No layoffs planned at St. Clair County Circuit Clerk Office

BELLEVILLE – Despite rumors to the contrary, the St. Clair County Circuit clerk says there will be no layoffs at her office.

St. Clair County Circuit Clerk Kahala Clay told the Record that no one in her 62-person office will be losing their job. 

“We are the largest governmental office in all the county, so I would have laid off more employees than anyone," Clay said. "But I really care about my staff and their families, and I fight very hard for the people that work for me because they work so hard and I appreciate them. I just did everything that I could so that I didn’t lay off one single person. Their families and their jobs are secure."

The state's budget stalemate, which eventually was resolved by July 1, helped fuel layoff talk. Also, office personnel have indicated that staff cutbacks were responsible for delays of up to three weeks for court documents being scanned and made available to the public. 

“The state owes the county so much money – millions of dollars," Clay said. "Anything the budget or the state ends up giving that they owe will end up helping everyone, not just my office, but all the employees and therefore all the citizens in the county."

Clay stressed that she fought for her staff to avoid laying off anyone. 

“Obviously, anytime there is no state budget or anytime there is a financial crisis going on within the county and the state, there’s always the possibility [of layoffs], but that is why it is so key to work really hard and fight really hard for your employees," she said. "There’s always that possibility, but as long as that possibility stands, I’m going to keep fighting for my people.”

With an election for St. Clair County Circuit clerk coming in November, Republican challenger Dallas Cook told the Record that changes need to be made in the office to provide a better environment for the employees who work there.

“I want to create a more positive and comfortable work environment for those that have there and reward those that have been there in the circuit clerk’s office for a long time and not make them feel like they’re unwanted by bringing in other people and paying them more than they have and they’ve been there for 30 years," Cook said. 

According to Cook, employees at the St. Clair County Circuit Clerk office haven’t been allowed to unionize, even under Democratic leadership. 

 “I think everyone deserves to be treated equally no matter what their opinion is," he said. "They’re doing a civil service and working on behalf of the people and that’s what they should be worried is serving people. I don’t want them to feel like they’ve been slighted. I want them to feel like they are really valued. I know for a fact that’s not going on now. They deserve to be treated with respect and not looked down upon or mistreated.”

Illinois still needs structural reforms to revitalize economy

To the Editor:

I am hopeful the “stop-gap” budget approved last month will be a bridge to a full-year budget agreement that does not raise taxes. The plan passed on June 30 provides a surprising increase from last year’s funding for K-12 education in the upcoming school year, but it only provides six months of funding for human services, public safety and other state programs and services. That’s unacceptable and, most of all, the math does not seem to work. We need a 12-month budget - as required by our state constitution - that does not spend more money than we take in.

Springfield often forgets about the 12 million Illinois citizens and focusses instead on itself. In this case, placating the public in order to make it through the next election and knowing that this stop-gap might just result in another tax increase. For too long the motivation has been politics rather than the people. Growing government through overspending, overtaxing and overregulating hurts Illinois. It’s the primary reason why Illinois’ economy continues to struggle and why the state is so deeply in debt.

Illinois needs structural reforms to how it conducts public business and in the taxation and regulation of the free market economy. It’s critical that we implement pro-business and pro-jobs policies. Growing the economy will help get our state’s fiscal house in order. It means opportunity for employers and employees, thereby creating more revenue for government to provide the critical services for our most vulnerable citizens. A revitalized Illinois is important for our future too. Getting our fiscal house in order will help get our public debt under control so government does not become a burden for our children and grandchildren.

At the heart of the long budget stalemate is an argument that the budget and reforms should not be tied together. In reality, they are linked because they impact each other at the fundamental financial level and they impact the lives of Illinois citizens. The road to opportunity and prosperity is clear. It includes structural reforms to improve our business/jobs climate and government reforms. It means ending the failed policies of the past and being honest with the citizens about how much money we have to spend.

Let’s take the opportunity the “stop-gap” budget agreement presents and work together to restore confidence in state government, revitalize our economy, inspire hope and create opportunity for everyone.

Motorist alleges another driver's negligence caused crash

BELLEVILLE — A St. Clair County man is suing a Granite City transit company and a driver, alleging their negligence caused a vehicle crash that injured the plaintiff. 

