2016 corruption watch: Chicago, East St. Louis take top corruption spots

Illinoisans are no strangers to corruption. In fact, a Gallup survey found that Illinois residents have the least amount of confidence in their state government. It’s no wonder, considering Illinois and the City of Chicago are consistently ranked among the most corrupt governments in the nation.
This is evident in the top corruption stories for 2016, which cover local officials who have engaged in elaborate schemes worth millions of dollars in bribery, insider deals and theft, all at the expense of taxpayers.
A full look at 2016 corruption stories can be found in the Illinois Policy Institute’s Illinois Corruption Watch. Illinoisans should not have to accept corruption in their state. Residents and taxpayers should insist on – and politicians must embrace – more government transparency.
Here is a recap of the top four corruption stories from 2016:
- Chicago’s red-light scandal continues: Redflex Traffic Systems Inc., the company that used to administer Chicago’s red-light-camera program, made headlines in 2015 as news of a multi-million dollar scandal broke. The former CEO pled guilty to bribery and conspiracy in a $2 million scheme to funnel tens of millions of taxpayer dollars to the Redflex company.
The saga continued in 2016 as the city’s deputy commissioner of transportation, John Bills, was prosecuted for his role in the scheme where he ensured the company would win and maintain Chicago city contracts for the red-light-camera system. He was convicted of 20 counts of mail and wire fraud.
- Corruption in CPS: Another corruption case from 2015 also continued into 2016. In October 2016, former chief executive of Chicago Public Schools Barbara Byrd-Bennett pleaded guilty to wire fraud for funneling $23 million worth of school district contracts to two consulting firms. She received $2.3 million in kickbacks for ensuring the firms would have no competition in the bidding process.
In March, Chicago Public Schools filed a lawsuit seeking $65 million in damages and losses against Byrd-Bennett.
Also, in October, Gary Solomon, a co-owner of the consulting confirms involved in the scheme, pleaded guilty to wire fraud for his role in the scandal.
- Bribes, backroom deals stay the norm in Chicago: In September, Philip Oropesa, a former executive for LAZ Parking, pleaded guilty to wire fraud for his role in a kick-back scheme involving lucrative Chicago parking contracts. He pocketed $90,000 in brides in exchange for steering a $22 million contract to Cale Parking Systems USA.
 - Series of arrests in Metro East: Illinois’ Metro East area was also in the spotlight for corruption this year, as eight public officials were arrested on corruption charges. Those arrested included an East St. Louis councilwoman, two East St. Louis Township trustees and a St. Clair County Board of Review member. The charges include official misconduct, bribery, forgery and using public resources for personal gain.
The East. St. Louis Township supervisor was also arrested and pleaded guilty to wire fraud for using the township credit card to pay for personal expenses, including a trip to Las Vegas.

Timing of LeChien’s TRO for AFSCME questioned by Rauner in brief to appellate court

