BELLEVILLE — A vehicle passenger is suing Liberty Mutual Fire Insurance Company and motorist Jason Glasper, citing alleged breach of contract and negligence.
Jay A. Isaak filed a complaint on Sept. 16 in St. Clair County Circuit Court against the defendants, alleging that Liberty Mutual breached its contractual obligation pursuant to its uninsured motorist provisions and that Glasper was negligent in operating a motor vehicle.
According to the complaint, the plaintiff alleges that on Nov. 4, 2014, he was a passenger in a vehicle being operated by a driver carrying automobile insurance coverage through Liberty Mutual when the vehicle was struck by a vehicle driven by Glasper, who don't have an automobile insurance coverage. The plaintiff says he made a claim against Liberty Mutual under its uninsured motorist provision because of injuries he suffered, but has been denied payment. The plaintiff holds Liberty Mutual Fire Insurance Company and Glasper responsible because Glasper allegedly negligently operated his vehicle and Liberty Mutual allegedly failed and refused to make a proper payment for a claim.
The plaintiff requests a trial by jury and seeks judgment against the defendants in excess of $50,000, costs for this action, pre- and post-judgment interest and any further relief. He is represented by Robert J. Radice of Horas, Radice & Associates LLC in St. Louis.
