Baricevic contributions to date largely from local lawyers

Local lawyers contributed $21,000 to the judicial campaign of St. Clair County Chief Judge John Baricevic from Sept. 22 through Oct. 7.  
Lawyers provided three fourths of the $28,000 he raised.  
Becker Hoerner, a Belleville firm that regularly represents the county in civil litigation, gave Baricevic $5,000.  
Gori Julian, which litigates asbestos suits in the circuit court, gave him $4,000.  
The firm of Armbruster Dripps gave him $1,000, as did the firm of Gori Julian and the firm of Weilmuenster and Keck.  
Tom Keefe III and the firm of Keefe, Keefe, and Unsell each gave him $1,000.  
Unsell, Schattnik and Phillips gave him $1,000, and Unsell, Schuman and Freeman gave him $1,000.  
The firm of Grey Chatham and Charles Baricevic, son of the chief judge, gave him $1,000.  
Ted Gianaris, of Simmons Hanly Conroy, gave him $1,000.  
Mathis, Marifian and Richter gave him $1,000.  
Law partners Jerald Bonifield and Jon Rosenstengel each gave him $1,000.  
Clyde Kuehn gave him $1,000.  
Baricevic also received $1,000 each from county board chairman Mark Kern, associate judge Christopher Kolker, the Casino Queen, James and Sandra McEvilly, and Mississippi Avenue Inc., of Sauget.  
Costello for Congress transferred $2,000 to Baricevic.

Applebee’s denies owning restaurant at location where woman alleges she was served food with broken glass

Applebee’s alleges it does not own a restaurant at the location an Alton woman alleges she was served a meal with broken glass.

Linda Harbaugh filed the complaint on Aug. 1 against Applebee’s Restaurant.

According to her complaint, she was a customer at the Applebee’s in Wood River on Aug. 30, 2014, when she was allegedly served shrimp scampi with broken glass.

Harbaugh alleges she injured her tongue and digestive tract when she ingested the pieces of glass.

She claims she has expended large sums of money for her hospital and medical treatment.

The plaintiff alleges the defendant failed to observe that broken glass was in its food preparation and failed to serve food that was fit for consumption.

Applebee’s answered the complaint on Sept. 16 through attorney Johnathon Brereton-Hubbard of the Law Office of McDonald & Bogdan in St. Louis, denying liability.

In its affirmative defenses, the defendant argues that it does not even own or operate a restaurant where the plaintiff alleged to have been injured.

Harbaugh responded to the affirmative defenses on Sept. 26 through attorney Bob Perica of Wood River. She denied the allegations.

The plaintiff seeks a judgment of more than $50,000, plus costs of the suit.

Defense attorneys instructed on lawfirm cyber security at IDC conference

Defense attorney Steven Puiszis instructed fellow litigators on how to tighten up cyber security in their firms, noting that law firms are a popular target for hackers.

Puiszis of Hinshaw Culbertson in Chicago presented on cyber security at the Illinois Associate of Defense Trial Council's Perspectives, Predictions & Pointers seminar on Sept. 29 at Busch Stadium in St. Louis.

He explained that when hackers can’t get through the fire wall of a business, they turn their attention to the law firms representing them.

“Our security defenses are weaker than our clients,” he said.

He called today’s online attacks a “cyber war,” saying businesses get hit with a new piece of malware every four seconds.

In fact, cyber crime is turning into a business.

“Hackers are actually selling malware to other hackers,” he said.

He added that 23 states have adopted a duty of technology competence, meaning firms are responsible for protecting their clients information from hackers.

So if firms make mistakes, “it’s going to come back to haunt us.”

He warned attorneys present at the conference that the way to get into a firm’s computers in through the attorneys themselves.

“Data breaches are typically the result of human error” instead of hacking, Puiszis said.

About 23 percent of employees who receive phishing emails end up opening them.

He added that it typically takes about 210 days before someone knows they’ve opened a phishing email. They are typically notified of the breach by law enforcement, who monitors the networks to see what information is being sold.

Puiszis said the average cost of a single data breach is approaching $5 billion.

“The fines that can be imposed are astronomical,” he said.

For example, he said a firm was hit with a $1.2 million fine when two computers were stolen and weren’t password protected.

“The smaller the device is, the easier it is to set it down or set it aside and forget about it,” they said.

One popular hacking method is through a cryptolocker, or ransomware, where hackers get in and encrypt documents and information. Then they send a note promising to send a key to the encryption in exchange for money. They essentially hold information ransom.