Kendrick T. Barnes filed a lawsuit June 17 in St. Clair County Circuit Court against Dynamic Transit Company and Ronnie D. Wells of Jackson, Tennessee,  alleging Dynamic Transit negligently entrusted the vehicle to Wells.

According to the complaint, on Aug. 13, 2014, while Barnes was driving eastbound on Interstate Highway 64 in St. Clair County, he suffered severe injuries when a commercial vehicle driven by Wells suddenly turned into the plaintiff's lane of and struck Barnes'  vehicle. The suit says the crash caused Barnes to suffer great pain, medical expenses, loss of wages and benefits, and disability. 

The plaintiff alleges Wells carelessly operated the vehicle, failed to properly control the vehicle, failed to be attentive to the roadway, failed to yield right of way, failed to sound warnings, and failed to stay in his proper lane. The suit also alleges Dynamic Transit failed to porperrly train Wells properly.

Motorist blames Fayetteville driver for crash that injured plaintiff

BELLEVILLE — A St. Clair County motorist is suing another driver, alleging her negligence caused a crash that injured the plaintiff.

Betty Moreno filed a lawsuit June 24 in St. Clair County Circuit Court against Anastasia Maldonado of Fayetteville and USAA Insurance Agency Inc., alleging breach of duty and negligence. 

According to the complaint, on June 26, 2014, Moreno was driving southbound on state Route 4 while Maldonado was traveling in the same direction directly behind her. The suit says the defendant's then collided with the plaintiff''s vehicle. 

The lawsuit states Moreno sustained injuries to her head, neck, back and chest, loss of enjoyment of life and medical expenses. The plaintiff alleges Maldonado negligently caused the collision, failed to keep a careful look out, followed her vehicle too closely and that defendant USAA Insurance breached its contract for the under-insured motorist.

Belleville woman blames city for fall that led to injuries

BELLEVILLE — A Belleville woman is suing the city, alleging negligence led to her suffering injuries. 

Jody Jordan filed a lawsuit June 17 in St. Clair County Circuit Court against the city of Belleville, alleging negligence in failing to fix a dangerous condition.

According to the complaint, on Sept. 6, 2015, while Jordan cutting her grass at 17th and South Belt East in Belleville, she fell because of a dangerous retaining wall built by the city. The suit says the fall resulted in Jordan sustaining serious injuries, pain, suffering and medical expenses. 

The plaintiff alleges Belleville failed to warn her of the danger by posting a notice or a safety cone, and improperly built the retaining walls, creating a dangerous condition.

BELLEVILLE — An Illinois woman is suing a Fairview Heights motorist, alleging his negligence caused a vehicle crash that injured the plaintiff.

Carla Snow filed a lawsuit June 17 in St. Clair County Circuit Court against Matthew Decrevel, alleging negligence in failing to exercise due care with his motor vehicle.

According to the complaint, on July 28, 2015, Snow was in her motor vehicle and stopped on the shoulder of eastbound Interstate Highway 64 when suddenly Decrevel's vehicle collided with the plaintiff's vehicle. The suit says this crash caused Snow to sustain severe and permanent injuries to her head, neck and back that resulted in physical pain and mental anguish and incurred medical expenses. 

The plaintiff alleges Decrevel failed to keep proper lookout, failed to pay attention to traffic, failed to maintain proper speed, failed to maintain proper distance and failed to obey a traffic control device.

Property owners accuse contractor of false representation

BELLEVILLE — Belleville property owners are suing a contractor, alleging breach of contract, fraud, and false representation.

Margaret Lowery and The Margaret J. Lowery Revocable Trust filed a lawsuit June 17 in St. Clair County Circuit Court against Jerry Trent, doing business as Trent's Quality Construction in Belleville, alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, in April, Lowery met with Trent and discussed the needed repairs and remodeling to her property at 424 Christine Drive, Belleville after a plumbing accident. As a result of defendant's poor performance, the suit says, Lowery was financially damaged, including out-of-pocket losses and expenses, emotional distress and damages in connection with the bad reputation of her property. 

The plaintiffs allege Trent's Quality Construction advised her that the repairs were being paid under a policy insurance, misrepresented that Trent was licensed and bonded, failed, and refused to provide proof of insurance and bonding, and induced her to sign the contract.

