Lawyers at odds over Restatement of Law covering liability insurance

PHILADELPHIA - Insurance and business defense attorneys are sparring with the drafters of a powerful legal document that will influence the outcome of insurance liability cases.
The lawyers contend that the document, “Restatement of Law, Liability Insurance,” by the Philadelphia-based American Law Institute (ALI) will increase litigation, open the door for punitive damages against insurers, and lead to higher insurance premiums.
But, University of Pennsylvania law professor Tom Baker, one of two reporters (authors) on the project, said that the impact on price is going to be very difficult to “tease out.”
“We will be seeing a hard market in liability insurance within the next few years,” Baker said, “meaning that liability insurance prices will increase significantly – for reasons that have nothing to do with the Restatement. When that happens, people will point fingers in lots of directions.”
The ALI began the process four years ago as “Principles of the Law of Liability Insurance,” a declaration covering shortcomings in current law – where the law should be. A year and a half ago, the project was converted to a Restatement, a document intended to reflect common law, and used by judges as a guide, particularly when existing law is unclear.
Critics say that the drafts of the chapters (the fourth and final chapter was released on Sept. 12) contain too many provisions that are still aspirational, rather than a pure accounting of the law.
“There are sections in the drafts not found anywhere in the law,” said Laura A. Foggan, partner at Wiley Rein in Washington.
She points to Section 13, for instance, that says an insurer must defend any time an allegation in the legal action would be proven. It allows only three limited exceptions. The problem, Foggan says, is that other facts exist outside the complaint that have noting to do with the insured’s liability and the underlying claim, which the insurer should be allowed to consider. In these instances, the insurer would have to file a separate lawsuit that it has no duty to defend.
“The Reporters suggest their way is better than the way it works now, because there is ‘judicial supervision’ of the insurers’ decision whether to defend a policyholder,” Foggan said. “It would be similar to consumer law requiring a car rental company to get court approval to show there are no added fees before charging your credit card.”
Another Section, 19, states that an insurer that breaches the duty to defend “without a reasonable basis” loses the right to contest coverage for the action. The ALI said that the language adopts a “middle ground,” and is consistent with the rule that an insured is entitled to extra-contractual damages where the insured has acted in bad faith.
But the rationale disregards judicial findings, according to David G. Harris II, partner at Goldberg Segalla in St. Louis.
“The ALI fails to recognize that the majority of jurisdictions to have addressed the issue have held that an insurer does not automatically forfeit its coverage defenses if it is found to have wrongfully breached its duty to defend,” Harris said.
Of particular concern to insurance and business defense lawyers is the broadening of bad faith claims, and the proposed standard for and ready availability of punitive damages.
“If punitive damages are to be provided, the threshold for punitive damages plainly must be higher than that for other relief,” Foggan said. “While the Reporters purport to agree, I'm not convinced their standard for punitives accomplishes this important objective. Unless there are greater safeguards against their award, punitives will encourage unnecessary litigation for 'bonus" amounts and chill desirable (cost-saving and economically preferable) conduct by insurers.”
She added several states and the District of Columbia don’t allow punitive damages in insurance bad faith cases at all. Many states require deliberate misconduct demonstrating oppression, fraud, wantonness or malice.
“Under Section 53, at a minimum the Restatement should require proof of extreme deviation from reasonable conduct to justify punitive damages, instead its standard seems very loose,” she said.
At ALI’s 2016 annual meeting in May, the Reporters presented Tentative Draft No. 1, containing Chapter 1 on Basic Liability Insurance Contract Rules, Chapter 2 on Management of Potentially Insured Liability Claims, and Chapter 3 on General Principles Regarding the Risks Insured. Chapter 4 covers Remedies: Bad Faith and Punitive Damages.
In a meeting scheduled for Oct. 6- 7, ALI members plan to discuss preliminary Draft No. 3.
A final document isn’t expected until summer 2017, and could be delayed beyond that.
Noted civil justice reform attorney, Victor E. Schwartz, partner at Shook Hardy & Bacon in Washington, said that over the course of the project, the Reporters have added some balance, “especially where there has been no existing case law support for their position.”
“But there is still a long way to go to achieve a project that all would agree treats insurers equitably, is sensitive to the cost of insurance, and follows the most sound legal rules,” he said.

