to do so.

Attorney Michael E. Reid also is named as co-defendant.

The Illinois Supreme Court suspended Verett in October 2008 on the recommendation of the state's Attorney Registration and Disciplinary Commission (ARDC) which charged her with making a false statement in a Missouri court and engaging in conduct involving dishonesty, fraud, deceit or misrepresentation.

Verett was hired in 2007 to represent Christopher Nolan in an on-going dissolution case from former wife Tanna Nolan. In the divorce, a Madison County court had enjoined Christopher Nolan from contacting his son's doctors unless it was an emergency.

After the order was issued, Tanna Nolan scheduled a tonsillectomy for her son at Children's Hospital in St. Louis.

Several days prior to the surgery, Verett, in Madison County, filed a motion to stop the surgery from taking place. The motion was denied.

Verett then filed a petition for damages in St. Louis City Circuit Court against the son's medical providers. She also filed an injunction to stop the surgery.

According to the ARDC, at a hearing before St. Louis Circuit Judge John Garvey, Verett failed to tell the judge that she had just had a hearing in Illinois on the same matter.

Garvey subsequently enjoined the surgery, appointed a guardian ad litem for the minor, and ordered the mother to be added as a party.

Verett later withdrew her petition after the mother filed a motion to dismiss.

Garvey held a hearing and apologized to the lawyers for Children's Hospital and the mother telling them that had he known that the issue was taken care of in Madison County he would have immediately denied Verett's request.

At the hearing before the ARDC, Garvey testified that once he learned that the issue was disposed of in Madison County he was "mad" and felt like he "had just been lied to in court" by Verett.

Verett had testified before the ARDC that she did not lie to Judge Garvey but said she later realized that he "did not understand what the facts were in Madison County," and that she did not explain matters to Judge Garvey "clear enough to convey the appropriate information," and that it was her responsibility to do so.

Nolan's civil suit against Verett seeks in excess of $50,000 in damages. He claims that he was assessed $25,000 in attorney's fees as a result of Verett's alleged breach of contract and another $25,000 in fees in defending the assessment of attorney's fees.

He claims the statute of limitations did not begin to run until Oct. 21, 2016, when a motion he filed on Aug. 29, 2013 to reconsider the assessment of attorney's fees was denied.

Nolan claims Verett charged him $18,569.03 for services which not only provided no benefit, but also which put him in a worse position.

He is represented by attorney and former Madison County associate judge Thomas Hildebrand of Granite City, whose license to practice law was reinstated last September following a 10-year suspension.

In 2007, Verett sued Pizza Hut and Troy police officer Clarence Jackson claiming she suffered a shoulder injury because Pizza Hut negligently owned a faulty door that Jackson pulled one way while he entered the restaurant and she pulled the other way while exiting.

Her attorney Thomas Maag litigated the case in Madison County for two years before Circuit Judge Dennis Ruth dismissed it in 2009. The Fifth District Appellate Court affirmed Ruth in 2011.
