Rosenstengel denied remand in asbestos suit; Removed based on federal officer defense

District Judge Nancy Rosenstengel denied a woman’s request to remand an asbestos suit to Madison County Circuit Court, holding that defendant Crane Co. sufficiently established federal jurisdiction.

Rosenstengel filed the order on Nov. 30, denying plaintiff Sylvia Perez’s motion to remand.

“Crane Co. has shown that the Navy approved reasonably precise specifications, Crane Co.’s equipment conformed to those specifications, and the Navy was aware of the dangers of asbestos. Thus, Crane Co. has established the elements of the government contractor defense,” she wrote.

Sylvia Perez filed the wrongful death suit individually and as special administrator of the estate of Armando Perez, her deceased husband, on June 1.

According to her three-count complaint, the plaintiff alleges the decedent was exposed to asbestos while serving in the U.S. Navy aboard the USS Maryland from 1944 to 1946. As a result of his exposure, the decedent developed mesothelioma.

Crane Co. removed the case to federal court on July 25.

The defendant removed the case based on the federal officer removal statute, alleging federal subject matter jurisdiction.

Defendant General Electric Company joined Crane Co.’s removal on Aug. 1. It also filed a separate notice of removal asserting independent grounds for federal officer jurisdiction.

The Illinois Supreme Court explained that the “basic purpose of the statute is to protect the federal government from the interference with its operations which would ensue if a state were able to try federal officers and agents for alleged offenses committed while acting within the scope of their authority.”

Perez filed a motion to remand the case on Aug. 24.

Crane Co. responded to Perez’s motion to remand on Sept. 26.

GE also filed a response.

Crane Co. moved to strike GE’s joinder in its removal and its response to the plaintiff’s motion to remand, “to the extent those documents provided arguments related to GE’s untimely notice of removal asserting independent grounds for federal officer jurisdiction.”

The court denied Perez’s motion to strike but allowed the plaintiff time to provide a reply brief in support of remand.

Perez filed her response brief on Nov. 28.

The plaintiff argues that Crane Co. waived its right to removal by filing a motion to dismiss in the circuit court before removing the case.

However, Crane Co. counter-argues that removal is waived only in “extreme situations.”

Rosenstengel held that because Crane Co. filed its notice of removal only two hours after filings its state court motion to dismiss, “the Court cannot say that Crane Co. evinced an intent to have the state court decide the case on the merits. Therefore, Crane Co. did not waive its ability to remove the case to this Court.”

The plaintiff also claims Crane Co. failed to meet its burden of establishing federal subject matter jurisdiction.

Perez argues that the supporting affidavits filed by the defendant were all originally filed in other asbestos cases in other jurisdictions, “and none of the affiants worked for Crane Co. at the time the products at issue were manufactured.”

Further, she argues that Crane Co. failed to provide any evidence that it supplied the USS Maryland with equipment or made any specific warning requirements for equipment the Navy obtained from the defendant.

However, Rosenstengel cited the Ruppel decision, which holds that individuals with similar positions are “sufficient to merit removal based on federal officer jurisdiction.”

Turning to the merits of Crane Co.’s federal officer defense, Rosenstengel concluded that the defendant is a person under the statute and was acting under a federal officer.

“Crane Co. acted under the direction of the Navy in the design, manufacture, and sale of its products for and to the Navy, and its products were designed and manufactured in strict accordance with contracts and specifications approved by the Navy.

Rosenstengel also held that Crane Co. is not required to notify or obtain the consent from other defendants in order to remove the case to federal court, and removal is allowed for the entire case even when the federal officer defense does not apply to all of the claims.

The court denied Perez’s motion to remand on Nov. 30.


Driver, passenger allege motorist caused collision

BELLEVILLE — A driver and passenger are suing a motorist for allegedly causing a collision.

Amanda Gavins and Nina Young filed a complaint on Nov. 2 in the St. Clair County Circuit Court against Tamara Thompson, alleging she breached her duty to exercise reasonable care to protect others on the road.

According to the complaint, the plaintiffs allege that on March 15, Gavins was driving through Centreville with Young as a passenger when Thompson, traveling the opposite direction, made a left turn directly in front of their vehicle, causing a collision.