MOUNT VERNON – Counsel to Gov. Bruce Rauner indicates the state may have been misled by St. Clair County Circuit Judge Robert LeChien when he preserved the status quo for state workers last month, according to a chronology that Rauner’s lawyer prepared.
LeChien invited briefs in response to American Federation of State, County and Municipal Employees’ request for a temporary restraining order at close to 6 p.m. on Dec. 5, according to Rauner attorney Thomas Bradley, yet the state learned the next day that the judge had already signed off on the TRO in favor of workers.
“There was no explanation why, if the temporary restraining order had already been entered on Dec. 5, Judge LeChien was inviting the parties at 5:58 p.m. that day to submit courtesy copies of briefs in support of the temporary restraining order and advising that he might schedule another hearing on the temporary restraining order, if needed,” Bradley wrote.
Bradley submitted the chronology as an addendum on a single page in a brief submitted to the Fifth District Appellate Court on Dec. 15.
Appellate judges overturned LeChien’s decision on Dec. 16.
LeChien had ordered Rauner to abide by a contract that the AFSCME and Gov. Pat Quinn signed in 2012.
The contract expired on June 30, 2015, but remained effective pending execution of a new contract or declaration of an impasse.
Rauner declared an impasse last January, but the union disagreed.
Last summer, an administrative law judge at the state Labor Relations Board held a trial on this dispute and others.
The judge found that the state and the union had reached an impasse in January, over the critical issue of subcontracting.
On Nov. 15, the Labor Relations Board adopted the judge’s recommendations.
The board didn’t formally declare an impasse, but Rauner took the initiative.
On Nov. 16, he told state employees they would earn $1,000 bonuses for attendance above 95 percent.
He told them they would qualify for merit bonuses, in consultation with the union.
On Nov. 30, he announced alcohol and drug testing on reasonable suspicion.
On that date, in LeChien’s court, the union moved to amend a complaint it filed last April but never pursued.
The union argued that the old contract remained effective because the labor board hadn’t declared an impasse.
LeChien granted the amendment.
The union moved for a temporary restraining order on Dec. 1.
LeChien set a hearing for the next day, without public notice.
At the hearing, he ordered Rauner to rescind any changes he had made.
LeChien didn’t immediately put the order on paper.
On the morning of Dec. 5, the labor board issued an order declaring an impasse.
At 11:52 a.m., according to Bradley’s chronology, the state sent the impasse order to LeChien with a brief opposing a restraining order.
Bradley wrote that at about the same time, the union petitioned the First District appellate court for review of the impasse order.
At 12:31 p.m., he wrote, the union requested an opportunity to respond to the state’s brief in LeChien’s court.
He wrote that at 3:13 p.m., the union indicated it would shortly file a response.
He wrote that at 5:58 p.m., LeChien indicated that he would schedule another hearing on an expedited basis.
“There was no mention of any action on AFSCME’s temporary restraining order request, and the judge’s email led the state to conclude that the temporary restraining order had not yet been resolved,” Bradley wrote.
On Dec. 6, he wrote, the union served on him a reply brief dated Dec. 5.
“In a subsequent email to Judge LeChien, AFSCME stated that the reply brief had been filed ‘late last night,’” he wrote.
That afternoon, he wrote, LeChien sent him a restraining order order dated Dec. 5.
He wrote that LeChien indicated he would consider briefs on Jan. 13.
“There was no explanation as to why the temporary restraining order was dated and filed on Dec. 5, 2016,” Bradley wrote.
Also on Dec. 6, in Cook County court, the union challenged the labor board’s impasse order as a violation of the Open Meetings Act.
On Dec. 7, Bradley petitioned the Fifth District for review of LeChien’s order.
Bradley wrote that the Labor Act provides no jurisdiction for circuit courts over public sector labor disputes.
He wrote that the harm the state would suffer from the order far outweighed any harm the union might suffer if it wasn’t reversed.
He wrote that Rauner had a right to implement his best offer to address the worst fiscal crisis in the nation.
Union counsel Stephen Yokich responded to the petition on Dec. 12, writing that LeChien noted the severe impact of the state’s health insurance approval.
Yokich wrote that the proposal would require families to pay $3,000 more in premiums or enroll in plans with high out of pocket costs.
On Dec. 13, labor board members erased any doubt about the impasse order by approving it at a regular public meeting.
Bradley sent the order to the Fifth District on Dec. 15, arguing that LeChien no longer had jurisdiction.
He wrote that on Dec. 11, “Judge LeChien acknowledged that the consensus of the parties was that he no longer had jurisdiction.”
Bradley attached his chronology as an addendum on a single page.
A day later, Fifth District judges advised LeChien that circumstances changed.
They didn’t deny his jurisdiction, but they ruled that he must determine whether to dissolve the order in light of facts as they currently exist.

Mother alleges physician failed to timely intervene, injuring newborn

BELLEVILLE — A mother is suing Memorial Hospital and Frank F. Mussemann, MD, alleging negligence in labor and delivery care.

Rebecca Jones-Wilson, as a mother and next friend of Matthew Jones, a minor, filed a complaint on Nov. 21 in St. Clair County Circuit Court against the defendants, alleging that they failed to provide medical care and treatment consistent with the standards in the medical community.

According to the complaint, the plaintiff alleges that as a result of the defendantss negligence, her minor son was injured during delivery, and that the injuries were permanent and will require lifetime care and treatment. The plaintiff holds the defendants responsible for an alleged failure to intervene in a timely fashion when labor was not progressing, an alleged failure to monitor properly, and other allegations of improper care.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of $50,000 for each of them, plus costs of this suit. She is represented by Timothy R. Tyler and Jesse R. Tyler of Tyler Law Offices PC in Chicago.

Patient alleges negligence following surgery

BELLEVILLE — A patient is suing Lincoln Surgical Associates and a physician following a medial gastrocnemius flap procedure.

Andrew Dahm filed a complaint on Nov. 23 in St. Clair County Circuit Court against Lincoln Surgical Associates Ltd. and Dr. Vidya Shankaran, alleging medical malpractice.

According to the complaint, the plaintiff alleges that while performing a medial gastrocnemius flap, there was no denervation of the flap. He also claims the defendants failed to provide appropriate post-surgical care.

