Dawn Lymberopoulos filed the suit on behalf of Donna LeVar in Madison County Circuit Court against Christopher S. McCoy and Wigglers LLC.
On Dec. 23, 2015, plaintiff LeVar was driving westbound on Moro Road near the intersection with Illinois Route 159 in Moro Township, and the defendant was also driving westbound on the same stretch of roadway, the suit says.
The defendant allegedly failed to obey a traffic signal at the intersection and collided with LeVar's vehicle from behind at a high rate of speed. The suit further alleges that the defendant left the scene of the accident.
The complaint against Wigglers comes under the Dram Act, since McCoy allegedly purchased liquor there; he subsequently drank the liquor and became intoxicated, according to the complaint.
The plaintiff had severe injuries including brain trauma, diminished earning capacity, disability and loss of a normal life, according to the complaint. In fact, the dramatic scope of her injuries resulted in the appointment of Lymberopoulos as her temporary guardian, the suit claims.
The plaintiff seeks judgment against both defendants in excess of $50,000 plus court costs and other relief the court deems proper. She is represented by Eric J. Carlson of Byron, Carlson, Petri & Kalb LLC in Edwardsville.