Widow blames construction companies for husband's death

BELLEVILLE — A widow is suing construction-related companies, alleging their negligence caused her husband's death. 

Angela Behme, as special administrator of the estate of John Douglas Behme, filed a lawsuit June 20 in St. Clair County Circuit Court against Ameren Illinois Company, A.B. Construction & Development LLC, doing business as Keystone Construction & Development and Sheppard, Morgan & Schwaab Inc., doing business as SMS Engineers, alleging negligence and wrongful death. 

According to the complaint, on April 6, during the course of John Douglas Behme's employment with Keller Construction on a Villas of Nottingham project in Maryville, he was operating the excavating equipment. The suit says Behme struck an underground gas pipeline owned and operated by Ameren and the pipeline ruptured and exploded, resulting in Behme's death. 

The suit says Angela Behme has been permanently deprived of her husband's love, companionship, society, consortium, services, benefits, income and support. The plaintiff alleges the defendants failed to monitor the gas pipeline for appropriate depth and the line's integrity, failed to provide the actual location of the pipeline and failed to monitor the gas pipeline during construction and excavation in the area.

Customer blames Belleville Walgreens for injuries

BELLEVILLE — A St. Clair County woman is suing a Walgreens store in Belleville, alleging its negligence caused her to fall and suffer injuries. 

Eileen Henderson filed a lawsuit June 17 in St. Clair County Circuit Court against Bond Drug Company of Illinois LLC, doing business as Walgreens No. 4024, William L. Frein and Mildred A. Frein, alleging their negligence permitted the facility to become and remain in a dangerous condition.

According to the complaint, on July 29, 2014, Henderson was shopping inside the defendants' facility in Belleville when she was distracted by merchandise in an aisle. The suit says she encountered debris on the floor, which caused her to to fall and suffer injuries of personal and pecuniary nature. 

The plaintiff alleges the defendants improperly managed and maintained the premises, failed to properly monitor the floor to ensure that dangerous conditions did not exist and failed to warn Henderson of such dangerous conditions.

Conductor alleges Illinois Central negligence caused his injuries

BELLEVILLE — A conductor is suing Illinois Central, alleging its negligence caused him to suffer injuries.

Jonathan Jones filed a lawsuit June 17 in St. Clair County Circuit Court against Illinois Central Railroad Company, alleging negligence in failing to provide a safe place to work.

According to the complaint, on June 21, 2013, during the course of Jones' employment, he was injured when he fell while walking along the Illinois Central tracks near mile 32.9 on the defendant's Lenzburg lead. His injuries caused him to suffer great physical pain and mental anguish, loss of earning capacity and loss of normal life, the suit says. 

The plaintiff alleges Illinois Central failed to respond to employee complaints about the difficulty of walking on ballasted surfaces in the area of its tracks, required Jones to walk on improperly ballasted surfaces and allowed limestone to accumulate along the walking surface.

Consumer accuses cleaning product manufacturer of false merchandising

BELLEVILLE — A St. Clair County woman is suing a cleaning products manufacturer, alleging deceptive, unfair and false merchandising practices and unjust enrichment.

April Dugan, filed a lawsuit, individually and on behalf of all other similarly situated citizens of Illinois, June 15 in St. Clair County Circuit Court against CleanWell LLC, alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act.

According to the complaint, in March, Dugan was deceived after reviewing the all-natural label on the product she had purchased, the CleanWell All Natural Antibacterial Foaming hand soap. As a direct and proximate result of defendant's unlawful conduct, the suit says, she has suffered economic damages for paying more for the product. 

The plaintiff alleges CleanWell marketed, distributed and sold the product as all-natural but it contains harmful artificial, synthetic ingredients and chemicals and that CleanWell took advantage of the growing market by labeling the product as all-natural.

Dugan seeks a trial by jury, certification this case is a class action, compensatory damages, pre-judgment and post-judgment interest, attorney fees, legal costs and for such other relief as is just and proper. GOP lawmakers file resolution to remove Mautino amidst state, federal investigations

CHICAGO – Illinois lawmakers want to remove the state’s auditor general from office as federal and state probes continue into the former state representative's questionable spending of campaign finances.