Puiszis said about 93 percent of phishing emails contain ransomware, which is on pace to become a $1 billion crime business this year by itself.

He added that hackers are getting creative. In one case, some hackers were having trouble getting through a firm’s firewall, so they attached malware on a local restaurant’s online menu and got in when employee’s ordered take-out.

Hackers also use something called “soft targeting,” where they pretend to be a law student with an attached resume, but the attachment is actually malware.

Puiszis said criminals will also pretend to be a company CEO or executive and ask for sensitive information, which is called a “whaling exploit.”

He also explained that one firm fell victim to hackers by using a fake public wifi network. The attorney tethered to the wifi, thinking it was legitimate, and a hacker was able to monitor his email. He ended up receiving alternate instructions for transferring a settlement. The attorney thought the instructions were coming from the other party, but they were coming from the hacker.

Puiszis gave attorneys 10 ways to recognize a phishing email:

1. Poor spelling and grammar
2. Offers too good to be true
3. Threat to take action if you don’t respond
4. Reference to a transaction you did not make or action you did not take
5. Requests for personal information
6. Mismatched URL embedded in the email text
7. Variation on domain of a known website
8. If it’s from a person or company you do know but aren’t expecting something from them
9. Emails from a government agency
10. Emails with warnings about a photo of you or suspicious transaction or promises of a prize or refund.

Justice Moore endorsed by state right-to-life groups; Says choice of life is 'worth the effort'

CARTERVILLE For Justice James “Randy” Moore, the right to life is more significant than simply a campaign issue. It’s core to his being.  
He and his family have always adhered to the pro-life stance. But their convictions were put to test when their daughter faced the prospect of becoming a single mother at a young age. Suddenly, they were confronted with a choice that involved their daughter’s future.
“We believed in life,” Moore told the Record. “Our response was we will love this child.”
With a strong family support system, Moore’s daughter went on to achieve big things including earning an MBA.
Moore and his wife cherish their grandson.
“He is very much a delight to our life,” Moore said.
Moore is running to fill a vacant seat on the Fifth District Appellate Court. He has served on the court since he was appointed in December 2014 by the Illinois Supreme Court after Justice Stephen Spomer retired. Now he’s running for the seat left vacant by James Wexstten, who retired before his term expired.
Issues concerning the right-to-life have been important to Moore for a long time. During his years as an attorney, he was quick to call legislators when abortion or life-related bills were being considered.
He’s been involved with pro-life groups in the state for years and supported pro-life candidates.
With fresh endorsements by the Illinois Federation for Right to Life PAC and Illinois Citizens for Life PAC, Moore said he was proud to inform voters on exactly where he stands.
“Justice Moore has been known to us for years, even before he was a judge, as a man who respects the sanctity of human life from conception to natural death,” Ralph Rivera, ICL-PAC chairman, said in an Oct. 5 news release.
Dawn Behnke, IFRL-PAC chairman, said in the release that Moore has “a proven record of dedication and commitment to the cause of life.”
The endorsements are important to Moore because he believes “life should be respected,” he said. “I think it informs voters that I have always stood for life even before I was a judge.”
Moore and his wife, Cindy, have been married for more than 40 years. They have eight children and 12 grandchildren. After receiving his law degree from Southern Illinois University, Moore worked as a sole practitioner in Carterville for 28 years. In 2007, he was appointed as a circuit judge. A year later, he was elected to the First Judicial Circuit covering the nine southernmost counties in the state. He successfully ran for retention in 2014.
He said being pro-life means being willing to put someone else’s welfare ahead of his own to help them as they make a difficult choice that, in the end, becomes a blessing. If his family’s experience has taught him anything, it’s that such a choice takes effort.
He knows the effort is worth it, he said. “I’ve lived it.”

EDWARDSVILLE — A woman diagnosed with acute myelogenous leukemia and her husband are suing several companies, alleging that they bear responsibility for her alleged exposure to benzene and benzene-containing products.

Montana residents Cynthia Davidson and David Davidson filed a complaint on Oct. 3 in the Madison County Circuit Court against 3M Company, Akzo Nobel Coatings, Inc., Akzo Nobel Paints, LLC fka The Glidden Company, Ashland Chemical Company, BP Amoco Chemical Company, BP Corp. North America, Inc., BP Products North America, Inc., BNSF Railway Company, Chase Products Company, Chevron U.S.A., Inc., CH2M Hill Engineers, Inc., f/k/a Lockwood Greene Engineers, Inc., Citgo Petroleum Corporation, Conocophillips, Co., E.I. According to the complaint, the plaintiffs allege that in 2014, Cynthia Davidson was diagnosed with acute myelogenous leukemia that they attribute to benzene exposure. The plaintiffs hold the defendants responsible for allegedly failing to implement proper safety measures.