Mother alleges hospital failed to provide HSV treatment for newborn

BELLEVILLE — An Illinois mother is suing Maryville health care providers, alleging their negligence caused injuries to her newborn son. 

Phylica Lang, as parent and natural guardian of Kamden Durnell, a minor, filed a complaint Aug. 12 in St. Clair County Circuit Court against Dr. Christina L. Midkiff and Southwest Illinois Health Facilities Inc., doing business as Anderson Hospital in Maryville. Lang alleges the defendants negligently failed to screen and take appropriate measures to monitor Durnell for the herpes simplex virus (HSV) infection.

According to the complaint, on Oct. 22, 2015, Kamden Durnell was born and infected with HSV. As a result, the suit says, he suffered brain damage, permanent pain, disability, loss of future life, and Lang incurred large sums for medical treatment and care. 

The plaintiff alleges the defendants negligently failed to prescribe or recommend anti-viral medication or other appropriate treatment so as to protect the infant against the spread of HSV.

Lang seeks trial by jury, judgment of more than $75,000, plus costs of suit. She is represented by attorney Thomas Q. Keefe of Keefe, Keefe & Unsell PC in Belleville.

Supreme Court finds 6-person jury law unconstitutional

The Illinois Supreme Court on Thursday unanimously found that a statute signed into law by former Gov. Pat Quinn which limited jurors in civil trials from 12 to six is unconstitutional.

Chief Justice Rita Garman wrote the court's opinion, citing transcripts from debates of the state's 1970 constitutional convention showed that drafters "did not believe the legislature had the authority to reduce the size of a jury below 12 members and the drafters did not act to give the legislature such power."

The high court's 5-0 decision affirms Cook County Circuit Court Judge William Gomolinski who on Dec. 21, 2015, overturned Public Act 98-1132, finding that the law violated the separation of powers between the legislature and the judiciary.

Garman wrote that the court has "long included the 12-person size of a jury within its descriptions of the essential features of a jury trial."

She declared the entire act - which also included provisions for raising juror pay - to be invalid.

Justices Thomas Kilbride and Robert Thomas did not take part in the decision.

Democrat Quinn signed the bill in the waning days of his administration after losing to Republican Bruce Rauner in November 2014.

Republican lawmakers had opposed the measure, with one calling its enactment Quinn's "parting gift" to the Illinois Trial Lawyers Association. The organization, which lobbies for attorneys who commonly represent injury plaintiffs, was a strong proponent of the measure.

Injured Illinois workers take 50 percent more time off than peers in surrounding states

The Illinois Workers’ Compensation Commission’s 2015 annual report reveals that injured workers in Illinois spend an average of 50 percent more time off work than their counterparts in Indiana, Wisconsin, Michigan or Iowa. The report points out that total temporary disability claims in Illinois are for longer periods of time than those in most states covered in the study. The average time off work for a temporary injury is 18.4 weeks in Illinois, compared with 15.7 weeks in Michigan, 11.6 weeks in Iowa, 10.9 weeks in Wisconsin, and 10.5 weeks in Indiana.

This deserves attention not only because unnecessary time off work is a major cost driver for businesses and governments, but also because the long-term health of both workers and businesses is at stake. A look at two aspects of Illinois’ workers’ compensation system reveals how bad policies keep workers off the job longer in Illinois.

Illinois law gives some workers an effective pay hike when they are on workers’ compensation

Some workers in Illinois receive more take-home pay when they are injured than when they are working. Under workers’ compensation in most states, an injured worker usually receives two-thirds of his lost wages as a wage-replacement benefit. These benefits are untaxed at both the state and federal levels, so a worker who makes $3,000 per month before taxes will receive a workers’ compensation benefit of $2,000 per month, but will owe no federal or state taxes on that benefit.