As a result, the plaintiffs sustained injuries, suffered loss of wages and incurred medical expenses, the suit states.

The plaintiffs allege Thompson failed to maintain proper lookout, operated her vehicle at a speed greater than reasonable and negligently made a left turn in front of the plaintiffs' vehicle.

The plaintiffs request a trial by jury and seek judgment in their favor in excess of $50,000 for each of them, plus costs of this suit.

Motorist alleges man was driving without headlights

BELLEVILLE — A driver is suing another motorist for allegedly driving without headlights and causing a collision.  

Dennis S. Moore filed a complaint on Nov. 3 in St. Clair County Circuit Court against Michael Burris, alleging the defendant breached his duty to exercise ordinary care in operating his motor vehicle.

According to the complaint, the plaintiff alleges that on May 14, he was traveling south on Mud Creek Road in Marissa. He claims he was stopped at a stop sign and then began to turn onto Illinois 13 when the defendant collided with him at high speed. Moore alleges he could not see the defendant's vehicle because his headlights were not on.

As a result, the plaintiff sustained severe and disabling injuries resulting in physical and mental pain, medical expenses and loss of enjoyment of life, the suit states.

The plaintiff alleges Burris failed to stop or reduce speed to avoid collision, failed to maintain proper lookout and failed to turn on the headlight of the his vehicle to provide visibility to himself and caution to others.

The plaintiff requests a trial by jury and seeks judgment against the defendant in excess of $50,000.

Woman accuses Fairview Heights motorist of negligence

BELLEVILLE — A Cahokia woman is suing a Fairview Heights City motorist, alleging negligence in connection with a collision.

Yvonne Tucker filed a complaint on Nov. 9 in St. Clair County Circuit Court against Brandon Riley, alleging the defendant failed to maintain proper control of his vehicle.

According to the complaint, the plaintiff alleges that on Nov. 13, 2014, she was driving a motor vehicle in Belleville when the defendant, who was traveling next to the plaintiff, negligently caused his vehicle to collide with the plaintiff's vehicle.

As a result of the collision, Tucker sustained severe injuries resulting in medical expenses and loss of wages and gainful employment, she alleges.

The plaintiff alleges Riley failed to keep careful lookout, failed to stop or swerve and/or to timely stop his vehicle to avoid a collision.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount greater than $50,000, plus costs of this suit and any other relief that is just and proper.

BELLEVILLE — Two people allege injuries following St. Clair County accident.

Whittnee Jones and Brittnee Jones filed a complaint on Nov. 9 in St. Clair County Circuit Court against Kristin L. Tolar, alleging the defendant failed to exercise the highest degree of care to avoid a collision.

According to the complaint, the plaintiffs allege that on Feb. 20, 2015, they were traveling westbound on Salem Place in St. Clair County when the defendant swerved and collided with their vehicle.

As a result, they claim they sustained injuries resulting in pain and suffering and medical expenses.

The plaintiffs allege Tolar negligently operated her vehicle at a speed greater than reasonable, failed to sound warning of her approach and improperly used the plaintiffs' lane.

The plaintiffs request a trial by jury and seek judgment in excess of $50,000 for each of them, plus cost of suit.

Patient alleges misread x-ray

BELLEVILLE — A patient alleges his x-ray was misread and doctors failed to diagnose a fracture.

Roger Kuerth filed a complaint on Nov. 7 in St. Clair County Circuit Court against Neetin Patel, M.D., MidAmerica Radiology SC and Good Samaritan Regional Health Center, alleging they deviated from standard procedure in medical care.

According to the complaint, the plaintiff alleges that on Aug. 8, 2014, he underwent an X-ray that was misread. As a result, he was misdiagnosed and mistreated, which caused him to suffer permanent injuries and pain, mental anguish, disability, lost wages and to become liable to expensive medical treatment, he alleges.

The plaintiff alleges the defendants failed to diagnose a fracture and negligently rendered injurious treatment.

The plaintiff requests a trial by jury and seeks judgment exceeding $75,000, plus costs of suit.

