Pierre Sanders and other plaintiffs filed the suit April 13 in St. Clair County Circuit Court against Combe Incorporated, Combe Products Inc., Combe Laboratories Inc. and Combe International Ltd.
This suit alleges that all the plaintiffs suffered physical injury in connection with their use of Just For Men hair care products, manufactured by the defendants.
Even though the defendants allegedly knew that many users of its products would have allergic reactions, they failed to warn customers of such, according to the complaint.
The defendants failed to warn users of an adverse reaction to the product, do not have any information about adverse reactions on their website or advertising, and failed to warn that African-American customers are at higher risk for an acute reaction than Caucasians, according to the complaint.
The counts against the defendant include four strict product liability claims, negligence, breach of express warranty, breach of implied warranty, and negligent representation and fraud.
The plaintiffs seek judgment for each claim in excess of the jurisdictional requirements for the court, court costs and other relief the court deems proper. They are represented by John J. Driscoll and Philip Sholtz of The Driscoll Law Firm PC in St. Louis and Richard W. Schulte in Vandalia, Ohio.