What’s unusual in Illinois is that certain groups of workers receive 100 percent of their lost wages as a workers’ compensation benefit even though that income is untaxed. This creates an effective pay increase for some on workers’ compensation.

For example, the 2005 legislation signed by former Gov. Rod Blagojevich created an after-tax pay bump for lower-wage workers by raising the minimum wage-replacement rate. A worker earning no more than $220-$330 per week (depending on the number of dependents) gets all of his lost wages replaced untaxed, even if he is only a part-time worker. This creates a financial incentive for lower-wage earners to remain on workers’ compensation because they get more take-home pay and aren’t required to work.

In addition, Illinois’ Public Employee Disability Act provides that police and firefighters receive their full salaries for up to one year when they are injured. This full salary is also untaxed, meaning police and firefighters receive an effective pay bump for being injured.

This is not to say that policy should be drastically changed to put low-wage workers and public safety workers under duress when they are injured. Rather, they should simply be treated more like other injured workers. Even researchers from the Social Security Administration point out “the effect of a minimum benefit can be to ‘overcompensate’ low-wage workers in some cases.” When there is a greater financial benefit to staying home than there is to going to work, injuries in Illinois will result in more time away from the job.

Physician dispensing results in more time off work in Illinois

Another way state law causes injured workers to take more time off work is by allowing physicians to profit by dispensing drugs directly to their patients. Research by Johns Hopkins University medical scholars has shown that when doctors have a financial incentive to prescribe more medications – such as by selling the drugs they prescribe directly to patients – workers end up receiving more drugs and spending more time off work. Illinois doctors prescribe 3.2 times more medication when they sell those drugs directly to workers’ compensation patients than when a pharmacist sells the drugs prescribed. In such cases, workers spend 33 percent more time off work when the prescription is for non-opioid pharmaceuticals, and 85 percent more time off work when the prescription is for opioid painkillers.

Other states have previously dealt with this problem. When Florida banned physician dispensing of strong opioids in 2011, doctors became much less likely to prescribe them. In fact, the frequency of opioid prescriptions fell by 87 percent after the Florida law eliminated the profit motive inherent in physician dispensing. Texas and Indiana have enacted similar restrictions, with Texas outright banning physician dispensing except in rural areas with few pharmacists, and Indiana limiting physician dispensing to the first eight days after an injury.

Illinois’ comparatively longer time off work for workplace injuries needs to be studied further, as there are likely more causes then the two described here. Unnecessary time off is bad for both workers and employers, and the harmful incentives in the law hurt Illinoisans. Workers’ skills can diminish when time off drags on, which hurts workers’ long-term prospects. And when doctors dispense the drugs they prescribe, workers tend to receive more drugs, and more potentially addictive drugs, than they would otherwise. It’s also a bad deal for employers because businesses and taxpayers have to cover the cost of poorly crafted public policy.

Fifth District affirms Judge Chapman’s order enforcing settlement agreement in dispute over Lake of the Ozarks property

The Fifth District Appellate Court affirmed Madison County Associate Judge Thomas Chapman’s order enforcing a previous consent order regarding property in Lake of the Ozarks.

Justice Judy Cates delivered the Rule 23 decision on Sept. 21 with Justices Thomas Welch and Richard Goldenhersh concurring.

The appellate court concluded that Chapman did not err in granting defendants Gary and Davi Claxton’s motion and ordering plaintiffs Richard and June Gross to sell a Lake of the Ozarks property to the defendants for the appraised value in accordance with the settlement.

The parties entered into a contract for deed on Nov. 1, 2004, where the plaintiffs agreed to sell their vacation home at the Lake of the Ozarks to the defendants for $300,000.

According to the contract, the defendants were required to provide $10,000 in earnest money and then make $1,000 payments per month for five years with a final balloon payment on Dec. 1, 2009.

However, during the fall of 2009, the defendants found that they could not make the final balloon payment of approximately $276,000.

The plaintiffs agreed to extend the contract until Dec. 1, 2010.