Individuals allege injuries in Collinsville head-on collision

EDWARDSVILLE – Two individuals allege they were injured in a Collinsville crash when a motorist allegedly crossed the center line and struck their vehicle head on.

Joshua Bailey and Todd Wells filed a complaint on Nov. 30 in Madison County Circuit Court against Cassandra Hart, alleging negligence.

According to the complaint, the plaintiffs allege that on July 18, Bailey was operating his motor vehicle with Wells as a passenger on West Main Street in Collinsville when the defendant negligently crossed over the center lane and hit Bailey's vehicle head on.

As a result, the plaintiffs allege they sustained injuries that made them feel sick, lame and disordered and suffered pain and sufferings, disabilities and medical expenses.

The plaintiffs allege Hart failed to maintain a careful lookout, failed to timely apply brakes and failed to operate her vehicle in her right lane of travel.

The plaintiffs request a trial by jury and seek judgment in their favor in an amount of more than $50,000 for each of them, plus costs of this suit.

Man sues over Alton rear-end collision

EDWARDSVILLE – A motorist alleges he was injured when he was rear-ended on Martin Luther King Drive in Alton.

Michael Harpole filed a complaint on Dec. 1 in Madison County Circuit Court against Daniel Plate, alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 4, 2014, he was traveling northbound along Martin Luther King Drive approaching its intersection with Alton Square Mall Drive in Alton when the defendant, who was traveling on the same road and direction, negligently struck the rear his vehicle.

He alleges he sustained injuries resulting in pain and suffering, disability, medical expenses and loss of wages.

The plaintiff alleges Plate failed to reduce his vehicle's speed to yield right of way to an ambulance entering the intersection.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages of more than $50,000 and for all other relief that is just and proper.

Why all Illinoisans need action on workers' comp

At first glance, workers’ compensation reform might seem like small potatoes.

That’s because its effects can be tough for people to see: The payroll of a small trucking business in East Peoria, a routine railroad repair job in Rochelle, salaries at a Springfield steel shop.

This type of blue-collar work is where employers can experience serious pain on their workers’ compensation bills. Those costs, the highest in the Midwest, kill jobs growth and higher salaries. That’s why some state politicians dismiss workers’ compensation as purely an economic issue. They say it should be off the table in budget discussions.

But they’re wrong. There are other unseen costs.

What many Illinoisans may not know is that this broken system greatly affects the ability of Illinois governments to care for the people most in need of public services. It is indeed a budget issue. And it lays bare the perverse priorities of our state.

Kim Zoeller is the CEO of the Ray Graham Association, a social service provider based in DuPage County that cares for 2,000 adults and children with intellectual and developmental disabilities. Nearly all of the group’s funding comes from state government.

The mission of the Ray Graham Association is not only to care for those people, but also to help them achieve more than they ever thought possible: A dream job, pursuing a passion, or simply the joy of living independently. That takes years of patience and hard work from nearly 400 employees.

But in 2010, something terrible happened.

While caring for one of the Association’s clients, an employee stumbled and suffered a sprained ankle. After many visits to different doctors, a later diagnosis of a generalized pain disorder, and years of litigation, the Association found itself on the hook for a $650,000 settlement.

All for a sprained ankle.

“It was like someone pushed us off a cliff,” Zoeller said.

That case radically increased the organization’s workers’ compensation premiums. What once was a cost that hovered around $460,000 annually now comes in at more than $1 million.

“You think about where that half-a-million-dollar difference could go,” Zoeller said.

She estimates it would be enough to cover the cost of residential support services for nine adults for an entire year, or it could be used to raise the base salary of her care providers.

“The provider community is very supportive of workers’ comp reforms for those reasons,” Zoeller said. “What’s frustrating is that it’s the same system that’s funding us that isn’t passing these reforms.”

The sprained ankle is only one example of government funds flowing not to essential services, but to pay for a system that is clearly flawed. Zoeller said the Association recently had to pay out $1,500 for a paper cut.

That’s not where taxpayers expect their money to go, especially when funding care for Illinoisans with lifelong disabilities.