The plaintiffs seek judgment against the defendants for compensatory damages in an amount in excess of $50,000 plus court costs and any further relief this court grants. Audra Barnes filed a complaint in St. Clair County Circuit Court against Wal-Mart Stores Inc., alleging that the retail store operator breached its duty to exercise reasonable care.

According to the complaint, the plaintiff alleges that on Sept. 21, 2014, she was returning to her vehicle after shopping at Wal-Mart when her foot slipped into a pothole in the parking lot, causing her to fall and sustain injuries that resulted in medical expenses, pain and suffering and lost wages.

Barnes alleges the defendant allowed the dangerous condition to exist on its premises and failed to repair the pothole.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, plus costs for this action and any other relief the court deems proper. She is represented by Paul J. Evans and Benedict Young of Evans Law Firm PC in O'Fallon.

EDWARDSVILLE — A passenger alleges injuries when the vehicle she was riding in struck a fallen tree.

Debra Simmons, as guardian and next friend of Lisa Lynn Newbury, filed a complaint on Sept. 29 in the Madison County Circuit Court against Jeanne Lee Newbury, the City of Edwardsville and Richard's Brick Company Inc., alleging negligence and insufficient measures taken to prevent injuries.

According to the complaint, the plaintiff alleges that on Sept. 22, 2014, Lisa Lynn Newbury was a passenger in a vehicle driven by Jeanne Lee Newbury on Highway 143 in Edwardsville when a tree on the property of Richard's Brick Company fell onto the road. Jeanne Lee Newbury struck the tree, severely injuring Lisa Lynn Newbury.

The plaintiff alleges the defendants breached their duty and failed to exercise reasonable care.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of $50,000, plus costs of suit. She is represented by Thomas G. Maag of Maag Law Firm LLC in Wood River.

People Against Dirty Manufacturing PBC accused of false all natural label

BELLEVILLE — A woman has filed a class-action lawsuit against People Against Dirty Manufacturing PBC, a cleaning products manufacturer, citing alleged deceptive and unfair business practices over its all natural label.

Gayle Greenwood filed a complaint in St. Clair County Circuit Court against People Against Dirty Manufacturing PBC, alleging the cleaning products manufacturer violated the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, the plaintiff alleges that in March she purchased defendant's Method Power Foam Dish Soap Natural Dishwashing Foam after seeing that it had an all-natural label. However, she claims the product is not all natural or naturally derived.

Greenwood alleges she suffered damages for paying a premium price for the product. The plaintiff alleges the defendant claimed that its products are all natural and/or naturally derived and deceived customers into believing that its products include only natural ingredients, when in fact they don't.

The plaintiff requests a trial by jury and seeks certification of this case as class action. an injunction against the defendant's alleged ongoing deceptive practices, an award for declaratory and injunctive relief, an appointment of the plaintiff as class representative and her counsel as class counsel, and for all other relief as may be just and proper. Shopper alleges injuries from slip and fall at Wal-Mart

BELLEVILLE — A woman claims she was injured when she slipped and fell on water while entering a Wal-Mart store.

Raghda A. Salah filed a complaint on Sept. 9, in the St. Clair County Circuit Court against Wal-mart Stores Inc., Donald E. Bremer and Courtnie Springman, retail store operators, alleging that they negligently allowed the existence of the dangerous condition.

According to the complaint, the plaintiff alleges that on Sept. 10, 2014, she was entering the defendants' premises with the intent to shop when she allegedly slipped and fell due to a liquid substance on the floor.

She alleges she sustained serious injuries that resulted in physical pain, mental anguish, disfigurement, loss of earning capacity and medical related expenses.

The plaintiff alleges the defendants failed to warn patrons of the hazard and failed to remove the dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against defendant Wal-mart store in a sum in excess of $50,000. She is represented by Lea A. Captain of Cook, Ysura, Bartholomew, Brauer & Shevlin Ltd. in Belleville.