The defendants made their monthly payments for the year but, again, found that they could not make the final balloon payment.

The plaintiffs were unwilling to provide another extension, so they served the defendants with a notice of default and intent to declare a forfeiture on Dec. 7, 2010.

Then in February 2011, the plaintiffs filed a complaint against the defendants for breach of contract, conversion and fraud.

In May 2011, the plaintiffs filed a motion to restore to themselves immediate possession of the property.

The defendants replied with a motion to compel the plaintiffs to accept a payoff of the balance after they obtained a loan to pay the full remaining balance of the home.

However, the plaintiffs refused to accept the payoff.

The defendants also alleged they had a verbal agreement with Gary Prewitt, a local business owner, to purchase the property for $550,000, but he failed to complete the purchase after the plaintiffs contacted him. They claim they would have been able to pay off the contract if the plaintiffs hadn’t interfered with negotiations.

They later filed a counterclaim against the plaintiffs alleging tortious interference with a business expectancy.

On Oct. 26, 2011, the parties reached a settlement. They agreed to “use their best efforts” to sell the property for a minimum of $600,000. If the property didn’t sell, then the plaintiffs agreed to allow the defendants to purchase the property for the appraisal price.

Prewitt made several offers below the asking price, which the defendants refused to accept.

By Aug. 3, 2012, the plaintiffs filed a motion to vacate or modify the settlement agreement. They argued that while Prewitt’s offers were below the asking price, they exceeded the appraised value.

They claim the defendants “fraudulently concealed their bad faith intention to reject bona fide contract offers, knowing that if bona fide offers were rejected, a provision in the consent order would allow them to purchase the property for the appraisal price, and thereafter sell the property at a substantial profit, without having to share any profits with the plaintiffs.

The circuit court denied their request.

Then on Dec. 10, 2014, the defendants filed a motion to enforce the consent order, requesting the court to order the plaintiffs to accept the appraisal price of $200,000 for the property.

The plaintiffs argued that the appraisals obtained by the parties did not represent the true market value of the property. Instead, they argue that Prewitt’s offers reflect the true market value for the property and that the defendants acted in bad faith in rejecting the offers.

On March 12, 2015, the court found that the parties were unable to sell the property at the agreed upon sale price of $600,000. Further, the $200,000 appraisal was less than the contract balance owed to the plaintiffs, and that under the terms of the consent order, the defendants were required to pay $200,000 to the plaintiffs.

“The court determined that the consent order was not procedurally or substantively unconscionable, and that there was no bad faith,” the appellate court wrote.

As a result, the circuit court granted the defendants’ motion to enforce the consent order and upon tender of $200,000, the plaintiffs were to execute and deliver a warranty deed for the property to the defendants.

The plaintiffs appealed.

The appellate court agreed with the circuit court’s ruling.

“In this case, the plaintiffs have not established that the enforcement of the consent agreement was unconscionable, or that the defendants acted in bad faith in rejecting Gary Prewitt’s offers to purchase the property,” Cates wrote.

“Perhaps, both parties overestimated the actual value of this property to Gary Prewitt, or the market value to another qualified buyer. Even so, the value was a known variable to the parties when they negotiated the settlement and entered into the consent order, and that variable, with attendant risks, does not render the enforcement of the consent order unconscionable,” she continued.

Prenzler moves for new trial in discrimination suit brought by former employee; Jurors awarded $658K in February