As a result of the defendants' actions, Dahm claims he suffered severe, permanent and disabling injuries resulting in great pain and mental anguish, loss of enjoyment of life and multiple additional surgeries that required large sums of money.

The plaintiff requests a trial by jury and seeks judgment against each defendant in excess of $50,000, plus costs of this suit.

Woman alleges injuries from damaged curb

BELLEVILLE — A woman claims she was injured when she stepped onto a damaged curb.

Paula Daley filed a complaint on Nov. 23 in St. Clair County Circuit Court against Howland 3 Investments LLC and Tracy L. Bardin, alleging they negligently permitted a curb on their premises to become dangerous.

According to the complaint, the plaintiff alleges that on Nov. 24, 2014, she was lawfully on the defendantss premises, walking in the designated parking lot, when she tripped and fell after stepping onto a damaged curb.

She claims she sustained severe injuries resulting in pain and suffering, disability, lost wages and medical expenses.

Daley alleges the defendants failed to inspect and maintain the premises in a reasonably safe condition, failed to provide a safe place to walk and failed to warn their guests of the unsafe and defective condition.

The plaintiff requests a trial by jury and seeks judgment against each defendant in excess of $50,000, plus costs of suit.

Woman alleges decedent developed pressure ulcers in nursing home

BELLEVILLE — An executor of a deceased woman's estate alleges negligent nursing home care caused the decedent to develop pressure ulcers.

Judy McGovern, executor of the estate of Betty Elaine Hamilton, filed a complaint on Nov. 14 in St. Clair County Circuit Court against Covenant Care Midwest, doing business as Cedar Ridge Health & Rehab Center, alleging violation of the Nursing Home Care Act.

According to the complaint, the plaintiff alleges that during the time that Hamilton was a resident at the defendant's facility, she suffered from pressure ulcers and infections.

McGovern alleges the defendant failed to provide necessary care and services and failed to develop and implement a comprehensive care plan.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages in excess of $50,000, plus costs of this suit.

BELLEVILLE — A woman is suing the Blake Behme Law Group for alleged legal malpractice involving her divorce case.

Bobbi Jo Fults filed a complaint on Nov. 22 in St. Clair County Circuit Court against Edward J. Blake Jr., Megan M. Gilbreth and the Blake Behme Law Group PC, alleging they breached their duty to exercise reasonable skill and knowledge common to members of the legal profession.

According to the complaint, the plaintiff – who married and divorced the same man four times and lived with him most of the time during the periods between the marriages – alleges that as a result of the defendants' actions, she lost at least $1 million for her share in the marital property. She also alleges she sustained attorneys' fees in excess of $50,000, and suffered emotional distress worth excess of $100,000.

The plaintiff alleges the defendants failed to protect her interests, failed to discover all the marital property that should have been included in the property settlement and abandoned her on the hearing date of Nov. 23, 2015.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, in a sum exceeding $1,150,000, plus costs of this suit.

Tenant sues property owner over slip and fall

EDWARDSVILLE — A tenant claims he was injured when he slipped and fell on the sidewalk at his apartment complex.

is suing Bouse Properties LLC, a property owner, citing alleged insufficient measures were taken to prevent injuries.

Donald Jones filed a complaint on Dec. 9, in the St. Clair County Circuit Court against Bouse Properties LLC, alleging the property owner negligently allowed a dangerous condition to exist in the premises.

According to the complaint, the plaintiff alleges that on Dec. 14, 2014, he was a lawful tenant at defendant's apartment complex. While walking on the sidewalk, he stepped upon a substance that caused him to slip and fall.

As a result of the incident, Jones sustained severe injuries resulting in pain and suffering, loss wages and medical expenses.

The plaintiff alleges Bouse Properties failed to maintain the sidewalk and steps in a reasonably safe condition and failed to provide adequate warnings of the existence of the dangerous condition.

The plaintiff requests a trial by jury and seeks compensation in an amount greater than $50,000, costs of this suit and all other relief that are just and proper.

Guest sues resort operators over broken lounge chair

BELLEVILLE — A woman claims she was injured on a broken lounge chair while vacationing in Jamaica.

Roberta L. Vogt filed a complaint on Dec. 15, in the St. Clair County Circuit Court against Sagicor Life Insurance Co. and Aimbridge Hospitality, alleging they breached their duty to ensure that the property was safe for their guests.

According to the complaint, the plaintiff alleges that on Nov. 30, 2015, she was a guest at the defendants' golf resort in Runaway Bay, Jamaica, when he sustained a laceration on her right leg from a broken lounge chair.