Eye witness accounts vary in Caseyville mayor death threat case; Judge: 'Appears to be war of words'

In three accounts of the crime Brad Van Hoose of Belleville allegedly committed, he threatened to kill Caseyville Mayor Leonard Black, or to kill Black and Illinois House candidate Bob Romanik, or to kill everyone.  
Van Hoose faces trial on Nov. 3, on a felony charge of threatening a public official.
Records that special prosecutor David Rands produced to him show that Caseyville detective Andy Reel trusted Black’s reaction more than his memory.  
Records also show how Black’s story has shifted and how Romanik’s role has grown.  
Black called Caseyville police on Friday, April 15.  
Detective Andy Reel questioned Black and wrote in an incident report that, “Black was meeting Robert Romanik for coffee at the South Main Diner when Bradley Van Hoose began yelling and cussing at Leonard and Robert.”  
“Bradley got on his motorcycle and yelled, ‘I’m going to kill everyone,’” Reel wrote.  
Reel didn’t report whether Black heard the words, or Romanik, or both.  
“Leonard stated that he is in fear for his life,” Reel wrote. “Leonard is not sure what Bradley is capable of.”  
Later that day he wrote in a preliminary report that Black said Van Hoose told him he was going to kill him.  
Reel wrote that Romanik said he observed Van Hoose yelling at Black, and that Van Hoose yelled at both of them that he was going to kill everyone.  
Black prepared a petition for an emergency protective order.  
“Began yelling and cursing me,” Black wrote. “Yelled I’m going to kill everyone.”  
His petition didn’t identify Romanik or anyone else as a witness.  
On Monday, April 18, Associate Judge Julie Hormberg denied the petition.  
Reel interviewed Black again on Tuesday, April 19.  
“Leonard stated that Brad said he was going to kill both of them,” Reel wrote. “Leonard is concerned that Brad is going to harm him and his family.”  
Reel wrote that Black wished for charges to be filed.  
The interview lasted 20 minutes.  
Reel interviewed Romanik later that day, and Romanik took charge as star witness.  
“Robert did not see the initial confrontation with Brad and Leonard,” Reel wrote.   
That didn’t match Black’s statement to Reel on the previous Friday, that Van Hoose began yelling at both of them.  
Romanik scrapped Black’s statement that Van Hoose threatened to kill everyone, and he substituted direct personal threats.  
“Robert heard Brad say, ‘I will kill you, Leonard Black,’” Reel wrote.   
“Brad saw Robert. Brad said, ‘I will kill you too.  
“Brad said, ‘Do not talk about me on the radio. I will kill you.  
“Robert stated that Brad is a bully.”  
Romanik told Reel he is aggressive on radio but not that way in public.
  The interview lasted 52 minutes.  
On Thursday, April 21, diner employee Sherry Robinson told Reel she overheard Romanik say, “What is that guy yelling about?”  
Robinson told Reel that Romanik said that guy just threatened to kill them.  
Reel wrote that she didn’t know the individual and she heard no threats.  
Reel also interviewed Robert Ebner, owner of Jessi’s bar behind the diner.  
Ebner said Van Hoose was a patron, and he remembered him leaving the bar.  
“Bob did not observe the incident,” Reel wrote.   
On Sept. 23, grand jurors indicted Van Hoose on a felony charge of threatening a public official.  
At his arraignment on Sept. 30, Chief Judge John Baricevic said, “It appears to be a war of words at this point.”

State Farm asks Seventh Circuit for review of $7.6 billion certification out of Herndon court