BENTON – Madison County Treasurer Kurt Prenzler has challenged a verdict of federal court jurors who awarded $450,000 to former county comptroller Linda Dunnagan in a disability discrimination suit.
County counsel John Gilbert, on behalf of the treasurer’s office, moved for judgment as a matter of law or for a new trial on Sept. 13.
"Temporarily taking time off work due to an illness does not establish a disability,” he wrote.
Dunnagan sued Prenzler’s office in 2014, after he eliminated her position.
District Judge Staci Yandle held trial over three days in February.
After jurors rendered the verdict, Gilbert moved to reduce it.
For Dunnagan, Lee Barron and William Buchanan of Alton moved to award wage losses, legal fees and court costs.
In July, Yandle awarded Dunnagan $80,090.61 in wages, $125,440 in fees, and $3,368.16 in costs.
That raised the judgment to $658,898.77.
Now Gilbert asks her to clear Prenzler or try the case again.
“Not every person with an illness or chronic disease will necessarily be considered disabled under the Americans with Disabilities Act," he wrote.
“No medical evidence showed plaintiff was ever substantially limited in her ability to work.
“She also failed to show an illness limiting her ability to work for more than a short period of time.
"When she returned to work, she was not substantially limited and was fully released to work with no restrictions.”
He wrote that Dunnagan, her spouse, her supervisors and other employees all believed that when she returned she could perform all the tasks of her job.
He wrote that no one regarded her as disabled, and that she presented no evidence that Prenzler said or did anything indicating that he believed she was disabled.
Dunnagan’s response will come due on Oct. 17.

Insurance provider alleges construction business owes $229,000

EDWARDSVILLE — An insurance provider is suing an Illinois construction company, alleging it owes more than $229,000. 

Technology Insurance Co. filed a lawsuit Sept. 12 in Madison County Circuit Court against Oasis Construction Inc. of Troy, alleging failure to comply with the provisions of the workers compensation insurance policy.

According to the complaint, in 2016, Technology Insurance suffered monetary damages for not collecting payment for the defendant's premium in the amount of $229,052. The plaintiff alleges Oasis Construction has refused and continues to refuse to make payment for the insurance premium that is due.

Technology Insurance seeks trial by jury, judgment of $229,052, plus court costs. It is represented by attorney Michael S. Baim of The CKB Firm in Chicago.

State Farm alleges damages to leased Cottage Hills home

EDWARDSVILLE — State Farm is suing two Illinois residents, alleging their negligence caused damage to Cottage Hills property they were leasing.

State Farm Fire & Casualty Company, acting for Kenny & Lori Herrin, filed a lawsuit Sept. 12 in Madison County Circuit Court against John Louis Piper Jr. and Amy Rice, alleging the defendants negligently cooked methamphetamine on the Herrins' premises.

According to the complaint, on Feb. 10, 2013, the Herrins leased the Cottage Hills property to Piper. The suit says, on that date, the defendants were cooking methamphetamine when the home caught fire. 

The lawsuit states the fire caused $91,730 in damages. The plaintiff alleges Piper and Rice failed to act in a reasonable manner for the safety of other people's property.

State Farm seeks trial by jury, judgment of $91,730, together with court costs. It is represented by attorney Harry Ray Chiles Jr. of Harry Chiles & Associates in Wheaton.

Ship repairman alleges shipyard owner's negligence caused amputation

EDWARDSVILLE — A ship repairman is suing a Hartford shipyard owner, alleging the defendant's negligence led to the plaintiff's right hand being amputated. 

Rodger A. Radcliff, III filed a lawsuit Sept. 9 in Madison County Circuit Court against National Maintenance & Repair Inc. alleging failure to provide a reasonably safe place to work.

According to the complaint, on April 12, while Radcliff was performing repairs on a ship's engine at the defendant's shipyard in Hartford, his right hand was caught in a milling machine and was amputated. 

As a result, the suit says, Radcliff has suffered permanent injuries, lost wages and earning capacity, physical pain and mental anguish and medical care and treatment. The plaintiff alleges the defendant failed to provide adequate training, failed to inspect the hazards in the work area, failed to provide safe tools and equipment and failed to provide maintenance and cure.

Radcliff seeks trial by jury, judgment in an amount that is fair and sufficient under the circumstances, plus costs of suit and all other relief as justice requires. He is represented by attorney Matthew R. Chapman of Becker, Schroader & Chapman PC in Granite City.

Dentist sued after patient allegedly contracts herpes virus from contaminted tools

EDWARDSVILLE — A woman claims her daughter contracted the herpes simplex Type 1 virus from contaminated dental tools during a routine dental exam.