The 20 lawmakers, all Republicans, filed a joint House resolution today calling for the removal of Illinois Auditor General Frank Mautino, currently under federal and state investigation over questionable campaign fund expenditures.

The legislators are asking House Speaker Michael Madigan (D-Chicago) to bring the resolution, HJR 158, to the floor of the House when the Assembly next meets later this year.

State Rep. Dwight Kay (R-Glen Carbon), the key sponsor of the resolution to remove Mautino, said the state deserves an auditor general “beyond reproach and of the highest ethical standing.”

“Illinois deserves an auditor general free from any overhanging financial investigations, including a federal investigation for potential illegal campaign expenditures and a state investigation for the same," Kay said at a press conference today at the Thompson Center in downtown Chicago.

“As the auditor general labors under the weight of state and federal investigations, which could continue for a long duration of time, the citizens of Illinois and the General Assembly must have complete, unreserved confidence that the Office of Auditor General is able to operate effectively and without the hint of scandal," Kay said.

The lawmakers earlier had asked Mautino to take unpaid leave while the federal investigation proceeds. Kay said Mautino failed to respond to requests by legislators for information.

“Illinoisans deserve a clean government, and Auditor General Mautino, by his refusal to respond to public questions surrounding his ethical conduct, has demonstrated that he is unfit to remain in office,” Kay said.

Mautino was appointed as auditor general by the General Assembly in October and took office in January. Almost immediately, questions arose about campaign finance spending during his 24 year tenure as a member of the House of Representatives.

A Democrat from that small downstate town of Spring Valley, Mautino rose through the ranks in the Democratic Party to become Deputy Majority Leader.

He is now facing numerous inquiries, including that concerning the approximately $200,000 spent over 10 years on gas and vehicle repairs at a single Spring Valley service station.

Mautino also made $259,000 in payments to a local bank since 1999, his campaign finance filings said.

In May, it was disclosed that the U.S. Attorney’s Office is investigating Mautino. The Illinois State Board of Elections has also launched its own probe into Mautino's campaign finances.

Mautino sought a stay on the Board of Elections investigation while the federal probe continues. Board members on Monday voted 5-3 to continue the investigation.

In a separate motion, the board decided to give Mautino two weeks to file amended reports. If no reports are filed, the case will go to a public hearing, which would give the person who filed the complaint subpoena power.

Mautino’s attorney said the auditor general could invoke his Fifth Amendment right against self-incrimination because of the ongoing federal investigation into campaign spending, a report by the Illinois News Network said.

Kay, flanked by three of his colleagues at the press conference Wednesday, is pressing Madigan to bring the resolution to the floor of the House.

"Everything in Springfield happens according to the wishes of Mike Madigan," Kay said. "I think if the speaker doesn’t act, he’s going to find a lot of pressure coming forward from members of the General Assembly and the general public."

Kay said the auditor general is a position in which transparency is at the very heart of the job itself, adding that this official must be able to "operate effectively and without the hint of scandal."

"Illinoisans deserve a clean government, and Auditor General Mautino has done nothing to suggest he is up to the task,” Kay said.

Kay said the resolution gives Mautino the opportunity to address both houses of the state legislature and to respond to the charges against him.

State Rep. Jeanne Ives (R-Dist. 42), a co-sponsor of the resolution, said action needs to be taken.

“Frank Mautino cannot effectively do his job as auditor general while defending himself against potential criminal charges and a State Election Board investigation," Ives said. “If he will not do the right thing on his own and step aside, we have a responsibility as the people’s elected representatives to hold him accountable.”

A spokesman for Mautino said today that the auditor general had no comment on the resolution.

Legal experts differ on Mo. governor's Daubert veto; Business leader says it leaves negative mark on state

Legal experts in Missouri are divided on the governor's veto last month of a bill that would have enacted new guidelines for judges when approving expert witnesses.

Senate Bill 591 would have required the state to adopt federal guidelines for admissibility of expert witnesses. Those federal guidelines – commonly referred to as the Daubert standard – are a list of enumerated rules designed to guide a judge evaluating the admissibility of an expert witness.

In his veto, Gov. Jay Nixon wrote that Missouri already had “well-established” criteria to guide judges in admitting expert testimony and that SB 591 would replace that criteria with a “complicated and costly procedure.”