CHICAGO – State Farm has asked Seventh Circuit appellate judges to review certification of a $7.6 billion class action over its role in the election of Illinois Supreme Court Justice Lloyd Karmeier 12 years ago.  
State Farm petitioned the Seventh Circuit for permission to appeal on Sept. 30, two weeks after District Judge David Herndon of East St. Louis certified a class.  
Plaintiffs claim State Farm secretly supported Karmeier in order to overturn a $1 billion verdict that their class had won in Williamson County.  
State Farm’s petition challenges federal jurisdiction, calling the case an attack on the state judiciary.  
“This is the same class that the Illinois Supreme Court unanimously held was not certifiable as a matter of law,” Ronald Safer of Chicago wrote.  
Safer wrote that the damages are the exact amount of a judgment that the Illinois Supreme Court vacated, with interest and tripling of damages.  
“The only way that plaintiffs were injured by exactly that amount is if the Illinois Supreme Court’s decision to decertify the class was wrong,” he wrote.   
“That the requested remedy is the same is a clear demonstration that the federal suit would effectively overturn the Illinois Supreme Court decision.  
“The claims thus directly question the integrity of Justice Karmeier, soon to be Chief Justice, and the Illinois Supreme Court.”  
The original case started in 1997, on behalf of policyholders claiming they received inferior parts for crash repairs.  
Lead plaintiff Michael Avery prevailed at jury trial in 1999, and associate judge John Speroni awarded more than $1 billion to almost five million individuals.  
Fifth District appellate judges in Mount Vernon affirmed Speroni in 2003.  
Fifth District voters elected Karmeier in 2004.  
In 2005, the Illinois Supreme Court reversed Speroni.  
All seven Justices held that he shouldn’t have certified a class, although two would have remanded the case to Speroni for possible creation of subclasses.  
Avery asked the U.S. Supreme Court for review, and the Court denied it.  
In 2011, Avery’s lawyers asked the Illinois Supreme Court to recall the mandate, claiming they possessed new evidence of improper activity by State Farm in 2004.  
The Justices denied the motion, and Karmeier did not participate in the decision.  
In 2012, Mark Hale of New York state filed a racketeering suit against State Farm in U.S. district court, as a member of the Avery class.  
He also sued State Farm employee William Shepherd and Illinois Civil Justice League director Ed Murnane.  
State Farm moved to dismiss the action, and Herndon denied the motion.  
State Farm moved for reconsideration, and Herndon denied it.  
State Farm petitioned the Seventh Circuit for a writ of mandamus to halt the proceedings, and the Seventh Circuit denied the petition.  
Last year, Herndon ruled that plaintiffs could depose Karmeier.  
No trace of the deposition has reached public record, not even the date.  
Karmeier didn’t appeal Herndon’s authority but now State Farm does.  
Safer wrote that plaintiffs raised the issue of Karmeier’s recusal four times at the Illinois Supreme Court and once at the U.S. Supreme Court, without success.  
“Plaintiffs treat causation as a common issue only by effectively eliminating the causation requirement entirely, arguing instead that the alleged tainting of the tribunal suffices,” Safer wrote.  
“But this theory has no legal basis.  
“Review is warranted now because the astronomical damages sought and the need for individual assessment of injury and damages make it possible that the case will never reach a final judgment.  
“Moreover, this case is an attack on the integrity of the Illinois Supreme Court, and it should not proceed when lack of jurisdiction and errors on class certification are so apparent.”  
On the day State Farm filed the petition at the Seventh Circuit, it asked Herndon to stay discovery on the class notice and to stay the notice itself.  
On Oct. 10, class counsel Elizabeth Cabraser of San Francisco told Herndon that Hale didn’t oppose a stay if it expired at least six months before trial.  
She wrote that fact discovery is not complete, expert discovery has not started, and a trial date has not been set.

St. Louis County residents seek damages from lawyers in 22-count claim

EAST ST. LOUIS — Two residents of St. Louis County are suing a lawyer and his firm based in Effingham County; two lawyers based in Las Vegas, Nevada; and the Law Vegas lawyers' firm, with a range of allegations that vary among the defendants.

The defendants variously face different accusations that include fraud, fraudulent misrepresentation, conspiracy, assisting in theft, unauthorized practice of law, violation of deceptive business practices law, intentional infliction of emotional distress, negligent infliction of emotional distress, blackmail, extortion, coercion, defamation, intentional interference with a prospective economic advantage, mail fraud, negligent supervision and breach of contract.

Scott Jenkins and Rhonda Stephanie Alexandroploulos filed a complaint on July 14 in the U.S. District Court for the Southern District of Illinois against lawyer Bruce Burkey and the Taylor Law Firm PC of Effingham County, and against Las Vegas lawyers Joice Bass and Jennifer Hostetler and the Lewis Roca Rothgerber LLP law firm of Las Vegas, alleging a range of accusations. During the relevant times, the suit states, Jenkins was the manager of CSRESL LLC, a registered entity in Nevada, headquartered in St. Charles, Missouri, and doing business in Missouri and Illinois.

According to the complaint, the plaintiffs allege that Burkey, as part of an attempt to have control of the Nevada LLC turned over to Jenkins' daughters, drafted a fraudulent Nevada legal document citing a nonexistent Nevada statute to remove Jenkins from his position, and they also allege that Burkey submitted fraudulent documents to the Nevada Secretary of State's Office with the same goal. The plaintiffs also allege that Burkey possessed private emails between Jenkins and a Denver law firm in an unrelated matter, which they allege were used by Burkey in an attempt to convince one of Jenkins' daughters to go against her father, and that he gained access to Jenkins' private credit report, which he allegedly used in an effort to motivate Jenkins' daughters that their father was in bad financial shape.

The plaintiffs allege that Bass and Hostetler wrote threatening letters and emails and that Hostetler breached a confidential settlement agreement.

On each of 22 counts, the plaintiffs are seeking damages of $75,000 plus costs.