Jane Doe, as a natural mother and next friend of Mary Doe filed a lawsuit Sept. 13 in Madison County Circuit Court against Dr. Kelli Blank, alleging the dentist failed to exercise requisite standards of care in the treatment of her patient.

According to the complaint, on April 14, 2015, Mary Doe visited Blank for a routine dental exam when she was contaminated with the herpes simplex Type 1 virus. As a result, the suit says, Mary Doe has sustained serious injuries causing her great pain, suffering, disability and embarrassment. 

The plaintiff alleges Blank failed to assure that all her equipment was free from contamination and failed to assure that her staff were properly educated as to sanitation practices.

Jane Doe seeks trial by jury, judgment of more than $50,000, and costs as provided by law. She is represented by attorney John J. Hopkins of John J. Hopkins & Associates PC in Alton.

Substitute of attorney granted for Wal-Mart in Byron's suit alleging injury from saddle stool

The O’Hagan Meyer firm withdrew as counsel for Wal-Mart in former Madison County Circuit Judge Nicholas Byron’s suit alleging he was injured when he fell off a pre-assembled saddle stool.

Nyhan, Bambrick, Kinzie & Lowry of Chicago is now representing Wal-Mart in the case. The firm entered its appearance on Sept. 20.

Byron filed suit on Oct. 8 through attorney Eric J. Carlson of Byron, Carlson, Petri and Kalb in Edwardsville. He alleges that on Dec. 17, 2013, he was seated on the 24-inch stool in his home when it allegedly collapsed, causing him to injure his ribs and tailbone area. As a result, he claims he development an open sore.

He claims he purchased the stool from the Glen Carbon Wal-Mart.

Byron claims his injuries resulted in significant medical care and treatment, severe pain, disfigurement and loss of a normal life.

He alleges the stool was unreasonably dangerous in that it lacked adequate fasteners or hardware, was improperly assembled and was more dangerous than an ordinary consumer would expect.

He seeks more than $50,000 in damages.

Wal-Mart previously answered the complaint on June 13, arguing that Byron “understood and appreciated the risk of injury from the failure to properly use and inspect the stool and he accepted and assumed all risks therefrom.”

Man seeks default in discrimination suit against Madison County Kid’s Corner

A man alleging The Madison County Kid’s Corner discriminated against him because of his gender seeks a default judgment.

Plaintiff James Agee filed a motion for default on Sept. 14 through attorney Thomas Maag of the Maag Law Firm in Wood River.

Agee argues that Madison County was served more than 30 days ago and has failed to appear or plead in the case. He seeks an order of default.

Agee field his complaint on June 13 against Madison County, operator of The Madison County Kid’s Corner.

In his complaint, Agee claims he was forced to sit and wait for 30 minutes each time he exchanged custody of his child.

He alleges Madison County failed to provide neutral treatment, including a “first-in first-out rule.”

He seeks an order enjoining the defendant from engaging in discrimination, plus attorney’s fees, costs and other relief the court deems just.

Patient voluntarily dismisses suit alleging breast implants migrated four times

Madison County Circuit Judge William Mudge granted voluntary dismissal in a lawsuit alleging a cancer patient's breast implants migrated multiple times after four surgeries.

On Sept. 8, plaintiff Eileen and Richard Dawdy filed a motion to voluntarily dismiss defendant Hania Bednarski, individually and doing business as Serenity Surgery.

Mudge granted dismissal without prejudice on Sept. 19.

The Dawdys filed the complaint on June 14, alleging Bednarski failed to properly perform the breast implant surgery after Eileen Dawdy’s battle with cancer.

According to the complaint, the Dawdys allege that over the course of 2014 and 2015, Eileen Dawdy underwent four surgeries performed by Bednarski. She claims the breast implants migrated after each surgery.

The plaintiffs allege the defendant failed to use tissue expanders in order for the breast implants to remain in the correct position.

They seek judgment in an amount in excess of $50,000, plus court costs.

The Dawdys are represented by Matthew Chapman of Becker Schroader & Chapman in Granite City.