“Senate Bill No. 591 would not improve upon this existing model but rather would abandon our current approach for the purpose of targeting injured litigants, whether individuals, small businesses or others, by making it more expensive – and perhaps cost prohibitive – to bring forward their claims,” Nixon wrote.

Though 46 states follow either the Daubert or the Frye standard when assessing admissibility of expert witnesses, Missouri – along with Nevada, North Dakota and Virginia – have neither.

Missouri follows state statute 490.065. While similar to Daubert, the statute weighs not only the expert’s knowledge, skill, experience, training and education, but also the expert’s “reasonably reliable” opinion.

The Frye standard asks judges one question: whether the method used to obtain evidence is generally accepted by experts in the field.

The Daubert standard is a five-part test. According to the Cornell University Law School, it asks:

(1) whether the theory or technique in question can be and has been tested; (2) whether it has been subjected to peer review and publication; (3) its known or potential error rate; (4) the existence and maintenance of standards controlling its operation; and (5) whether it has attracted widespread acceptance within a relevant scientific community.

Experts in Missouri disagree on the importance of Nixon's veto. Some claim without Daubert, judges hold too much power in determining the admissibility of an expert witness, leaving too much uncertainty for big businesses which thrive on certainty. These experts say that could be a deterrent for businesses and the jobs they create and deter their interest in that state. Still, others say the statute in place is sufficient and that Missouri judges already adhere to a strict standard.

Attorney Andrew Blackwell with Capes Sokol in St. Louis said he does not believe adopting the Daubert standard would have made much of a difference in the decisions being made.

“I know there’s been people who believe that this is a greater hurdle than what Missouri already had in place; I don’t personally believe that,” Blackwell told the Record. “I think Missouri judges already had to weigh the credibility of experts under the existing statute. I just think this (would have) provided a little more clarity and direction they have to take when assessing the reliability and credibility of experts.”

That extra direction, however, could be good for new and developing methodology in providing evidence. Through Daubert, Blackwell explained, there’s not one specific factor a judge has to consider.

Blackwell said he’s worked with experts before in court who have developed new processes and theories that aren’t yet widely used, but could be tested. Under the Frye standard, they wouldn’t hold up, he said.

“Those individuals perhaps can be precluded under our existing statute, whereas here there’s a little more room to find someone who’s a leader in their field or industry,” Blackwell said. “Someone who’s doing something a little different, but maybe helpful for you if you’re in a specific type of case that warrants that.”

A state business leader, however, has a different opinion on the veto, saying the governor does a disservice to the people of Missouri by sending out a red flag warning to businesses interested in coming to the state.

“The Governor is ignoring the pleas of the business community by rejecting the common-sense standard already in effect in the federal courts and the vast majority of state courts,” said Brian Bunten, general counsel and director of Legislative Affairs with the Missouri Chamber of Commerce and Industry. “Our members are simply asking for uniformity of the standard an expert witness must meet in order to be allowed to testify as an expert in our courtrooms and federal courtrooms.”

The Daubert standard is employed by 39 states; Frye by eight. The lack of federal regulation in terms of expert witnesses doesn’t make Missouri the most welcoming state, according to Bunten.

“Our lack of the Daubert standard is explicitly cited as a reason why Missouri lags behind the rest of the nation when it comes to a fair business climate in our courts,” Bunten said. “These distinctions are nothing to be proud of and Missouri’s economy continues to suffer until we enact bold legal reforms.”

Statements like those, Blackwell believes, are hyperbolic.

“There’s this belief that by adopting this language it will make it harder to qualify an expert. And I think I’ve kind of said, I don’t think that’s necessarily true,” Blackwell said.

The Missouri Chamber of Commerce and Industry resolves to continue the fight to make the state a more attractive place to do business. According to Bunten, vetoing Daubert only emboldens their cause.

“We are certainly disappointed in Governor Nixon’s veto, but it’s par-for-the-course for the Governor,” Bunten said.”Nixon has done the bidding of the plaintiff’s bar — his campaign’s most prolific contributors – his entire 30 year career. It has left a profoundly negative mark on Missouri’s business image.”

Gov. Jay Nixon vetoed Senate Bill 591 June 28. The bill was passed by the house April 27 and passed on to Gov. Nixon May 25.