A study released Nov. 29 by the Illinois Policy Institute shows the cost of workers’ compensation for municipalities, counties and state government in Illinois is more than $400 million per year.

If that’s not a budget issue, what is?

That estimate doesn’t even consider the other units of local government in Illinois, which together represent more than half of all government payroll costs in the state. Also left out are billions of dollars in public construction projects, all of which come with the inflated cost of workers’ compensation insurance here.

Instead of trying to solve this problem, legislative leaders have chosen to peddle wild conspiracy theories.

Steve Brown, spokesman for Illinois House Speaker Mike Madigan, has blamed high costs on insurance companies not passing along savings to customers. There is no evidence supporting this claim, and it would require collusion among more than 330 rival insurance companies in Illinois, in violation of federal anti-trust law.

And the trial lawyers who bankroll Madigan’s machine would have been all over any kind of insurance price-fixing scandal. After all, people and businesses harmed by federal anti-trust violations can seek triple damages.

Those trial lawyers like the system the way it is.

That’s why Illinoisans continue to see public dollars wasted on paper cuts, sprains and bruises. And it’s why reform is needed now more than ever.

Regions Bank alleges borrower failed to make payments

EDWARDSVILLE — Regions Bank claims a borrower failed to make payments on a loan.

Regions Bank filed a complaint on Dec. 2, in the Madison County Circuit Court against Gary Layton Jr. alleging the borrower failed to perform his obligations under the loan agreement.

According to the complaint, the plaintiff alleges that on March 28, 2008, it reached a contract with the defendant for a loan. As of June 30, 2016, the defendant owes $214,069.81, including interest and late charges, the suit states.

The plaintiff alleges the defendant failed to repay the amounts due and owing under the terms of the note.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages amounting to $214,069.81, plus interest, late charges, costs and all other legal and equitable relief.

Real estate agents accused of concealing mold

EDWARDSVILLE — Property buyers are suing real estate agents for allegedly concealing mold.

Jennifer E. Gross and Nina C. Gross filed a complaint on Nov. 29, in the Madison County Circuit Court against Jared Childess, Danny Childress, C&C Home Restorations LLC, John Kodros and Market Pro Realty Inc., alleging consumer fraud.

According to the complaint, the plaintiffs allege the defendants failed to disclose a widespread mold contamination in a property. As a result, they allege they suffered health issues and actual damages in the total amount of $125,000.

The plaintiffs allege the defendants negligently represented that the property did not have a mold infestation and failed to remediate and abate said mold contamination.

The plaintiffs request a trial by jury and seek judgment against the defendants, jointly and severally for damages exceeding $125,000, plus interest, punitive damages in the amount of $150,000, attorney's fees, costs and all other relief.

EDWARDSVILLE - Four new associate attorneys join HeplerBroom's Edwardsville, St. Louis and Springfield offices. 

Zoe Gross will focus on business litigation matters at the firm's St. Louis office.

Gross earned a Bachelor of Art Degree from Wesleyan University. She later received a law degree in 2016 from the Washington University School of Law.

While she was a student in law school, she also was part of the Washington University Law Review, where she served as Managing Editor. She also served as a teaching assistant in Legal Practice and Criminal Law.

Julieta Kosiba will focus on civil litigation at the firm's Springfield office.

Kosiba earned her law degree in 2016 from Washington University's School of Law. She earned her undergraduate degree from DePaul University.

During her time at law school, she was the Primary Editor of the Washington University Jurisprudence Review and completed several internships.

While at DePaul University, she was a member of the Mock Trial Association, where she took first place in the Outstanding Attorney Award during a tournament battle. 

Amanda McQuaid will focus on banking transactional and litigation matters at the firm's Edwardsville office.

She recently graduated in 2016 from the Illinois College of Law, where she earned her Juris Doctorate. 

She also served as the Admissions Editor for The Elder Law Journal.

Previously, she was employed as a law clerk in Illinois and has helped co-author a law article with HeplerBroom partner Steven Wallace. 

Mary Beth Youngworth will focus on asbestos and toxic torts at the firm's Edwardsville office.

In 2016, she graduated with her Juris Doctorate from the University of Missouri School of Law. 