The plaintiff alleges the defendants failed to inspect the defective lounge chair, failed to repair or replace the lounge chair and failed to warn her of the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against each defendant in an amount exceeding $50,000, plus costs of this suit and all other relief that the court deems appropriate.

Consumer sues peanut butter manufacturer for alleged unlawful advertising

BELLEVILLE — A consumer has filed a class-action lawsuit against Aldi for allegedly charging a premium price for peanut butter wit evaporated cane juice.

Brett Toenjes, individually and on behalf of all others similarly situated current citizens of Illinois, filed a complaint on Dec. 14, in the St. Clair County Circuit Court against Aldi Inc., alleging unjust enrichment and the peanut butter manufacturer violated the Illinois Consumer Fraud Act.

According to the complaint, the plaintiff alleges that in August 2016, he purchased Aldi's Peanut Delight Natural Creamy Peanut Butter Spread for $1.89. However, he claims he suffered damages for paying a premium price for a misleading product. The plaintiff holds Aldi Inc. responsible because the defendant allegedly deceptively represented that its product contains evaporated cane juice.

The plaintiff requests a trial by jury and seeks an order certifying this case as a class action, appointing plaintiff and his counsel as class representatives, award for declaratory and equitable relief, plus interest, attorney's fees, costs and all other relief ay may be just and proper.

Woman claims doctor refilled narcotic prescription for patient with history of drug abuse

BELLEVILLE — A special administrator of a deceased man's estate is suing a doctor for allegedly negligently refilling an opioid narcotic for a patient with a history of drug and alcohol abuse.

Judy L. Grant, as special administrator of the estate of Tony Grant, filed a complaint on Dec. 9 in St. Clair County Circuit Court against Dr. William Harold Thom and Associated Physicians Group Ltd., alleging Thom breached his duty to apply the skill and care ordinarily used by a reasonably well-qualified healthcare provider.

According to the complaint, the plaintiff alleges that on Sept. 28, 2015, Tony Grant died from his opiate use. As a result, the plaintiff alleges she suffered grief and sorrow, as well as the decedent's adult children. 

The plaintiff alleges the defendants negligently continued to prescribe an opioid narcotic to Tony Grant despite the claim that he knew or should have known that the decedent had an inconsistent urine toxicology screen and a history of alleged drug and alcohol abuse.

The plaintiff requests a trial by jury and seeks compensation in excess of $50,000, plus costs of suit.

Deubbert re-assigned to administrative duties while police investigate 'person of interest' parolee who lived with judge

St. Clair County Circuit Judge Ron Duebbert has been re-assigned to administrative duties due to his involvement with a registered violent offender who is now a "person of interest" in a Belleville murder investigation, according to Chief Judge Andrew Gleeson who entered the re-assignment order today.

The person that matches the description in Gleeson's order is David E. Fields, 20, who upon release from prison on parole Oct. 24 lived with Duebbert at his home on Powdermill Road in Belleville until Dec. 2.

Duebbert, a Republican, was elected in November, having defeated Democrat John Baricevic, former chief judge, in a bruising campaign. Duebbert was sworn into office on Dec. 5.

Upon his release from prison, Fields was required to register as a violent offender with an Illinois State Police registry. He was convicted for aggravated battery of a pregnant woman who was 17 at the time of crime, as was Fields.

On Friday, the Major Case Squad was called to investigate the fatal shooting of Carl Z. Silas, 28, at an apartment on West Boulevard in Belleville.

Fields was jailed later on Friday and continues to be held on a parole violation charge at the St. Clair County jail.

"An issue has arisen that leads the Court to act with caution and deliberation," Gleeson wrote.

Gleeson's order indicates re-assignment will be effective until issues "are understood and resolved to the Court's satisfaction."

"The Court is acting thusly to ensure the safety of the general public, its right to a fair and impartial jurist, and to protect the integrity of the Court," the order states.

Duebbert has been contacted for comment, but had not returned a phone call as of Tuesday afternoon.

Woman alleges injuries after slipping on oil

BELLEVILLE – A woman claims she was injured when she slipped on oil at Valvoline Oil Change.

Teri Dent filed a complaint on Dec. 10 in St. Clair County Circuit Court against Ashland Consumer Markets, doing business as Valvoline Oil Change, claiming the property was not kept in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Aug. 28, she fell on a patch of oil on the floor while exiting her vehicle.

The incident caused her to sustain injuries that resulted in pain and suffering, mental anguish, medical expenses and lost wages, she claims.

The plaintiff alleges the defendant failed to monitor the floor to prevent oil from spilling and failed to clean the spilled oil from the floor.
