BELLEVILLE — A widow is suing CSX Transportation Inc., her deceased husband's former employer, alleging an unsafe work environment and insufficient measures taken to prevent injuries.
Sheree Lee, executrix of the estate of David G. Lee, filed a complaint on Oct. 21 in St. Clair County Circuit Court against CSX Transportation Inc., alleging that the railroad corporation violated the Locomotive Inspection Act.
According to the complaint, the plaintiff alleges that during the course of decedent David Lee's employment with with defendant from 1974 to 2009, he was exposed to products containing asbestos fibers. His exposure to the toxic substance contributed to the development of his stomach cancer, which later spread to his colon and led to his death on Jan. 24, 2014, the suit alleges. As a result of her husband's death, plaintiff Sheree Lee suffered pecuniary losses, she claims. The plaintiff holds CSX Transportation Inc. responsible because the defendant allegedly failed to provide decedent with a safe place to work, free from asbestos fibers.
The plaintiff requests a trial by jury and seeks judgment in an amount greater than $50,000, plus costs of this suit and for all other relief as the court may deem just and proper. She is represented by Michael V. Oltmann of Goldenberg Heller & Antognoli PC in Edwardsville.