She also served in the United States Army, where she was an Attach Scout helicopter pilot. She has been awarded several medals for her work in the army. 

"The associates will be primarily assigned to a single practice group, but we do actively seek to have our new attorneys work in different areas to get a broad base of experience," HeplerBroom partner Troy Bozarth told the Record.

The new additions are no strangers to the HeplerBroom Law Firm family. All served as previous Summer Associates while completing their law school degrees.

"Summer associates at the firm rotate through various practice areas and offices during their summer with us," Bozarth said.

"This allows them to get a good feel for the practice of law and our firm. They are often able to observe and participate in hearings, depositions and even trials."

Bozarth added that having a new attorney who has completed the program is "helpful to both the firm and the potential employee."

Financing firm sues trucking company for alleged breach of contract

EDWARDSVILLE — First Midwest Equipment Finance is suing a trucking company and its owner for allegedly failing to make payments.

First Midwest Equipment Finance Co. filed a complaint on Dec. 2, in the Madison County Circuit Court against Wheeler Trailer Leasing Inc. and Brian Wheeler, alleging breach of contract.

According to the complaint, the plaintiff alleges that on Aug. 1, it executed an agreement with the defendants, whereby First Midwest agreed to finance equipment for Wheeler in an amount of approximately $340,000.

The plaintiff alleges the defendants failed to make payments for the amounts due and owing and wrongfully detained the financed equipment.

The plaintiff requests a trial by jury and seeks an order of replevin against defendants for the possession of the subject equipment, the value of the undelivered equipment and damages for the wrongful detention of the equipment.

Motorcyclist says motorist pulled out in front of him

EDWARDSVILLE — A motorcyclist claims a motorist negligently pulled out in front of him in Alton.

Joseph Richards filed a complaint on Dec. 5, in the Madison County Circuit Court against Michael Shore, alleging he breached his duty to exercise reasonable care in operating his motor vehicle.

According to the complaint, the plaintiff alleges that on Sept. 24, he was operating his Harley Davidson, traveling east on Broadway in Alton. At the same time, the defendant attempted to turn left from a private lane, causing Richards' motorcycle to strike Shore's vehicle.

As a result, Richards claims he sustained life-threatening injuries that caused him to suffer lost wages, medical expenses and loss of enjoyment of life.

Richards alleges Shore failed to maintain proper lookout, failed keep proper control of the vehicle and negligently pulled out into oncoming traffic.

The plaintiff requests a trial by jury and seeks compensation in an amount exceeding $50,000, costs for this action and all other relief as the court deems reasonable.

Making Madison County more transparent

During the campaign I promised to assist in making Madison County government more transparent. Therefore, I will provide periodic reports to the people concerning my work as your county board representative. I will submit reports to Advantage News, the Belleville News Democrat, Highland News Leader, The Pioneer, The Alton Telegraph for dissemination, WQQZ and this paper for dissemination.
County Clerk CDebbie Ming Mendoza swore me in on Monday, December 5, 2016 at my first County Board meeting. We will decide on recommendations to fill vacant board positions in the near future.
My major goals are to reduce the county portion of the property tax 10 percent, ensure transparency, promote greater fiscal responsibility and create jobs.
I’ve been selected to the following committees; Finance, Planning, Transportation, will chair Real Estate Committee and also serve on the Executive Committee. As a board member and as a chairman I seek to change the time and venue for some committees to make them more accessible to allow for greater public participation.
On December 6, 2016 I visited Major Brad Lavite at the VAC Office. I hope to ensure the best possible veterans services. We discussed the VAC budget. I support returning the VAC funds cut by the prior administration. Restored funds should be used to fill a veteran job counselor position helping veterans to find jobs.
I reached out to elected officials in effort to determine how I might best serve their people. I wish to thank Hamel Mayor Larry Boemler who provided an excellent synopsis of issues effecting his village. In addition, I will soon meet with Highland’s Mayor Michaelis and his staff to discuss issues of mutual concern. I hope to arrange meetings to speak with leaders in Grantfork, New Douglas, Prairietown, Williamson, and Worden to determine how I can best serve these geographical regions.
